Naviair

The Swedish and Danish Air Navigation Service Providers LFV (Sweden) and Naviair (Denmark) intend to purchase a common Aviation Liability Insurance for the Air Navigation Services provided by the companies and their associated and subsidiary companies. The insurance cover required is protection against LFV and Naviair and ther associated and subsidiary companies' legal liability arising from the provision of Air Navigation Services and therewith associated activities.
The Tender covers the appointment of the Leading Insurer and the Support behind the Leading Insurer.

Naviair and LFV is initiating a tender process in order to get quotations from suitably qualified and experienced insurance companies, in order to appoint 1) a Leading Insurer, and 2) support behind the Leading Insurer who can provide Aviation Liability Insurance coverage for Naviair and LFV and ther associated and subsidiary companies. The purpose of this notice is to initiate the tender process for phase 1) The selection of the Leading Insurer and phase 2) The selection of support behind the Leading Insurer (the selected lead quotation will be released to insurers, who are interested in the position as support behind the leading insurer). The LFV group consists of the state enterprise Luftfartsverket (LFV) and the wholly-owned holding company LFV Holding AB, which runs the operation through wholly and partially owned subsidiaries and partnerships. LFV provides air navigation services mainly in Sweden. LFV employs about 1.300 people and sales over SEK 2 billion. The headquarter of LFV is located in Norrköping, Sweden. LFV Aviation Consulting AB is a wholly owned subsidiary of LFV entrusted with carrying out export-oriented consulting operations and air navigation services. NUAC HB is jointly owned byt LFV Holding AB and Naviair (Denmark). As from 1 July 2012 NUAC HB provides en route services in the Danish Swedish Functional Airspace Block (DK/SE FAB). Naviair is a company owned by the Danish State (Ministry of Transport) and is responsible for the provision of Air Navigation Services in Denmark. Included in the Air Naviagation Services are area control service in Copenhagen Flight Information Region (FIR) as well as approach and tower control service at the Copenhagen Airports of Kastrup and Roskilde, and at the airports of Billund, Aalborg, Aarhus and Bornholm. Flight information service is provided in Copenhagen FIR to VFR flights and helicopter flights in the airspace of the North Sea, within Sondrestrom FIR (Greenland) up to flight level 195 and within Vagar traffic information zone (Faroe Islands). Additionally Navaiir co-ordinates the "search and rescue services" in Greenland. Communication, navigation, surveillance and air traffic management system are owned and maintained by Naviair. Moreover Naviair offers technical services and maintenance to customers. Naviair employs about 690 people at 8 sites in Denmark, Greenland and the Faroe Islands and sales about DKK 950 millions. The applicants' economic and financial ability will be evaluated on basis of credit rating from Standard & Poor's, Moody's or equivalent agents. The contracting entity will obtain and use credit ratings from Moody's unless an applicant should wish to use the credit rating by another agent. If so, the applicant must enclose proof of such rating.

Minimum level of standards required: At least A-.

Teknisk og faglig kompetence:

All applicants for the position as Lead Insurer will be required to provide the following information/documentation when applying for prequalification:

a) The applicant shall be well known in the aviation liability insurance market for Air Navigation Service Providers and/or airports and shall be well experienced and have a wll known competence within such aviation liability insurance,

b) the applicant shall deliver a short description of the company in terms of its organisations, management, professional qualifications of key person; and

c) a list of 3 client references for the applicant acting as Leading Insurer for ANSP's and/or airports during the last three years.

Should a group of Underwriters/Syndicates decide to quote on a co-assurance basis, the Underwriters/Syndicates participating in the co-assurance must appoint a Lead Underwriter/Syndicate who represents and acts on the participating co-insurers' behalf. Lead Underwriter/Syndicate must be appointed to handle and settle all claims on the other co-insurers' behalf. The co-insurers must accept Lead Underwriter's/Syndicate's decision regarding indemnity payments.

The applicants that intend to form or participate in a consortium should clearly state the share of their participation together with the tasks and funtions to be undertaken by each one ot them.

The awarded Insurer(s) should be duly established and operating insurer(s) registered with the relevant Union of Association of Insurance Companies in accordance with applicable legislation.

Oplysninger om frister for klageprocedurer:

As a consequence of Danish Act No 492 og 12 May 2010 on the enforcement of procurement rules etc. there are following deadlines for lodging appeals. Complaints about not beeing pre-qualified shall be submitted to Klagenævnet for Udbud within 30 calendardys from the day following the day on which the contracting entity has sent a notification to interested applicants who have been prequalified. In other situations the complaint against the tender being submitted to Klagenævnet for Udbud before:

1) 6 months after the contracting entity has published a notice in the Official Journal stating that the contracting enitityhas entered into a contract. The period is calculated from the day following the day on which the notice has been published.

2) 30 calendardays from the day following the day on which the contracting entity informed the tenderers that a contract based on a framework contract with reopening of competition or a dynamic purchasing system are made, if notification is given a brief account of the relevant reasons for decision.

3) 12 months after the entity has signed a framework agreement from the day after the day on which the contracting entity informed the tenderers and candidates, cf. § 2(2).

At the latest at the same tim as an appeal is sent to Klagenævnet for udbud, the appellant shall in writing inform the contracting entity that the complaint is sent to Klagenævnet for udbud, and whether the complaint is filed during the stand-still period referred to in § 3. If the appeal has not been lodged in the stand-still period the appellant must also state whether it is requested that the appeal is granted delaying effect pursuant to § 12 (1).
