Excess War Liability insurance

Naviair

Naviairs current excess war liability insurance coverage expires 30th September, 2011. Naviair is therefore initiating a tender process in order to get quotations from suitably qualified and experienced insurance companies, who can provide Naviair with a 100 % solution for excess war liability (AVN52E) insurance coverage wtih effect as from October, 1, 2011.
Limit required is 850 000 000 USD in excess of 150 000 000 USD.
Naviair has recently appointed leading and following Insurer(s) to provide aviation liability insurance coverage for Naviair. This insurance has an extended Coverage Endorsement (Aviation Liabilities) AVN 52E, deleting all sub-paragraphs other than (b) of Clause AVN8B, with sub-limit under paragraph 3 of 150 000 000 USD any one occurence and in the annual aggregate.
Naviair now wants to buy insurance coverage for its legal liability to pay damages for bodily injury or property damage, caused by an occurrence in excess of the limitiation of liability of the extended coverage endorsement (aviation liabilities) AVN52E, subject to sum herein.

Provision of air navigation services is Naviair’s first and foremost priority, i.e. to provide its services in an efficient and expeditious way, guiding aircraft safely through Danish airspace with minimum delays. Naviair offers training of all operative staff at its own college - of which that of Air Traffic Controllers constitutes the primary part - and operates and maintains the advanced technical systems and air navigation aids. The initial training takes place at Entry Point North, the joint Scandinavian Academy i Malmö. Naviair has a staff of approximately 660 persons most of which are Air Traffic Controllers and technical staff, and runs a business of approximately 900 000 000 DKK a year.

The applicants that intend to form or participate in a consortium should clearly state the share of their participation together with the tasks and functions to be undertaken by each one of them. Each applicant is not allowed to participate in the tender more than once (either individually, or in parallel through an affiliate or subsidiary company, or in parallel as a member of more consortia than one). Applicants through an insurance agent will not be accepted.

Proof must be provided by the applicants of their financial performance: Rating from credit rating agents (Standard & Poor's, Moody's or by other equivalent credit rating agent).

Should a group of Underwriters/Syndicates decide to quote on a co-assurance basis, the Underwriters/Syndicates participating in the co-assurance must appoint a Lead Underwriter/Syndicate who represents and acts on the participating co-insurers' behalf. Lead Underwriter/Syndicate must be appointed to handle and settle all claims on the other co-insurers' behalf. The co-insurers must accept Lead Underwriter's/Syndicate's decision regarding indemnity payments.
