Reduction of the number of candidates who meet the minimum requirements (if more than 5 candidates meet the minimum requirements) will take place on the basis of the candidates who have documented the most relevant references (cf. section III.2.3, C). b) Regarding section III.2.1 and III.2.3: Pre-printed material may also be submitted in Swedish and Norwegian. c) Banedanmark highlights that the tender material generally, including the technical specifications, is written in English only. However, the contract is written in Danish and background material may also be in Danish. The technical material by the tenderer(s) — who is awarded the contract(s) — shall be written in English or Danish. The working language shall be Danish or English as agreed between the parties and communication with authorities shall be carried out in Danish. Also it is required that works related to railway security shall be carried out by Danish speaking employees. d) Regarding the evaluation of the tenders Banedanmark intends to have weighted contract award sub-criteria as follows: 1) Technical/qualitative description, and 2) Financial. Kort beskrivelse:

E1001 Track Works, is a detailed tender package including:

— Building of approx. 120 km new track;

— Exchange of approx. 80 km of rail (40 track km);

— Realignment of approx. 85 km of track;

— Building and installation of approx. 80 points;

— Ballast cleaning of approx. 25 km track;

— Ballast supplementing of approx. 180 000 m

— Installation of sub-ballast bed, ballast bed and drainage for approx. 24 points;

— Installation of approx. 200 m of new platform fronts (-noses);

— Replacement of waterproofing of approx. 1 000 m

— Installation of approx. 100 rail insulations;

— Installation of special constructions e.g. rail expansion joints, guarding constructions etc.

All work will be described in detail in the tender material, and the Contractor shall carry out all track works, additional and other works and all activities necessary for the following:

— Establishing of work sites;

— Removal and stockpiling of rails;

— Removal and disposal of rails;

— Removal and disposal of ballast cleaning residual products;

— Adjusting of tracks (for 200 km/h);

— Mobile flash butt weldings;

— Thermite weldings;

— Fittings and finishing of rail welds;

— Track works assistance to other works;

— De-stressing of rails;

— All finishing works;

— Cleaning up and removal of work sites.

Please note that all work is to be carried out with craftsmanship to the highest possible standard and that strict specifications and tolerances are to be met. Also, Banedanmark will ensure detailed supervision throughout the entire process.

For sections where new tracks are to be installed the interface to the contract is the ballast surface 7 cm below future sleeper sub-surface.

The work has to be carried out according to the safety regulations of Banedanmark (Banedanmarks Sikkerhedsreglement 1975 (SR)) including latest amendments.

The contractor must supply the necessary safety staff to manage the works to ensure that they are carried out in accordance with the safety regulations. If the contractor wishes to use rolling stock as part of his work, the contractor must make arrangements with sub-contractors himself.

The Ringsted-Fehmarn project conclusively includes the extension, speed upgrading, re-signalling and electrification of the partly double track/partly single track railway line of the approx.105 km line from Ringsted in the north across Sjælland, Falster and Lolland to Holeby in the south, at which location the project has an interface to the railway of the Fixed Link across Fehmarn Belt.

The Contract is discontinued across the Storstrøms Bridge which is taken care of by another project.

The pre-qualification evaluation is a 2 step process The required ‘Economic and financial ability’ stipulated in III.2.2 with the requirement of a guarantee is pre-requisite for evaluation of references and therefore step 1 in the pre-qualification process. If the guarantee is not received, the application is considered non-conformant and the candidate will not be considered to be pre-qualified.

Step 2 is evaluation of the references. The references will be evaluated solely based on the 5 references provided as stated in III.2.3 by using the template provided as a part of the pre-qualification information. Information provided in other documents will not be considered. The focus during evaluation will be on relevant projects similar to the Ringsted — Fehmarn Rail Line, E1001.

After the pre-qualification evaluation process the pre-qualified candidates, the tenderers, will be invited to participate in submitting tenders. Based on the invitation to tender, the tenderers submit a ‘First Negotiating Tender’ (in the following referred to as ‘FNT’). The FNT will be the basis for a negotiation process where the focus will be strengths and weaknesses of the FNT. The tenderers then have to submit a ‘Best and Final Offer’ (in the following referred to as ‘BAFO’), and eventually a revised BAFO, based on the FNT and the conclusions from the negotiation process. The Tender will be evaluated according to the award criteria outlined in the tender documents.

