The tender material, including the tender conditions, is published via the Internet-based eSourcing system, CTM from EU-Supply. Thus, the tender material, including any Corrigendum, downloaded via
https://eu.eu-supply.com/ctm/supplier/publictenders?B=REGIONMIDT All communication regarding this tender must take place via EU-Supply in accordance with the tender conditions — and not via the client's email stated above.
Access to the tender material and participation in the tender requires online registration in EU-Supply. It is free to register as a user in the system. After registration, (Tenderer/Applicant) logs in to the upper left corner. Then there is an overview of all the region's tenders, and the relevant tender is clicked on, after which the tender material appears, including the appendices that must be submitted as part of the total tender.
Please note that both the contracting authority's and Tenderer/Applicant's' actions are logged in the system.

Questions about the tender itself must be asked to the contracting authority via the question/answer module inside the system. Answers to these questions are published in anonymous form in the system, where they are available to everyone.
The provisions of the Public Procurement Act (sections 135-137) reflect the final and complete wording of the provisions on which the exclusion grounds stated in ESPD are based. The voluntary exclusion grounds stated in section 137 only apply to the extent stated in ESPD.
In addition to the mandatory grounds for exclusion in the Public Procurement Act, the following of the voluntary grounds for exclusion in the Public Procurement Act apply in this tender:
• breaching of obligations in the field of environmental law;
• breaching of obligations in the field of social law;
• breaching of obligations in the field of labour law;
• bankruptcy;
• insolvency;
• arrangement with creditors;
• analogous situation like bankruptcy under national law;
• assets being administered by liquidator;
• business activities are suspended;
• agreements with other economic operators aimed at distorting competition;
• guilty of grave professional misconduct.
