Equity: The equity must be positive in the latest annual report available as per the deadline of submission of application.

References: Information concerning references of similar deliveries including information of transformer size, delivery time and location, cf. the Contract notice section 5.1.9. Similar deliveries are to be understood as: i) 3-winding transformer 165/10.5/10.5kV with rated power of 100/50/50MVA, including engineering, delivery at foundation, installation, cleaning, test and documentation. ii) Delivered / commissioned after the 8’th of January 2021 The references should include a description of the transformer (including included services, MVA etc.) and contact details of the customer referenced (name, mail and phone number). The references should also include date of delivery/commissioning. References which are older than 3 years as per the date of submission of application will not be taken into consideration. The applicants may submit up to 5 references and these may be stated either in the ESPD or in the attached reference sheet, cf. Annex G.

References - selection of candidates: If more than 4 applicants submit an application, Fjernvarme Fyn will prequalify the 4 applicants who submits the most relevant and similar references considering the scope of supply of this contract (complete 3-winding transformer 165/10.5/10.5kV with rated power of 100/50/50MVA, including engineering, delivery at foundation, installation, cleaning, test and documentation). In this context the similarity of the scope of supply is of higher importance than the number of references and consequently an application including few very similar references will be evaluated better than an application which include 5 only partially relevant references.

As part of the application the applicant must submit the ESPD (European Single Procurement Document), cf. the ITT section 3.2. -- Applicants may not be subject to the mandatory grounds for exclusion, cf. the Danish Public Procurement Act (udbudsloven) Section 134a, 135 (1-3) and 136. Further, the applicant may not be subject to the voluntary grounds for exclusion, cf. the Danish Public Procurement Act Section 137 (1, 2, 3 and 5). Applicants subject to the grounds for exclusion may, however, be included in the tender procedure if they are able to self-clean in accordance with the Danish Public Procurement Act section 138. -- Documentation: Prior to award of contract Fjernvarme Fyn will request documentation for the information stated in the ESPD. In this context Danish participants may submit a “Serviceattest” (https://erhvervsstyrelsen.dk/serviceattest-ved-udbud) as documentation for the grounds for exclusion. Participants from other member states must consult e-certis (https://ec.europa.eu/tools/ecertis/#/search) when establishing what to submit. The documentation concerning the grounds for exclusion may not be older than 6 months calculated from the date of submission of Tender. According to the Danish Complaints Board for Public Procurement Act etc. (the Act can be downloaded at www.retsinformation.dk), the following deadlines for filing a complaint apply: Complaints about not having been selected must be submitted to the Danish Complaints Board for Public Procurement within 20 calendar days, cf. Section 7(1) of the Act, from the day after sending a notification to the candidates concerned about who has been selected, when the notification is accompanied by a statement of reasons for the decision in accordance with Section 2(1)(1) of the Act and Section 171(2) of the Public Procurement Act. In other situations, complaints about tenders, cf. Section 7(2) of the Act, must be submitted to the Complaints Board for Public Procurement within: 1) 45 calendar days after the contracting entity has published a notice in the Official Journal of the European Union that it has entered into a contract. The deadline is calculated from the day after the date on which the announcement has been published. 2) 20 calendar days from the day after the contracting entity has announced its decision, cf. Section 185(2) of the Public Procurement Act. No later than the same time that a complaint is submitted to the Complaints Board for Public Procurement, the complainant must inform the contracting entity in writing that a complaint is submitted to the Complaints Board for Public Procurement and whether the complaint has been submitted during the standstill period, cf.
