The SI-PSP will be monitored according to the Monitoring, Evaluation, Accountability, and Learning (MEAL) principles. Monitoring will be implemented at two levels; engagement results-based monitoring and strategic monitoring.
The MEAL unit will assist with the engagement Results-Based Monitoring which aims with providing the information needed to assess whether engagement performance is as expected. The focus in the monitoring will be on measuring the progress towards achieving outputs and outcomes at engagement level and will include the compilation, assessment, and presentation of monitoring information according to the agreed results-based frameworks and indicators defined for each engagement. Engagement results-based monitoring will be implemented by the engagement partners, but monitored and quality assured by the MEAL unit.

The programme Strategic Monitoring will provide the information and analysis needed for strategic level decision-making, adaptive management, learning and accountability by the MENA. This strategic level monitoring is where contextual changes and risks, including financial through annual audits, will be monitored and analysed. It will also include impact monitoring. The SI-PSP operates in a political challenging, fluid and fragile context.

The consultant must perform the following services, however not limited to:
- Draft annual work plans for the MEAL unit;
- Assist partners with improving their reporting formats, results framework, theory of change and risk management setup;
- Participate in field visits to Iraq to verify the relevance of indicators, identify practical and conceptual challenges of monitoring, field level risks, etc. and to participate in meeting on a programmatic level hosted by partners;
- Liaise closely with MFA staff in Copenhagen and MFA posted staff in Istanbul on programme related issues;
- Participate in MFA staff meetings relating to monitoring and reporting on engagements and the programme;
- Undertake in visits in Turkey and to Lebanon as well as to Copenhagen and Brussels in consultation with engagement partners, MENA and the Danish embassies in Ankara, and Beirut;
- Assist Syrian civil society organisation partners with developing their capacity in terms of financial management, internal management procedures and compliance with MFA guidelines;
- Assist MENA and the MFA posted staff in Istanbul to process the partners’ monitoring reports to yield the elements needed for inputting into the MFA reporting and transparency systems;
- Ensure that partners implement and follow the procedures, requirements and reporting schedules in accordance with the agreements, PSEDs and relevant MFA guidelines;
- Liaise with other stakeholders in the region to stay abreast of contextual and political developments in Iraq and Syria and in the region that may potentially influence the SI-PSP 2022-2025 and individual engagements;
- SI-PSP engagement and programme progress reports based on input received from partners;
- Assist MENA with drawing up Terms of Reference for technical reviews and other reviews such as Mid-Term Review;
- Produce an overall mid-term status report for the SI-PSP 2022-2025;
- Assist MENA with scoping, assessing and formulating new engagements to be funded with unallocated funds;
- Promote shared learning through close coordination with partners;
- Liaise and coordinate with MENA on communication and public diplomacy on possibilities for case stories and other communication initiatives to target different communication platforms and websites;
- Undertake dialogue meetings on programmatic related issues with engagement partners on ad hoc issues;
- Draft final results reports on all ODA-engagements under SI-PSP 2022-2025;
- Draft a final results report on programme level.

MENA and the consultant can at any time agree to extend the completion date and all or part of the services. However, the total budget for payment of such continuation of the services cannot exceed DKK 2,000,000.00 net of VAT.

In addition to the main work streams, MENA may wish to request the Consultant to carry out certain other tasks that to varying degrees are related to monitoring, learning and communication. Examples could be studies related to assessments, or assistance related to particular opportunities for communication. The tasks will be financed from a reserve fund of DKK 2,000,000.00 net of VAT. However, there is no commitment by MENA to utilise the total amount of the reserve fund.

Duty station is Istanbul, Turkey. In addition, the services include field visits to Iraq, visits in Turkey and to Lebanon, Copenhagen, Denmark, and Brussels, Belgium. Travel to Syria is not expected.

