The Fehmarnbelt Fixed Link Project (‘Project’) is the final stage in the realisation of a straight traffic corridor between Scandinavia and continental Europe. This is intended to be an immersed tunnel containing two dual carriageways and a twin-track railway (‘Tunnel’). It will traverse the 18 km distance across the Fehmarnbelt between Rødby on the island of Lolland in Denmark and Puttgarden on the island of Fehmarn in northern Germany.
Femern A/S has been appointed as the infrastructure manager of the Fehmarn Railway System under the Treaty between Denmark and Germany relating to the Fehmarnbelt Fixed Link.
This notice relates to the Tunnel Power Supply (‘TPS') contract.
The Tunnel Power Supply station will be located at Rødby on Lolland. Energinet.dk will construct two independent underground 132kV supply lines from Nakskov and Sakskøbing including switchgear, housings and bus bars under a separate contract. The TPS contract relates to the design, construction and maintenance of the sub-systems to provide a power supply to the Fehmarn Railway System and a power supply to the Tunnel and its ancillary facilities. Femern A/S' programme plans for the road and ancillary facilities sub-system to be operational and handed over to Femern A/S in 2018, with the railways sub-system to be operational and handed over in 2020. The TPS contract includes (without limitation):
Railways and Road/Ancillary Facilities Sub-Systems: The design, manufacture and installation of the following (without limitation):
— 2 x 20 kV three phase transformers for the tunnel power supply (excluding switchgear for 20kV);
— 3-5 x 25 kV single phase transformers for the railway traction power supply and 25kV balancing convertors or 3-5 x 25kV invertor transformers;
— switchgear for the 25 kV power supply;
— filter equipment (if necessary);
— earthing of the entire Power Supply station (including the main earthing bar);
— 400 V uninterruptible power supply;
— control systems (including for remote operation);
— testing, safety and technical approvals; and
— such other works, supplies and/or services that are necessary to deliver the sub-systems.
Ancillary Civil Works: Femern A/S will contract with a civil works contractor to prepare the site for the Tunnel Power Supply station. The prepared site will comprise of a prepared and elevated gravel platform and sheet pile flood protection with watertight portals. The TPS contractor will be required to design and construct on the prepared site:
— buildings and fit out for the switchgear, control room and site employee facilities; and
— related works such as foundations, oil spill troughs for transformers, internal roads and paving, drainage for the entire Tunnel Power Supply station (including oil spill collectors, connections to local utilities and facilities), lighting and noise damping.
Maintenance Services: The TPS contractor will be required to provide reliability-centred maintenance for the system and the ancillary civil works from the date of hand-over for the duration of the defects notification period. It is intended that the defects notification period and the provision of maintenance services of the entire scope will expire 5 years from the date of hand-over of the railways sub system.
Other Information: The TPS contractor will be required to coordinate closely with other Project contractors and Energinet.dk in relation to the design and execution of the works and the management of interfaces. The TPS contract will cover such works, supplies and/or services that are ancillary to the works set out above.

Femern A/S has an ongoing procurement process for the Tunnel Power Supply (‘TPS') contract. However, this procurement process has been awaiting the process regarding obtaining the final German plan approval. Femern A/S has carried out a market consultation (see 2019/S 176-429426). Following this Femern A/S has now concluded that continuing with the paused procurement is no longer viable. Femern A/S wishes to pursue the best overall value for the project and has determined this is best achieved by making a new call for competition. Femern A/S has accordingly decided to terminate the procurement process in order to make a new call for competition. Such a new call for competition will e.g. allow Femern A/S to make needed changes in the tender material without consideration to the original tender material (e.g. award criteria, etc.). Femern A/S expects to start a new procurement process during 2020.

Complaints regarding decisions related to the tender must be submitted to the Danish Complaints Board for Public Procurement within 45 calender days after the contracting authority has published a notice in the Official Journal of the European Union that the contracting authority has entered into a contract. The deadline is calculated from the day after publication of the notice, cf. Section 7(2) in the Act.
