Tenderer minimum requirements:
Only offers from tenderers who qualify the followings minimum requirements will be accepted by Cerius as valid offers:
a. Tenderer must have an equity in most recent financial year of minimum DKK 20 mio.
b. Tenderer must have a rating of higher than “normal” according to Experias KOB-rating scale or higher than “A” in Bisnodes AAA-rating mode.
c. Tenderer must not, in the most recent 2 connecting financial years, have a financial deficit - unless the company’s positive equity in the most recent financial year as a minimum comprises 2 times the most recent financial years deficit. The equity is to be corrected if there are any qualifications in the auditor endorsement.
d Tenderes lastest annual financial report must timely available and be auditet by certified accoundant,
and must not have any auditor's endorsement with any reservations or any additional information regarding conditions, for example regarding reservation for carrying on its business as a going concern, that the accountant can not confirm the stated revenue, expenses or assets, illegal shareholder loans, overdue tax/VAT or similar, which significantly will increase the company’s risk of not fulfilling it’s obligations in time.
Tenderers must be able to document compliance to the requirements in clause a) c) and d) at the lastest published annual financial report, if public publication of the annual report is a regulatory requirement in the area where the tenderer is located.
For offers that are made jointly by association of tenderers, compliance to minimum requirements in clause a), c) and d) is documented by submitting the lastest timely available and auditet by certified accoundant annual financial report for each of the associated tenderes.
If a tenderers compliance to minimum requirements is based on other entities financial capacity, compliance to minimum requirements is documented by submitting the lastest timely available and auditet by certified accoundant annual financial report and a legally binding Letter of Comfort from the supporting entity.
In the situations where offers are either based on an association of tenderers or tenderers compliance to minimum requirements is based on other entities, the contracting entity will base it’s evaluation on the assessment of the constellation of the tenderer in relation the minimum requirements.
In case the tenderer cannot submit the lastest timely available and auditet by certified accoundant annual financial report, the tenderer can document compliance to minimum requirements by any other documentation which according to the tenderer is adequate.
Documentation of requirement in clause b) is acquired solely by the ordering party.
Please note that tenderers should NOT submit documentation upfront. The contracting entity will acquire the documentation from the tenderer before awarding the contract. Only the awarded tenderer is required to submit documentation.
Delivery minimum requirements:
The renewable energy guarantees of origin must be based on:
- Production plants that are not subsidized
- Production from sun or wind
- Productions plants which pr. 1. January 2023 are no more than 3 years old, meaning that they have not been commissioned earlier than 1. January 2020.
When submitting offer, the tenderer guarantees compliance the above requirements. Tenderers who are not in compliance to minimum requirements will be rejected.
