Consultancy Services — Multi-diciplinary consultancy services contract on locomotive purchase
DSB is preparing a potential acquisition of locomotives. The locomotives are expected to be with electric propulsion system; however, it is currently being evaluated if a part of the locomotives is to be diesel powered to act as a risk response in case other projects may be delayed; for instance delays in the electrification program currently ongoing in Denmark or delays in finalization of the IC4 DMUs.
The locomotives shall be able to pull and push DSBs current double deck coaches type Bombardier (DO2003) and potentially be able to handle peak loads across Øresund i.e. cross border services between Denmark and Sweden. The new locomotives shall be able to be used for freight services with no/minor modifications to have the best possibility to resell the locomotives after 10-15 years of operation corresponding to the remaining lifetime of the fleet of double deck coaches. The size of the acquisition has not yet been finally decided, but based on current indications, DSB expects the procurement to be in the range of 10-20 locomotives. Option sizes to be determined. There is currently no final political approval on the acquisition, however this is expected in due time after the contract documentation and relevant decision documents have been completed.
The contract covers multi-disciplinary consultancy services in the period from October 2015 to the time when all train units have been delivered and put into operation successfully, potentially also covering the warranty period. DSB wishes to enter 1 contract only for consultancy services, however on a non-exclusive basis.
The contract must include all consultancy services necessary for acquisition of locomotives, except for legal advice that will be sourced separately. The consultancy services include e.g. preparation and analysis of the operational requirements, market research, participation in preparation of contract documentation, establishment of relevant contractual framework, requirement specifications, LCC, RAMS and warranty management as well as the tender evaluation, negotiations, contracting and contract management with the supplier. During the build phase the advisor shall support DSB to fulfil its role as client towards the locomotive manufacturer in supervising, controlling and managing the contract including construction and requirement validation, test and approval activities and finally the take-over of the locomotives and monitoring of their operational performance. The consultancy services shall support and complement the current DSB organization that will be supplemented on an ongoing basis. Further to the specific acquisition process, the applicant shall also be capable to support DSB in identifying, preparing and executing necessary changes in the logistic environment that the locomotives shall operate in; i.e. management of the necessary enabling works.
Investments in rolling stock of more than 100 000 000 DDK, must be approved by the Minister of Transport before tendering and contracting thereof. For the purpose of the Minister‘s approval, an external quality assurance of the investment will be completed. Therefore, all services provided by advisors must be supported by all relevant and necessary documentation, and the documentation must be available for DSB, DSB partners and external quality assurance. DSB expects that external quality assurance and sparring will be done continuously, why applicant is obliged to cooperate in this regard.
The procurement organization will be located in the Greater Copenhagen Area and on-site presence will be required.
The specific consultancy services regarding preparation of tender materials are identified i.e. phase 1. However, the total scope and volume of the consultancy services over the years have not yet been finally determined.
The above will be elaborated in the contract documentation.
Below the different phases for acquisition of locomotives are described. The descriptions reflect the overall tasks. Expected tasks for the applicant are listed in Phase 1 ‘Preparation phase’ — note that the tasks listed is described in the best way possible based on the knowledge of today why the list is indicative.
Phase 1: Preparation Phase:
Preparation of a full procurement package for the locomotives. This includes preparation of the pre-qualification process, preparation of the necessary contract documentation (including schedule and deliverability requirements, evaluation criteria and model), preparation of maintenance specification and functional specification for the locomotives. Delivery solutions for derived projects will also be developed. Phase 1 will be completed when a paper is submitted to the Ministry of Transport. As part of phase 1 the necessary project management, controlling and reporting tools are to be refined and developed.
Expected tasks for applicant in phase 1 include e.g. assistance to contract documentation, establishment of relevant contractual framework, functional specification for locomotives and maintenance specification, evaluation criteria and model, requirement management, procurement strategy, identification and description of derived projects and decision paper to the Ministry of Transport.
Phase 2: Tender Phase:
In phase 2 potential suppliers will be invited to pre-qualify and the short listed bidders will be invited to submit full tender proposals. Following a process of evaluation, negotiation and re-submission of revised offers, the preferred bidder will be selected and the contract will be awarded. Preparation of derived projects. Phase 2 will be completed when contract for locomotives is signed.
Possible tasks for applicant in phase 2 include e.g. market study, tender strategy, assistance to the pre-qualification process as well as the tender process, assessment methods, criteria and evaluation model and evaluation of tenders.
Phase 3: Design, test and approval Phase:
Phase 3 is the start of the post contract work. DSB will audit and oversight the selected supplier as they undertake their obligations under the contract. Phase 3 is completed when the locomotives have been homologated and approved for operation on the Danish rail network by the relevant authorities and when the first production unit has achieved.
Possible tasks for applicant in phase 3 include e.g. assistance to contract management, ensure proper quality in the delivery of locomotives, clarification of any issues with manufacturer, safety and approval process and derived project.
Phase 4: Delivery Phase:
Phase 4 is the continuation of the post contract work. During phase 4 DSB will exercise due diligence, audit and oversight of the selected supplier, accepting locomotives, commencing maintenance activities and putting into commercial service. Phase 4 is completed when all locomotives intended to be supplied under the contract have achieved Preliminary Acceptance by Danish Transport Authority. Contract closure will occur when all warranty obligations have been fulfilled and all contract retentions have been paid, this will occur at least 2 years after phase 4 is completed.
Possible tasks for applicant in phase 4 include e.g. assistance to contract management, ensure proper quality in the delivery of locomotives, clarification of any issues with manufacturer and ensure delivery of all relevant documentation to DSB.
