Økonomisk og finansiel stilling:

The applicant must confirm the economic ability in the ESPD part IV.B: ‘Economic and financial standing’ with information from the latest annual report regarding the following economic indicators:

1) Equity (total equity incl. share capital, reserves, revaluation, retained earning, etc.);

2) Equity ratio (equity/total assets).

If the applicant is relying on the capacities of one or more other entities (e.g. a parent or sister company or a subcontractor) or the applicant is a group of economic operators (e.g. a consortium) the information for the ESPD part IV.B must also be given in a separate ESPD from each of these entities, cf. section VI.3 ‘Additional information’. It is the sole responsibility of the applicant to secure that the minimum level(s) of standards required are reached when the applicant is relying on the capacity of other entities or when the applicant is a group of economic operators (e.g. a consortium).

Mindstekrav til niveauet:

The applicant’s fulfilment of the minimum requirements to economic and financial standing, will determine how many lots the applicant can be awarded in this tender competition, cf. section 9 of ‘the Ministerial Order on procurement by entities operating in the water, energy, transport and postal services sectors’ and the rules specified in document 20/02068-39, Tender Conditions, section 4.2 Evaluation model. A tenderer may submit tenders for all the lots the tenderer is prequalified for but can only be awarded lots for which the minimum requirements concerning economic and financial standing is meet. Please note that the numbers will be aggregated if the tenderer is to be awarded more than one lot.

Concerning 1: Equity from the latest annual report must be at least 33.3 % of the expected value of the individual lot for which the applicant wishes to apply. There is no aggregation rule at the pre-qualification stage, however, to be awarded more than one lot the equity must meet the following requirements as also specified in document 20/02068-39, Tender Conditions, section 4.2:

• award of lot 1 (section 1.1 and 1.2): equity to be minimum EUR 2 181 948;

• award of lot 2 (section 2): equity to be minimum EUR 1 870 408;

• award of lot 3: equity to be minimum EUR 2 225 531;

• award of lot 4 (section 4 and 6): equity to be minimum EUR 2 032 420;

• award of lot 5: (section 5) equity to be minimum EUR 1 895 246.

Concerning 2: Equity ratio from the latest annual report must be at least 20 pct. If the equity ratio is between 15 pct. and 20 pct. the applicant can qualify, if the equity exceeds the total expected value of the lot for which the applicant wishes to apply. As with equity, cf. 1., the numbers are aggregated if more than one lot is to be awarded, and as a result a tenderer with an equity ratio between 15 pct and 20 pct. must meet the following requirements:

• award of lot 1: equity to be minimum EUR 6 611 966;

• award of lot 2: equity to be minimum EUR 5 667 908;

• award of lot 3: equity to be minimum EUR 6 744 036;

• award of lot 4: equity to be minimum EUR 6 158 851;

• award of lot 5: equity to be minimum EUR 5 743 170.

The method for awarding the contracts is described in the Tender Conditions, section 4. Evaluation and award stage.

If the applicant is relying on the capacities of one or more other entities (e.g. a parent or sister company or a subcontractor) the information for the ESPD part IV.B must also be given in a separate ESPD from each of the entities, cf. section VI.3 ‘Additional information’. It is the sole responsibility of the applicant to secure that the minimum level(s) of standards required are reached when relying on the capacity of other entities.

The applicant must include up to 5 comparable and relevant references undertaken in the past 5 (five) years as part of the application. The references must be stated in the ESPD part IV.C: ‘Technical and professional ability’. Undertaken in the past 5 (five) years implies that the reference must not have been completed prior to the date reached when counting 5 years backwards from the submission date for pre-qualification. References older than this will not be taken into consideration. References which have not yet been fully completed can be included as part of the application, but if this is the case, the applicant must describe the parts which have not yet been delivered, and this may affect the evaluation of the applicant, cf. section II.2.9).

Each reference should include a description of the work performed, including the following:

• project scope;

• foundation construction works, covering but not excluded to: earthworks, concrete foundation structure, interims structures, handling of permits (handling of surface- and groundwater, soil pollutions, environmental measures/restrictions), geotechnical evaluation and pilling (engineering and execution);

• mobilization and work in remote distributed working areas;

• client and location of project;

• contract value (if possible);

• date of initiation and final delivery (day, month, year);

• project scope.

From the references it must be demonstrated that the Applicant has solid experience with similar foundations construction projects as requested in the scope of the tender, this includes:

• foundation construction projects, especially concerning earthworks, concrete foundation structure, interims structures, handling of permits (handling of surface- and groundwater, soil pollutions, environmental measures/restrictions), geotechnical evaluation and pilling (engineering and execution);

• mobilization and work in remote distributed working areas.

Any ambiguities and/or incomprehensibilities concerning the above information may have a negative effect on the selection of candidates, cf. section II.2.9. Please note the ‘description’ box can contain more text than is visible. I.e. it is possible to copy paste text into the box.

If the applicant is relying on the references of one or more other entities (e.g. a parent or sister company or a subcontractor) or the applicant is a group of economic operators (e.g. a consortium) the information for the ESPD part IV.C must also be given in a separate ESPD from each of these entities.

The number of references should not surpass a maximum of the 5 (five) most comparable and relevant references. If the applicant is relying on the capacity of one or more other entities (e.g. a parent or sister company or a subcontractor) or the applicant is a group of economic operators (e.g. a consortium) the maximum number of references to be submitted must still be respected and cannot exceed 5 when combined. If more than 5 references are submitted, the Contracting Authority will only consider the 5 most recent references determined by date of final delivery (in this case not yet finished references will not be included).

Applicants may not be subject to the mandatory grounds for exclusion, cf. the Danish Public Procurement Act (udbudsloven) Section 135 (1-3) and 136.
