Ringmount with armored protection including Softmounts, and lightweight Softmounts

This Contract Notice concerns The Danish Defence Acquisition and Logistics Organization (DALO) tender for a Framework Agreement, divided into two lots that covers DALO's need for Ringmounts with armored protection including Softmounts (RM — SM V1), and Lightweight Soft Mounts (SM V2). Both including accessories, spare parts, logistic support, operator- and maintainer training and documentation.
Lot 1:
The RM — SM V1 is intended for use on the different types of armored vehicles within the Danish Defence in order to offer ballistic protection for the gunner, and shall be able to fit the existing mounting interface RM M/07-M/08 (further described in the tender material) through a standard interface.
The ballistic protection offered shall be Level 2 according to NATO STANAG 4569, AEP-55 VOL 1 or equivalent. It will potentially be a requirement that the Ring Mount can be delivered with dummy protection for educational purposes, as well as level 1, 3 and 4 ballistic protection according to NATO STANAG 4569, AEP-55 VOL 1 or equivalent. It is expected that a final decision on such requirements will be taken during the negotiated tender process. Further details will be contained in the tender material. Furthermore, the ballistic protection should be modular and able to change configuration from one protection level to another in order to customize to the weight limitations of the vehicle types. The vehicles are ranging from armored trucks to armored patrol vehicles and armored personel carriers, e.g. Man HX, Man SX, Eagle, Piranha and M113.
The Soft Mount within the Ring Mount is to be mounted with a 12.7 mm Heavy Machine Gun Browning M2 and Light Machine Guns 7.62 MG MG3 and MG M60E6.
An initial purchase of 174 protected units is expected, in all a purchase of 574 units is expected, however DALO is not obliged to buy any minimum quantity during the lifetime of the agreement.
Lot 2:
The SM V2 is intended to be used on the existing Ring Mount, with a small pivot pin (NATO G3 cone), of an unprotected tactical vehicles wherefore weight is an issue. The SM V2 is to support weapons such as 40 mm Automatic Grenade Launcher Heckler & Koch (AGL) and 12.7 mm Heavy Machine Gun Browning M2.
It should be possible to mount a Fire Control System (FCS). The FCS is used when the AGL is mounted in the SM V2.
An initial purchase of 18 units is expected, however DALO is not obliged to buy any minimum quantity during the lifetime of the agreement.
Both lots:
Both types of Soft Mount are also to be operated off the vehicle using a M3 Tripod.
A maximum of 5 candidates will be pre-qualified for each lot. A candidate may apply for prequalification for one or both of the lots.
As it is DALO intention to perform a user test regarding both the RM — SM V1 and SM V2 during June 2017, the tenderers are to provide 2 ea RM — SM V1 and/ or 2 ea SM V2, depending on which lots the candidate is prequalified for, including accessories, documentation and technical support at The Danish Army Combat Centre prior to the test period.

This tender is conducted according to the negotiated procedure, cf. directive 2009/81/EC, article 26. The tenderers who will be invited to submit tenders will receive further practical information regarding the negotiated procedure in the Instructions to Tenderers. Candidates are asked to submit applications for prequalification via Mercell Sourcing Service http://permalink.mercell.com/61225148.aspx. The Candidate shall clearly state which lot, or both lots, the application is in regard of. The application for prequalification cannot be submitted by e-mail. DALO have prepared a prequalification questionnaire which candidates are strongly encouraged to use when submitting their applications. The questionnaire contains questions, forms and templates for providing information etc. in accordance with the requirements in this Contract Notice. Candidates are specifically made aware that it may be a condition precedent for signing the contract regarding Lot 1, but not lot 2, that the tenderer has entered into an Industrial Cooperation Contract with the Danish Business Authority (Erhvervsstyrelsen). Candidates should also note that the Danish legislation on industrial cooperation has been amended and that — as of 1 July 2014 — new rules on industrial cooperation have entered into force. Pursuant to the new rules, industrial cooperation may be required, in so far as a concrete assessment shows that such cooperation is necessary in order to safe-guard essential Danish security interests. Such an assessment is currently being made in relation to this contract. Prequalified tenderers will be informed of the outcome. Precise information on deadline(s) for lodging appeals: Pursuant to Danish act on The Complaints Board for Public Procurement (Act no. 492 of 12.5.2010 with subsequent amendments — available at www.retsinformation.dk), the following time limits for filing a complaint apply:

1) 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union (with effect from the day following the publication date);
2) 30 calendar days starting the day after the contracting authority has informed the tenderers in question that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes a short account of the relevant reasons for the decision;

3) 6 months starting the day after the contracting authority has sent notification to the candidates/tenderers involved that the contracting authority has entered into the framework agreement, provided that the notification included a short account of the relevant reasons for the decision;

4) 20 calendar days starting the day after the contracting authority has published a notice concerning his decision to uphold the contract, cf. the principle in § 185(2) of the Danish act on Public Procurement (Act no.1564 of 15.12.2015 — available at www.retsinformation.dk).

The complainant must inform the contracting authority of the complaint in writing at the latest simultaneously with the lodge of the complaint to The Complaints Board for Public Procurement stating whether the complaint has been lodged in the stand-still period, cf. § 6(4) of the act on The Complaints Board for Public Procurement. If the complaint has not been lodged in the standstill period, the complainant must also state whether it is requested that the appeal is granted delaying effect, cf. § 12(1) of the said act.
