The Principal Designer is expected to start delivering its services following the award and the signing of the contract in June 2023.

If more than five candidates fulfil the requirements for suitability and are not subject to grounds for exclusion, the NHMD will select the candidates to receive an invitation to submit an initial tender among these candidates.
This selection will be based on the following objective criterion:
• The most relevant experience
The NHMD will evaluate the references provided by the candidate on the basis on the criterion ‘the most relevant experience’. The more the references provided by the candidate correspond to the subject of this procurement procedure the more positively the NHMD will assess this candidate’s prequalification application.
In the comparison between the references and the subject of this procurement procedure, the NHMD will, among other things, attach importance to the extent to which the references document experience with:
• Projects executed in cultural institutions
The candidate is encouraged to describe its references in detail and to point out of any factors that make the individual references particularly comparable to the contract up for tender.
The NHMD will attach importance to the candidate’s role in performing the reference. The NHMD will consider references in which the candidate’s role is limited or unclear as less positive than references performed in full by the candidate.
Furthermore, the NHMD will attach importance to the period of performance of the reference. The NHMD will consider references where a considerable part of the services has not yet been performed or where a considerable part of the services was not performed within the last ten years as less positive than references performed and completed within the last ten years.
The selection will be based solely on the references specified in the ESPD (or in an appendix to the ESPD) and a maximum of ten references. If the candidate has provided more than ten references, only the ten most recent references will be considered in the selection decision.

In this procurement procedure only the mandatory exclusion grounds of sections 134 a, 135-136 of the Danish Public Procurement Act (Act no. 1564 of 15 December 2016 with subsequent amendments) apply.
The NHMD intends to request documentation regarding the information provided in ESPD from the tenderers in connection with the invitation to submit initial tenders.
To document that the tenderer is not subject to grounds for exclusion the NHMD expects to ask the tenderer to submit:
• An extract from the relevant register or a similar document issued by a competent judicial or administrative authority stating that the tenderer is not subject to the grounds for exclusion stipulated in section 135(1).
• A certificate issued by the competent authority in the country referred to as documentation that the tenderer is not subject to the grounds for exclusion stipulated in the cases stated in section 135(3).
If the country in question does not issue the documents or certificates, or if such documents or certificates do not cover all the cases mentioned, those documents or certificates may be replaced by a declaration on oath. If declarations on oath are not provided for in the relevant country, a solemn declaration made before a competent judicial or administrative authority, a notary, or a competent professional organisation in the country in which the tenderer is established may be provided instead.
For tenderers established in Denmark this documentation may be submitted in the form of a official certificate (‘serviceattest’) issued by the Danish Business Authority on request. The service certificate must contain information from the Bankruptcy Court (‘skifteretten’), the Central Criminal Register under the Danish National Police (‘Politiets kriminalregister’), the Danish Labour Market Supplementary Pension Fund (‘ATP’) and the Danish Customs and Tax Administration (‘Skatteforvaltningen’). It may not be older than six months at the deadline for submission of prequalification application.

The NHMD will accept sufficient documentation from national authorities in the national language. However, the NHMD requests that an unofficial translation into English is submitted as well.
To document that the tenderer fulfils the requirements for suitability for participation in this procurement procedure the NHMD expects to ask the tenderer to submit:
• An audited annual report or equivalent documentation stating the tenderer’s number of employees in the most recently concluded and audited financial year at the deadline for submission of the application for prequalification. If an annual report is not required under the law of the country in which the tenderer is established or if the tenderer’s annual report doesn’t contain the required information the NHMD will accept a declaration from the tenderer’s external accountant as equivalent documentation.
• Documentation of the formal architectural training of at least one employee with at least 10 years of experience (diploma or equivalent)
• Contact information (email and telephone number) to contact persons at the costumers mentioned as references in ESPD if such contact information is not included in the ESPD
If the information above is available to the NHMD via access to a national database, the tenderer is not obliged to submit the documentation in question to the NHMD. However, in that case the NHMD asks that the tenderer instead informs the NHMD where to find the information and supplies the NHMD with any necessary passwords, etc.

Complaints concerning a candidate not being prequalified must be lodged with the Danish Complaints Board for Public Procurement ("the Complaints Board") within a 20 calendar day deadline starting the day after the day that the NHMD has sent notification to the candidates involved regarding the NHMD's selection decision, cf. section 7(1) of the Danish Complaints Board for Public Procurement Act.
Other complaints must be lodged with the Complaints Board within a 45 calendar day deadline initiated by the NHMD's publication of a contract award notice in the Official Journal of the European Union.
