terminals and subscriptions to support personal communication for the Danish Defence. The framework
agreement also contains accessories, spare parts, services as help desk, repair function and training. The
communication is call based as well as data traffic. It is forseen that the data based communication will increase
going forward as the satellite operators plan to expand the communication and data capacity substantially within
the period of the framework agreement. The subscriptions must support different use patterns. The terminals

The terminals can be both personal wearable phones with small weight and long battery

time as well as fixed mounted terminals for i.e. navy vessels. The satellite

connection may also be in the form of a communication hub, connecting to other

devices like smart phones or computers. The satcom device may also be connected

to a VHF or UHF tactical radio to extend the range via a commercial satellite

connection. The supplier shall be able to manage subscriptions with short

activation and de-activaion time. It shall be possible for designated people from

Danish Defence to monitor voice and data traffic for individual subscriptions and

to introduce limits for traffic with alarm settings. The management service may

be web based and shall be avalable 24 hours a day, 7 days a week. The

management service shall include information of the operational status of the

satellite communication service. Due to the nature of satellite based

communication, the subscription and capacity requirements will be different for

the low orbit satcom compared to the geostationary satcom.

The terminals and subscriptions described in this tender are to be used in both

International Operations (INTOPS) as well as National Operations (NATOPS). The

use patterns various from low planned traffic to intense traffic for both voice

based communication and data communication.

Voice based communication and data communication shall be routed to the Danish

Defence internal communication network through dedicated connections and

should, where possible, not be routed via the Public Switched Telephone Network (PSTN).

In this setup a simpler control of cost and quality may be achieved. The

access point for the satellite operator connection to the dedicated connection

shall be located in a NATO country.

Following catagories is part of the framework agreement;

— Products: Terminals, SIM-cards, devices, accessories and spare parts for new and

for existing equipment.

— Subscriptions: Voice and data subscriptions, subscription management tool and

satellite tracker management tool.

— Services: Help desk, repair function and training.

Reference is made to the tender documents regarding payment terms. Invoicing must be done in accordance with the applicable Danish legislation on public payments. At present, this is Danish consolidation act. No. 798 of June 2007 which requires electronic invoicing. Exact terms are stated in the contract.

No particular legal form is required. If the contract is awarded to a group of suppliers (e.g. a consortium), the participants shall undertake joint and several liabilities and to appoint one supplier to represent the group.

The framework agreement must be conducted in consideration of social responsibility (CSR) and it contains a labour clause, please see Appendix B — CSR requirements for further information.

DALO demands that the tenderer and each of the legal entities whose capacities the tenderer relies on undertake joint and several liability for the performance of the contract.

The use of the ESPD is a precondition for participation in the procurement procedure, cf. § 148 of the Public Procurement Act. DALO shall require that the tenderer apply the ESPD as preliminary evidence that the tenderer is not subject to the grounds of exclusion stipulated in §§ 135 and 136 of the said Act.

The tenderers and, if relevant, the participants in the group of entities and/or supporting entities, must use the electronic version of the ESPD. DALO has prepared an ESPD (an XML-file) available at ETHICS. DALO strongly encourages the tenderer to use this XML-file when completing the ESPD. The tenderer must upload the XML-file to this website https://ec.europa.eu/growth/tools-databases/espd/welcome where the ESPD can be completed and later exported. No other versions than the ESPD shall be used.

Prior to decision on award of the contract, DALO shall require that the tenderer to whom DALO intends to award the contract presents documentation for the information stated in the ESPD, cf. §§ 151-155 of the said Act. DALO has prepared a template to be used to confirm the legal obligation which is available at ETHICS. DALO strongly encourages the tenderers to use this form. However, it is emphasized that it is the sole responsibility of the tenderer that the information provided fulfils the requirements

DALO shall exclude a tenderer from participation in the procurement procedure, if the tenderer is subject to one of the compulsory grounds for exclusion in §§ 135 and 136 of the said Act unless the tenderer has provided sufficient documentation that the tenderer is reliable in accordance to § 138 of the said Act. Please note that certain voluntary exclusion grounds in Directive 2014/24/EU on public procurement have been made compulsory in § 136 of the said Act.

The reason for the extension of the original deadline for submission of the offer is that DALO have receive so many questions that DALO can not send out all answers within the 6 days time limit before the deadline for submission of the offer. DALO is in progress of releasing 3 Question and Answers documents to have the information distributed as soon as possible. Due to the extension of the deadline Tenderers do still have the possibility to send questions about the tender document. DALO will try to answer all received questions, but can not guarantee that all questions received after this extension will be answered.

Med henblik på at sikre Forsvarets fortsatte anvendelse af satellitkapacitet og satellitradio til data og talekommunikation i både internationale operationer (INTOPS) og nationale operation (NATOPS) har FMI forlænget en eksisterende rammeaftale med leverandøren NSSLGlobal ApS, omfattende satellitkapacitet, satellitradioer og tilknyttede vedligeholdelse- og supportydelser. Aftalen er forlænget den 7. januar 2022 for perioden den 31. januar 2022 til den 31 januar 2023 med en forhøjelse af målværdi med 10,5 mio. DKK, og forlænget den 31. januar 2023 for perioden 31. januar 2023 til den 31. maj 2023 med en forhøjelse af målværdi med 3,5 mio. DKK.