E1001 Track Works is a detailed tender package including:

— The removal of approx. 200 60E2 rail insulations. The option comprises both the removal and disposal of the rail insulation and the substitution of the rail insulation with a length of 60E2 rail, thermite or flash butt welding of the rails, rail fitting and rail grinding, de-stressing of rails etc.

— The exchange of approx. 80 000 mono block sleepers presently installed on the Næstved-Vordingborg double track line. The existing sleepers are equipped with Vossloh W fastenings and it is expected that the new sleepers will be mono block sleepers equipped with Pandrol Fastclip fastening.

A. The candidate shall submit a short description of the company and organisation of the candidate. If the candidate is a group of companies (e.g. a consortium or joint venture) each member shall submit the information and documents requested.

B. Candidates, and if the candidate is a group of companies (e.g. a consortium or joint venture) the applying group, shall document that the candidate at the time of applying for pre-qualification, is able to present a contractor performance guarantee (cf. AB 92 § 6) of 90 000 000 DKK.

Documentation must be provided in form of a declaration from a bank or guarantor. It is accepted that the declaration is dated between the date of publication of this Notice and the time limit for receipt of requests to participate (cf. section IV.3.4).

Candidates are encouraged to use the standard form regarding ‘Contractor Performance Guarantee’, which can be downloaded from www.banedanmark.dk/femern-udbud (Danish) and www.banedanmark.dk/fehmarn-tender (English) (cf. section III.1.1) thereby ensuring that the declaration fulfils all demands.

Alternately candidates must ensure that the presented declaration contains the same information as the standard form. A statement about the guarantor's general possibility to issue guarantees on behalf of the candidate is not sufficient and a declaration without a statement from the issuing bank or guarantor regarding the candidate's economical status is also not sufficient.

Furthermore a declaration which does not contain the required size of the guarantee is not sufficient.

If the candidate does not supply the required guarantee it is considered a non-conformance, hence references will not be considered.

Teknisk og faglig kompetence:

C. The candidate shall document from 5 and maximum 8 projects relevant references within similar and most relevant experiences within the past 5 years (within this period both contracts won but not commenced, completed contracts and contracts in progress are of interest but the candidate is asked to specify for each single reference the situation to which reference is made). If the candidate has fulfilled similar activities as part of a consortium, or the candidate has acted as sub-supplier on similar contracts, the exact contribution by the candidate must be highlighted.

The documentation shall include information of contract price, time of performing, name of the customer and if possible a contact person at the customer.

If the candidate is a group of companies (e.g. a consortium or joint venture) each member shall submit the information and documents requested and submit relevant information showing the capacity as a group.

If the candidate relies on the capacities of the other legal entities (e.g. a parent company), the candidate must provide that the candidate has at his disposal the resources necessary, for instance by providing documentation that the candidate can rely on the capacities of the other legal entities in this respect.

The terms and conditions of the contract are based on the Danish Standard Agreement, AB 92, stipulating the general terms of a design and build contract within the civil and construction works with the deviations and changes resulting from the Banedanmark special terms and amendments thereto.

To obtain access to the track it is required that the employee has passed the course ‘Watch out, on the tracks’ (‘Pas på, på banen’) regarding railway security in Denmark. According to Law No. 492 of 12.5.2010 on the enforcement of procurement rules etc. and Law No. 511 of 27.5.2013 the following time limits are applicable in relation to the implementation of the contract:

Complaints about not being pre-qualified shall be submitted to The Complaints Board for Public Procurement within 20 calendar days from the day following the day on which the contracting entity has sent a notification to the applicants about who have been pre-qualified, if the notification contains a short statement of relevant reasons for the decision, cf. § 7, subsection 1.

Complaints about the award of the contract must be submitted to The Complaints Board for Public Procurement within 45 calendar days after the entity has published a contract award notice in the Official Journal of the European Union (TED).

Simultaneously with the appeal to The Complaints Board for Public Procurement, the claimant shall inform the customer in writing that the complaint is lodged to the Board and whether the complaint has been lodged during the standstill period, cf. § 3 subsection 1. In case the complaint has not been lodged in the standstill period, the claimant must specify whether suspensory effect of the appeal has been requested, cf. § 12 subsection 1.