In Part III.A-C of the ESPD, economic operators must answer whether they are subject to exclusion grounds.
An economic operator is excluded from the procurement procedure if
the economic operator itself or any person who is a member of its administrative, management or supervisory body or has powers of representation, decision or control therein has been convicted by final judgement or fined within the last 5 years for any of the exclusion grounds relating to the criminal convictions listed in section 135(1) of the Danish Public Procurement Act.
it has unpaid overdue debt of DKK 100,000 or more to public authorities in relation to payment of taxes and payment of social security, cf. section 135(3) of the Danish Public Procurement Act. An economic operator is, however, not excluded where the economic operator has agreed on a repayment scheme with the collection authority and that scheme is observed, cf. section 135(4), or where the economic operator provides guarantee of payment of the part of the debt which constitutes DKK 100,000 or more, cf. section 135(5).
it is subject to any of the exclusion grounds listed in sections 136(1)(1) and 136(1)(2) of the Danish Public Procurement Act.
it within the last 3 years has been subject to any of the exclusion grounds listed in sections 136(1)(3-4) and 137(1)(2) of the Danish Public Procurement Act.
An economic operator is not required to answer whether it is subject to purely national exclusion grounds, cf. Part III.D of the ESPD.
An economic operator is excluded from the procurement procedure if the economic operator is established in a country which is entered on the EU list of non-cooperative jurisdictions for tax purposes and which has not adopted the Government Procurement Agreement (GPA) or other trade agreements that oblige Denmark to open its market for public contracts for tenderers established in the country in question, cf. section 134 a of the Danish Public Procurement Act.

The contracting authority can accept the following documentation in relation to the exclusion grounds in sections 135(1), 135(3) and 137(1)(2) of the Danish Public Procurement Act (in order of priority):
(1) Extracts from the relevant register or similar documents issued by a competent judicial or administrative authority or certificates issued by the competent authority in the country referred to as documentation that the tenderer is not subject to the grounds for exclusion stipulated in sections 135(1), 135(3) and 137(1)(2);

If the economic operator consists of a group of economic operators (e.g. a consortia or joint venture) or if the economic operator relies on the capacity of other entities, each involved economic operator or entity must submit a completed ESPD.
When an economic operator is participating in the procurement procedure together with others (e.g. a consortia or joint venture) or if the economic operator relies on the economic and financial standing of other entities, the participating economic operators or the entities referred to are subject to joint and several liability for the performance of the contract.

Teknisk og faglig kompetence:
In Part IV.C of the ESPD, the economic operator must fill in a list of maximum 5 contracts entered into, ongoing or finalized within the last 3 years.
The number of performed contracts is determined based on all submitted ESPDs (i.e. from all involved economic operators in a group of economic operators and/or other supporting entities).
If an economic operator has listed more than 5 contracts, the contracting authority will only read and assess the 5 most recent contracts listed (first based on end date, and then based on start date).
Each listed contract should include the following information:
(1) a description of the contract (nature and quantity of services from the economic operator and how they compare to the description of this procurement),
(2) amount (remuneration received by the economic operator for the performance of the services),
(3) start date (date of conclusion of the contract),
(4) end date (date of completion of services), and
(5) recipient (name and contact information).
If the economic operator consists of a group of economic operators (e.g. a consortia or joint venture) or if the economic operator relies on the capacity of other entities, each involved economic operator or entity must submit a completed ESPD.
When an economic operator is participating in the procurement procedure together with others (e.g. a consortia or joint venture) or if the economic operator relies on the technical and professional abilities of other entities, the specific parts of the contract must be performed by the economic operators or entities with the required technical and professional abilities.

