The construction phase of the Femern fixed link is connected with numerous environment related tasks, the execution of which Femern A/S intends to award to an environmental consultant. The geographical scope of the services under the Framework Agreement will be limited to the territory of the Federal Republic of Germany and its associated Exclusive Economic Zone. The Consultant's Services cannot be described definitively. However, the Consultant is expected to perform the following Services in general: • Preparation of environmental plan amendment applications • Environmental construction inspection (Umweltbaubegleitung – UBB) • Review of Landscape execution plans (LAP) • Preparation and updates of environmental management concepts • Review of Contractors’ documents • GIS services

List and brief description of selection criteria:
The tenderer must complete and submit the European Single Procurement Document (“ESPD”) as preliminary documentation for the purpose of assessing whether the below minimum requirement for economic and financial suitability are fulfilled, cf. section 148 (1)(1-2) of the Danish Procurement Act and Article 79(2) of Directive 2014/25/EC. Information about the tenderer’s annual turnover must be filled in under Part IV, B of the ESPD.

If the tenderer consists of a consortium or any other group of legal persons and/or public entities, the above documents shall be provided for each of the legal persons and/or public entities and if relevant from its supporting entities. A tenderer which bases its tender on the economic and financial standing of other entities must provide the above documentation for each entity.

Mindstekrav til niveauet:
As a minimum requirement the tenderer must document that:
• The tenderer for each of the last 3 financial years have had an annual turnover of at least EUR 2.5 m.
Teknisk og faglig kompetence:
The tenderer must complete and submit the ESPD as preliminary documentation for the purpose of assessing whether the below minimum requirements for technical and professional ability are fulfilled. The list of deliveries of services must be inserted under Part IV, C of the ESPD and is the final documentation. No further evidence or documentation regarding technical and professional ability will be requested before Femern Bælt A/S awards the Framework Agreement, however Femern Bælt A/S reserves the right to contact the customer indicated on each delivery in order to verify the reference.

The ESPD is completed with a list of main deliveries of services carried out within the last 5 years stating amount and time and the public or private recipient, including contact information.
No more than 5 references for deliveries should be listed in the ESPD. If the ESPD contains more than 5 references only the first 5 references will be taken into account. References included in the tenderer’s own ESPD will in this respect be considered the first 5 references. In the event that the tenderer is a group of economic operators or a temporary association (consortia, joint venture or the like) the references from the leading operator will be considered the first 5 references. In the event that this provision do not determin the first 5 references Femern A/S will draw lots to elect the first 5 references (tenderers will not be allowed to supervise the draw).

As minimum requirements the tenderer is required to document:
• At least 1 reference covering a high-speed rail project, motorway project or civil structure (in German: Hochgeschwindigkeitseisenbahnen, Autobahnen, Ingenieurbauwerke) where the tenderer has delivered environmental consultancy services for a fee of no less than EUR 1 m.;

Please note, that 1 reference may cover both of the above minimum requirements.

1) Re the ESPD: the tenderer must complete and submit the electronic ESPD which serves as preliminary evidence of fulfilment of the conditions for participation in the tender procedure, including that the tenderer is not subject to the grounds for exclusion. Femern A/S reserves the right, at any time during the tendering procedure, to request the tenderer to provide documentary proof, cf. Section 151 of the Danish Procurement Act, if required to ensure the proper execution of the procedure. In this situation, Femern A/S will set an appropriate deadline for the submission of documentation. Before awarding the framework agreement, the tenderer to whom Femern A/S intends to award the agreement must provide documentation concerning the information in the ESPD, cf. Section 153 of the Danish Public Procurement Act. Femern A/S has prepared the electronic ESPD for the economic operator to fill out. The electronic ESPD is available at the link set out in Section I.3.
