Finansiel Stabilitet

The object of the tendered contract is to obtain the remaining excess layer for the Directors and Officers liability insurance policy (excess layer 7) with worldwide coverage for the contracting authority and its subsidiaries. The excess layer will have a limit of liability of EUR 5 000 000 for each and every claim and in the annual aggregate. The contract will be concluded as soon as possible after the standstill period has expired. The policy period will run from the date of conclusion of the contract to 28 February 2021, both days included.

Fremskyndet procedure:
The D&O insurance policy consists of a primary layer and 14 excess layers. FS could not have foreseen that FS would not receive an offer on excess layer 7 and that FS would be required to re-tender for layer 7 in order to be fully insured. FS has duly planned the tender processes for the primary layer and excess layers in order to have the contracts for the new D&O insurance policy (both primary layer and excess layer) concluded prior to the expiration of the existing D&O insurance policy on 29 February 2019, as it is absolutely vital for FS to have an insurance in place after that date. Therefore, it is also vital for FS that a contract for excess layer 7 comes into effect as soon as possible after the expiry of the existing policy in order to be fully insured. Consequently, FS finds that shortening the deadline pursuant to Section 57(5) in the Danish Procurement Act is warranted and justified.

A. Each tenderer must submit the ESPD as preliminary documentation that the tenderer is not covered by any exclusion grounds and has the required financial rating.
B. Agents: if the tenderer acts as an agent for an insurance company implying that the insurance company will eventually be party to the contract with Finansiel Stabilitet and thus the final issuer of the insurance policy, the ESPD must be completed by the insurance company. The agent is not required to complete an ESPD.

C. Joint applications/consortiums: if a group of insurance companies — either directly or through an agent acting on behalf of the insurance companies — submits an offer as a group, each of the insurance companies must complete an ESPD.
D. Only the company with whom FS intends to enter into a contract shall provide FS with documentation for the information in the ESPD. As documentation that the company has a financial rating of least A- (Standard and Poor's) or equivalent, the tenderer shall provide either an extract from the relevant register or a link to the website where information about the tenderer's financial rating may be found. As documentation that neither the company nor any member of the management has been caught by the exclusion grounds, reference is made to the tender conditions.
