Betingelser for deltagelse
Økonomisk og finansiel stilling:

Candidates, and if the candidate is a group of companies (e.g. a consortium or joint venture) the applying group, shall declare (See Section V.I.3)) that the candidate, is able to present a contractor performance guarantee (cf. ABT 93 § 6) of 15 000 000 DKK.

Documentation for the declared ability to present a contractor performance guarantee of 15 000 000 DKK, may be requested any time during the tendering process.

Documentation will be requested from the winning tenderer before the contract is awarded.

Further information about the required documentation is specified in the tender material.

Mindstekrav til niveauet:

It is required that the candidates, and if the candidate is a group of companies (e.g. a consortium or joint venture) the applying group, shall declare, that the candidate is able to present a contractor performance guarantee (cf. ABT 93 § 6) of DKK 15.000.000. If the candidates does not supply the required declaration (See section V.I.3) ) it is considered non-compliant, hence references will not be considered.

Teknisk og faglig kompetence:

The candidate shall describe (See section VI.3) ) up to 5 project relevant references within similar and most relevant experiences within the past 5 years (within this period both contracts won but not commenced, completed contracts and contracts in progress are of interest).

If the Applicant is a group of companies (e.g. a consortium or joint venture) the maximum of 5 references applies for the group as a whole (i.e. no more than 5 references in total should be submitted by the group). Even if the candidate gives more than 5 references the candidate will not be considered non-compliant. If more than 5 references is described, the Client will take into account the 5 references with the newest dates of contract signing. If the candidate has fulfilled similar activities as part of a consortium, or the candidate has acted as sub-supplier on similar contracts, the exact contribution by the candidate must be highlighted.

The description shall include information about the works performed, whether the reference is of design and build contract, the contract price, date of contract signing, name of the customer and if possible a contact person at the customer. The Client has described in section II.2.9) what the Client, in particular, will emphasize when evaluating the references.

The applicant must fill in and enclose in its application the European single procurement document (ESPD) as preliminary evidence that it is not in 1 of the situations set out in s.148(1)(i-iii) in Law No 1564 of 15/12/2015 (hereafter ‘the Procurement Act ’), i.e. that the applicant is not subject to any of the grounds for exclusion as further detailed below that the applicant complies with the minimum suitability requirements (economic and financial capacity) set out in Section III.1.2) above, and how the applicant complies with the objective and non-discriminatory selection criteria referred to in Section II.2.9) above.

The Client furthermore reserves the right, at any time during the tendering procedure, to request an applicant to provide documentary proof, see s.151 of the Procurement Act, if required to ensure the proper conduct of the procedure. In this situation, the Client will set an appropriate deadline for the submission of documentation. The Client intends to ask the applicants to provide documentation before pre-qualification.

Regarding grounds for exclusion:

The Client must exclude an applicant from participation in the tendering procedure if the applicant is subject to the mandatory grounds for exclusion set out in ss.135 and 136 of the Procurement Act.

Information in this respect is stated in the European single procurement document, Part III, sections A, B and C. Particular attention is drawn to the fact that certain of the non-mandatory grounds for exclusion of the procurement directive have been made mandatory in s.136 of the Procurement Act. Furthermore the Client has chosen to make some (No 1, 2, 3, 4 and 6 ) exclusion grounds in s.137 of the Procurement Act mandatory in this tender procedure.

Before awarding the contract, the tenderer to whom the Client intends to award the contract must provide documentation as stated in s.153 of the Procurement Act that the tenderer is not subject to the above mentioned grounds for exclusion as set out in s.135(1) and (3) and s. 137 (2) and of the Procurement Act and that the applicant meet the minimum suitability requirements. For applicants residing in Denmark (and having exclusively Danish citizens in their governing body) the documentation may consist of a service certificate issued by the Danish Business Authority (Erhvervsstyrelsen) upon request.

The documentation must be submitted within an appropriate deadline set by the Client of not less than 2 and a 1/2 weeks (18 calendar days) calculated from receipt of the request.

The Client reserves the right to initiate a ‘self-cleaning’ procedure if relevant, see s.138 of the Procurement Act. This is further specified in the tender specifications.

In respect of section II.2.9) it should be noted that, in the European single procurement document, Part V, only a reference to Part IV, section C is required.

Further information:

1) The Client points out that a part of the tender material including the technical specifications is only written in English. However the contract is written in Danish and background material, including e.g. geotechnical reports may also be in Danish. The technical material by the tenderer — who is awarded the contract — shall be written in English or Danish. The working language shall be Danish or English as agreed and communication with authorities shall be carried out in Danish. Also it is required that works related to railway security shall be carried out by Danish speaking employees.

2) The Client reserves the right to award the contract after evaluation of the tenderers' BAFO instead of doing a short-listing as stated in section IV.1.4)

3) The Client will have an information meeting for potential candidates on 23.5.2016 (10:00-12:00) at the address mentioned in section I.1) The meeting will give an overall highlight review of the project and time for questions. Pursuant to the Danish Act on the Complaints Board for Public Procurement, etc. (lov om Klagenævnet for Udbud) (the Act is available at www.retsinformation.dk), the following deadlines apply to the lodging of appeals.

Appeals for not having been selected must be submitted to the Danish Complaints Board for Public Procurement (Klagenævnet for Udbud) within 20 calendar days of the day after submission of notification to the applicants concerned of the identity of the applicants selected, see s.171(2) of the Procurement Act, or s.2(1)(i) of the Act if the notification is accompanied by an explanation of the grounds for the decision.
