This tender concerns the award of the framework agreement of Military Boots. The system will be used across all the armed services, and will be the soldier's primary work footwear, both during daily work and during extended combat operations. Without footwear that fits ergonomically, or suit the environment, the soldier can not be expected to perform optimal. Therefore this tender aims to provide each soldier with a boot that fits him/her individually and that provides the necessary protection in different environments. For this tender DALO wishes to divide the framework agreement into 3 lots.
Lot No 1 Combat boot with five assortment categories — will be awarded to 3 suppliers.
Lot No 2 Patrol boot with four assortment categories — will be awarded to 3 suppliers.
Lot No 3 Desert boot and Jungle boot with no assortment — will be awarded to 1 supplier.
Tenderer shall offer the mandatory boot(s) in each lot (Combat boot, Patrol boot and Desert boot and Jungle boot).
Each lot is non exclusive.

This lot concerns a obligatory Combat boot to be used in mud, grass, asphalt and paving. Key words for the Combat boot are ankle support, water resistance and insulation.
This Lot contains an optional assortment with five (5) assortment categories listed below:
1- Fast rope boot;
2- Water shoe;
3- Climing boot;
4- Diving boot;
5- Over the beach boot (OTB).
The tenderer can offer up to five (5) boots in each assortment category. The tenderer will only receive points for maximum three (3) boots in the assortment category. The tenderer can achieve maximum points by offering 15 boots in total. DALO will count the offered boots in each assortment category, but maximum three (3) boots fulfilling all requirements set out in Requirement specification. This Lot contains an optional assortment with four (4) assortment categories listed below:
1- Tactical running shoe;

3- Desert bootie;
4- Tactical sandal.
The tenderer can offer up to five (5) boots in each assortment category. The tenderer will only receive points for maximum 3 boots in the assortment category. Tenderer can achieve maximum points by offering 12 boots in total. — Desert boot: Primary terrain of this type of boot is sand, coast and dust covered chippings. Key words for the Desert boot are breathability and excess of heat.
— Jungle boot: Primary terrain of this type of boot is mud, water and jungle. Requirements in focus for Jungle boot are draining of water, dry time and slip resistance on wet logs.

The candidate must use the European Single Procurement Document (ESPD) as provisional evidence in replacement of certificates issued by public authorities or third parties confirming that the candidate fulfils the minimum requirement stated below with respect to the standards required, and how the candidate fulfils the objective and non-discriminating criteria for prequalification, cf. §148 (1), cf. §145 (2) of Danish Act on Public Procurement (act No 1564 of 15.12.2015 — available at www.retsinformation.dk). Prior to DALO's decision concerning award of the contract, the candidate to whom DALO intends to award the contract must submit documentation for the information given in the ESPD in accordance with § 151 of the said Act. A list of the most important similar deliveries carried out over the past three (3) years. The list should preferably include:
— A description of each delivery;
— Information on when it was carried out;
— The quantity and quality of the deliveries;
— The recipients of the deliveries (specific names/countries are preferred, but need not necessarily be included; if no country specific information is included the candidate is asked to provide as much generic information as possible about the delivery). Betingelser for opfyldelse af kontrakten:
Reference is made to the tender documents with regard to the payment terms. Invoicing must be done in accordance with the applicable Danish legislation on public payments. At present, this is Danish consolidation act. No 798 of June 2007 which requires invoicing to be done electronically. Exact terms will be stated in the contract.

No particular legal form is required. If the contract is awarded to a group of suppliers (e.g. a consortium) the participants are required to undertake joint and several liabilities and to appoint one supplier to represent the group.

It is expected that a need for highly specialised military boots will occure during the duration of the framework contracts. The exact requirements to these specialised boots will depend on a number of various issues, primarily the operational requirements which again depend on where the Danish defence is deployed. The exact requirements can therefore not be determined at this point. Such special needs, if it occurs, will be acquired in accordance with regulation in §8 (2) in the Danish Act on Public Procurement (act No 1564 of 15.12.2015).

A candidate participating alone and who does not rely on the capacity of other entities to fulfil the criteria for choosing the limited number of candidates shall only complete one ESPD. Please note that in relation to section III.1.2) and III.1.3), a candidate may rely on the capacities of other entities (eg. a parent or sister company or sub supplier), regardless of the legal nature of the links between them. The form of submission of commitment and the letter(s) of comfort herein must be completed in addition to the ESPD. DALO strongly encourages the candidates/tenderers to use this form when submitting their applications. However, it is emphasized that it is the sole responsibility of the candidate that the information provided fulfils the requirements.

Finally when groups of entities, including temporary joint ventures, participate in the tender procedure together, each of the participating entities must complete a separate ESPD with the information required in section II.IV.
Prior to the decision on award of the contract documentation for the information stated in ESPD must be produced, cf. §§151-155 of said Act. DALO further reserves the right to at any stage of the tender procedure to request a candidate to submit documentation, if this is required to secure that the procedure is conducted correctly. In this situation DALO will set an appropriate time limit for submission of the documentation. DALO shall exclude a candidate from participation in the tender procedure, if the candidate is subject to one of the mandatory exclusion grounds in §§ 135 and 136 of said act. The candidate shall submit information in this respect in the ESPD. Special attention is drawn to the fact that certain voluntary exclusion grounds have been made mandatory in § 136 of the ACT.
