Banedanmark is - on behalf of Regionstog A/S - planning to contract for the provision of data transmission on the GSM-R net. The contract will not comprise the erection of masts, antennas, base stations etc. but will comprise the necessary implementation, operation and support of the transmission between the GSM-R sites (along the railway track) and the GSM-R core (situated in Copenhagen) and the transmission between dispatcher workplaces and the GSM-R core.

a) Banedanmark intends to prequalify a maximum of three participants.
b) The specified areas (Area 1-3) in section III.2.3 are used by Banedanmark as selection criteria. Thus, if more than 3 applicants fulfill the minimum requirements, the selection of the candidates that will be invited to participate will be based on the relevance of the submitted references.
c) In order to avoid conflicts of interest and to promote competition, an economic operator can only submit one application to participate. "Economic operator" shall be defined as a single economic operator or a group of economic operators (a consortium). Economic operators who form part of the same legal group cannot submit more than one application to participate in the tender. "The same legal group" shall be defined as entities covered by Council Directive 83/349/EC with amendments (Council Directive on consolidated accounts) art.
1. The restriction does not preclude an economic operator from submitting an application to participate in the tender and at the same time serve as sub-contractor in collaboration with one or more economic operators.
If more than one application for participation in the tender is submitted by the same economic operator or by economic operators who form part of the same legal group, all applications submitted by those economic operators will be excluded.
d) If the applicant relies on the experiences or capabilities of other legal entities (e.g. a partner, a parent company or one or more affiliated companies), the applicant must in the application prove that the applicant has at his disposal the resources necessary, for instance by providing documentation that the applicant can rely on the capabilities of the other legal entities in this respect. If the applicant relies on the economic/financial
capacity of other legal entities (e.g. partner, a parent company or one or more affiliated companies) these other legal entities will be required to undertake joint and several liability togther with the applicant when a contract is signed.
e) Request for participation must be submitted in one hardcopy. The application should also, preferably, be submitted as a digital copy in pdf-format on a memory stick, CD-ROM, DVD or the like. Should there be any differences between the application in hardcopy and the digital application, the application in hardcopy will be given priority.
f) Please note that the language is English and Danish, cf. IV.3.4. It is, however, accepted that preprinted material (for example the annual reports, cf. III.2.2) may be in Norwegian, Swedish or German. Contracts and tender material are expected to be written in English. Some documents prepared by the applicant may need to be written in Danish. The supplier may experience that existing material/documents as well as future material/
documents from Banedanmark or external parties are in Danish.

The applicant must - in order to be taken into consideration - verify that the applicant at the time of the application has experience with:
— Implementing, operating and supporting a radio link solution between more than two GSM (mast) sites (Area 1); and
— Transporting radio link GSM data from 2Mb/SDH/ToP (Timing over Packet) to a GSM core site (Area 2).
In order to fulfill this requirement, the applicant must submit references of deliveries within these 2 areas for the past 5 years.
The applicant may also submit references for implementing similar projects (Area 3) for the past 5 years.
For each submitted reference the applicant is asked to provide the following information:
— Contact person at the contracting entity (including contact information).
— Description of scope of delivery.
— Statement of which of the three above-mentioned areas (Area 1-3) the reference relates to.
Banedanmark reserves the right to verify any information provided by the applicant by contacting any reference given.
