All applicants are encouraged to read the entire material before applying in the form of ESPD. If the application contains multiple versions (versions) of the same document, the most recently uploaded version will be the applicable one. All communication, including questions, must be done through ethics. Questions received later than 6 days before the deadline cannot be expected to be answered. Applicant must submit an ESPD, as his application, as preliminary evidence of the above mentioned circumstances. The applicant will be excluded from participation in the tendering procedure if the applicant is covered by the compulsory grounds for exclusion mentioned in sections 135 and 136 of the Procurement Act, cf. section 10 of the implementing order, as well as the grounds for exclusion listed in section 137 (1) of the procurement law. 1, No 2, cf. section 10 of the implementing order, unless the applicant has provided sufficient evidence that it is reliable in accordance with section 138 of the Tendering Act. The requested information forms the basis for the contracting authority's assessment of whether the applicant is suitable for fulfilling the tender offered and the applicants who are invited to submit tenders. If the applicant participates in the tendering procedure with others, in particular as part of a group, consortium, joint venture or similar, all affected participants must submit a separate ESPD. All required information under ESPD Part III must be provided for each participant in the consortium. However, in the suitability assessment, the consortium's overall suitability will be assessed. If the required information is not provided by all consortium participants, the offer is not necessarily non-conditional, but it may affect the suitability assessment. In addition, each participant in the individual ESPD must indicate the role of the economic operator in the group, the other economic actors participating in the procedure and, where appropriate, the name of the participating group (ESPD Part II.A). If the applicant relies on the financial and economic and/or technical and professional capabilities of other entities, they shall also attach a separate ESPD with completed Part II, sections A and B and Part III duly completed by the entities concerned (ESPD Part II .C). In the suitability assessment, it will be the total fitness assessed. Applicants can only submit one ESPD. If the same legal entity is part of or otherwise participates in several tenders, the tenderer must ensure that the same legal entity's participation does not lead to the possibility of mutually influencing the content of the different tenderers' offers. The tenderer must enclose a completed ESPD Section IV.B which is completed as described below.
Associations of economic operators, including temporary associations, may participate in the procurement procedure, cf. Article 37 of the public works directive.
Associations of economic operators must meet the criteria and requirements of ‘Economic and financial capacity’ and ‘Technical and professional capacity’. This can be done so that one or more members of the association of economic operators alone or together

1) Satisfies the requirements of the minimum requirements laid down; or
2) Relies on other companies' economic and financial and/or technical and professional capacity (supporting companies), so that the supporting company completes and submits a separate ESPD. If there are several supporting companies, all supporting companies must complete and submit their own ESPD, so that all the criteria and requirements are met by either the association of economic operators or one or more of the economic players.

It is a minimum requirement that the applicant has:
— positive equity in the last completed and audited financial year,
— annual turnover of DKK 15 000 000 in each of the last 3 available, completed and audited financial years.
Teknisk og faglig kompetence:
Tenderers must enclose a completed ESPD Section IV.C, completed as described below.
Applicants are required to state, in Section IV.C of the ESPD, the following regarding technical and professional capacity, cf. section 143 of the Procurement Act, cf.
— applicants' most significant deliveries of similar projects, as described in points II.1.4) and II.2.4),
— applicant must complete the ESPD, stating the year or period of execution of the project, the description of the project, the beneficiary and the contract value.
In addition, the applicant must explain why the individual reference is comparable with reference to the conditions described below.
— Applicant can enter a maximum of 5 references.
References beyond the first 5 listed references will not be considered.

Pursuant to Section 3 of the Danish Consolidation Act No 593 of 2 June 2016 on the Complaints Board for Public Procurement, the following time limits for filing a complaint apply:
Complaints must in accordance with § 7(2) of the Act on the Complaints Board for Public Procurement be filed with the Complaints Board for Public Procurement within 6 months starting the day after the contracting authority has sent notification to the candidates involved that the contracting authority has entered into the framework agreement, cf. § 2(2) or § 171(4) of the Public Procurement Act, provided that the notification included a short account of the relevant reasons for the decision.