MENA wish to hire a consultant to implement a MEAL unit to support MENA with programme strategic monitoring of the overall Syria-Iraq Peace and Stabilisation Programme (SI-PSP) 2022-2025 and all its Official Development Assistance (ODA) engagements, additional engagements if approved and engagements still under implementation from SI-PSP 2019-2021. The objective of the assignment is to ensure regular and proper monitoring, reporting and learning of the entire SI-PSP 2022-2025 at its programmatic level, across the two countries and each of the engagements and target interventions as well as the remaining active engagements from SI-PSP 2019-2021. The MEAL unit’s support to MENA includes risk management based on results framework(s), theory of change and risk set up in order for MENA to strengthen programme efficiency and effectiveness, facilitate learning and ensure informed decision-making by MENA and its partners related to implementation and development of the programme. The SI-PSP will be monitored according to the Monitoring, Evaluation, Accountability, and Learning (MEAL) principles. Monitoring will be implemented at two levels; engagement results-based monitoring and strategic monitoring. The MEAL unit will assist with the engagement Results-Based Monitoring which aims with providing the information needed to assess whether engagement performance is as expected. The focus in the monitoring will be on measuring the progress towards achieving outputs and outcomes at engagement level and will include the compilation, assessment, and presentation of monitoring information according to the agreed results-based frameworks and indicators defined for each engagement. Engagement results-based monitoring will be implemented by the engagement partners, but monitored and quality assured by the MEAL unit. The programme Strategic Monitoring will provide the information and analysis needed for strategic level decision-making, adaptive management, learning and accountability by the MENA. This strategic level monitoring is where contextual changes and risks, including financial through annual audits, will be monitored and analysed. It will also include impact monitoring. The SI-PSP operates in a political challenging, fluid and fragile context. The consultant must perform the following services, however not limited to: - Draft annual work plans for the MEAL unit; - Assist partners with improving their reporting formats, results framework, theory of change and risk management setup; - Participate in field visits to Iraq to verify the relevance of indicators, identify practical and conceptual challenges of monitoring, field level risks, etc. and to participate in meeting on a programmatic level hosted by partners; - Liaise closely with MFA staff in Copenhagen and MFA posted staff in Istanbul on programme related issues; - Participate in MFA staff meetings relating to monitoring and reporting on engagements and the programme; - Undertake in visits in Turkey and to Lebanon as well as to Copenhagen and Brussels in consultation with engagement partners, MENA and the Danish embassies in Ankara, and Beirut; - Assist Syrian civil society organisation partners with developing their capacity in terms of financial management, internal management procedures and compliance with MFA guidelines; - Assist MENA and the MFA posted staff in Istanbul to process the partners’ monitoring reports to yield the elements needed for inputting into the MFA reporting and transparency systems; - Ensure that partners implement and follow the procedures, requirements and reporting schedules in accordance with the agreements, PSEDs and relevant MFA guidelines; - Liaise with other stakeholders in the region to stay abreast of contextual and political developments in Iraq and Syria and in the region that may potentially influence the SI-PSP 2022-2025 and individual engagements; - SI-PSP engagement and programme progress reports based on input received from partners; - Assist MENA with drawing up Terms of Reference for technical reviews and other reviews such as Mid-Term Review; - Produce an overall mid-term status report for the SI-PSP 2022-2025; - Assist MENA with scoping, assessing and formulating new engagements to be funded with unallocated funds; - Promote shared learning through close coordination with partners; - Liaise and coordinate with MENA on communication and public diplomacy on possibilities for case stories and other communication initiatives to target different communication platforms and websites; - Undertake dialogue meetings on programmatic related issues with engagement partners on ad hoc issues; - Draft final results reports on all ODA-engagements under SI-PSP 2022-2025; - Draft a final results report on programme level. However, there is no commitment by MENA to utilise the total amount of the reserve fund.

Due to increased immigration from several countries over the past years, Turkey has increased its enforcement of its immigration laws and restricted the conditions for obtaining a work and temporary residency permits for foreigners who intend to work in Turkey. This has generally had consequences for both foreigners applying for residence and work permits for the first time and for renewals. As a result, Turkey has rejected the application for renewal of the temporary work permit for the Consultant’s MEAL expert (Iraq), and the Consultant expects that the work permit for the Consultant’s MEAL expert (Syria), will likewise be rejected. Therefore, the Consultant’s Meal expert (Iraq) and Meal expert (Syria) can maximum stay in Turkey without a visa for up to 90 days in any 180-day period. The modifications do not result in material changes to the Agreement, cf. Section 183 of the Danish Public Procurement Act, as: 1) MENA could not have foreseen the need for the change since MENA could not have foreseen the difficulties in obtaining work or residency permits as it was possible to obtain temporary residency permits in 2022, despite the legislation came into force in 2019, and since the Consultant's Iraq expert had previously obtained a residency permit (which is now denied). The effect of the implementation of the new legislation and the further ongoing tightening of the application of the legislation in 2023 and 2024, which directly affects the possibility of obtaining work and residency permits, could not have been foreseen by a diligent contracting authority, 2) the main place of performance (duty station in Istanbul, Turkey) remains unchanged, and the Consultant’s Key Staff shall to the extent possible perform 90 working days in Turkey per 180-day period, and 3) the original value of the Contract Price net of VAT has not changed (thus not exceeding 50% or more).

In the Scope of Services, the positions for Meal expert (Iraq) and Meal expert (Syria) were long-term assignments but are now changed to short-term assignments. The Meal expert (Iraq) and Meal expert (Syria) shall to the extent possible perform 90 working days in Turkey per 180-day period. As a result, the Meal expert (Iraq) and Meal expert (Syria) will from 1 July 2024 to 30 September 2026 perform 228 and 272 fewer working days in Turkey respectively (the total number of working days for each Key Staff shall remain unchanged).
