Furthermore, the facultative (re)insurance services comprises assistance in regard to negotiating, placing and managing of facultative (re)insurance agreements (‘Placement and Contract Management Services’). The assistance comprises inter alia the following services:

• propose appropriate structures, including the scope of cover, in relation to facultative (re)insurance of specific projects;

• analyse the facultative (re)insurance market and give recommendations regarding the opportunities for facultative (re)insurance of specific projects;

• facilitate and participate in meetings between EKF and the reinsurer(s) regarding specific projects with the aim of creating awareness and appetite in the facultative (re)insurance market for providing (re)insurance of a specific project;

• assist EKF in collecting and providing the reinsurer(s) with relevant and required information on specific projects (incl. Q&A) in order to comply with fair presentation requirements as well as with specific requirements from the reinsurer(s);

• assist and facilitate negotiations and closing of facultative (re)insurance agreements between EKF and the reinsurer(s), incl. facilitation of a direct dialogue between EKF and the reinsurer(s), where appropriate;

• assist in making changes to the terms of a facultative (re)insurance agreement at the request of EKF, including replacing one or more reinsurer(s);

• verify that issued facultative (re)insurance agreements, including any amendments thereto, are in accordance with the agreed (re)insurance cover;

• assist EKF in premium, loss and recovery calculations and facilitate the timely payment of all such amounts;

• act as intermediary between EKF and the reinsurer(s) and provide active assistance to EKF upon occurrence of claim events and collections of compensation of loss under facultative (re)insurance agreements:

• ongoing relationship management in general in the facultative (re)insurance market on behalf of EKF based on an understanding of EKF’s role and portfolio composition in order to further strengthen and promote EKF’s presence in the facultative (re)insurance market;

• inform and advise EKF on a regular basis and particularly on specific events, on changes in market conditions, market participants (incl. downgrades if the reinsurance broker has knowledge hereof), products, price structure, etc., tailored at improving and supporting EKF’s position and possibilities in the market;

• assist in the initial stage of EKF's development of new products (more in-depth assistance in regard to EKF’s development of new products is out of scope, and a separate remuneration must be agreed between EKF and the reinsurance broker);

• perform and/or assist with all such other tasks agreed under the facultative (re)insurance agreement(s) entered into by EKF, which have been brokered under the contract;

• any other task which usually is performed by a reinsurance broker in regard to placing and managing facultative (re)insurance agreements on behalf of an ECA.

• assist and facilitate negotiations and closing of treaty reinsurance agreements between EKF and the reinsurer(s), incl. facilitation of a direct dialogue between EKF and the reinsurer(s), where appropriate;

• assist in making changes to the terms of a treaty reinsurance agreement at the request of EKF, including replacing one or more reinsurer(s);

• verify that issued treaty reinsurance agreements, including any amendments thereto, are in accordance with the agreed reinsurance cover;

• act as intermediary between EKF and the reinsurer(s) and provide active assistance to EKF upon occurrence of claim events and collections of compensation of loss under treaty reinsurance agreements;

• perform and/or assist with all such other tasks agreed under the treaty reinsurance agreement(s) entered into by EKF, which have been brokered hereunder;

• ongoing relationship management in general in the treaty reinsurance market on behalf of EKF based on an understanding of EKF’s role and portfolio composition in order to further strengthen and promote EKF’s presence in the treaty reinsurance market;

• assist in the initial stage of EKF's development of new products in order to secure such new products are in compliance with or can be added to the scope of the respective treaty reinsurance agreements placed by the broker hereunder;

The tenderer warrants that the tenderer is not subject to the exclusion grounds set out in section 135(1)-(3) and 136 and 137(1)(1)-(7) of the Danish Public Procurement Act.

If the tenderer is an association of businesses, the above applies to each business in the association.

If the tenderer relies on other entities' technical and professional ability, the above also applies to each of the supporting entities.

Teknisk og faglig kompetence:

The tenderer warrants that the tenderer meets the following minimum requirements for technical and professional ability:

• Lot 1: The tenderer must have at least five references on placing facultative quota share (re)insurance for international project finance transactions based on products as specified in paragraph 1.3.1 of the tender conditions or similar products. Each reference must relate to a (re)insurance agreement with a cover period of at least 5 years and must have been placed within the 3 years prior to the deadline for submitting tender offers.

• Lot 2: The tenderer must have at least two references on placing treaty reinsurance for international financial transactions based on products as specified in paragraph 1.3.2 of the tender conditions or similar products. Each reference concerning a quota share treaty reinsurance, must relate to a treaty reinsurance with a cover period of at least 5 years. Each reference concerning an excess of loss treaty reinsurance must relate to reinsured transactions with a repayment term of at least 5 years. Each reference must relate to reinsurance agreements which have been placed within the 3 years prior to the deadline for submitting tender offers.

Only references concerning tasks performed at the time of the submission of tender offers will be taken into account when assessing whether the minimum requirement has been met. If it is an ongoing task, it is therefore only those parts of the service which have already been performed at the time of the submission of tender offers that will be included in the assessment of the reference.

If the tenderer is an association of businesses, it will be sufficient that one of the businesses in the association or the businesses in the association jointly meet(s) the above minimum requirements.

If the tenderer relies on other entities' technical and professional ability, it is sufficient that the supporting entities or the tenderer and the supporting entities jointly meet the above minimum requirements.

Means of proof:

Before EKF decides to award a lot to a tenderer, EKF must obtain specific proof from the relevant tenderer in respect of the information stated in the ESPD, see section 151(1) of the Danish Public Procurement Act (‘DPPA’). EKF may also require the production of such proof at any time during the tender procedure where necessary to ensure that the tender procedure is conducted correctly. The tenderer must provide the requested proof within an appropriate time limit set by EKF.

EKF must request that the tenderer supplement or specify the received proof concerning the tenderer's suitability, see section 151(4) of DPPA or forward the outstanding proof within the framework of EU public procurement law.

As evidence of the tenderer not being subject to the exclusion grounds as set out in section 135(1) and (3) and section 137(1)(2) and (7) of DPPA, the tenderer (including entities on whom the tenderer relies in respect of its technical and professional ability) must, at EKF's request, provide the following proof of the information stated in the ESPD:

• an extract from the relevant register or similar document issued by a competent judicial or administrative authority showing that the tenderer is not subject to the exclusion grounds set out in section 135(1) of DPPA;

• a certificate issued by the competent authority in the relevant country as evidence of the tenderer not being subject to the exclusion grounds as set out in section 135(3) and section 137(1)(2) and (7) of DPPA.

In respect of Danish businesses, such proof may be provided by submitting a service certificate from the Danish Business Authority which is no more than 6 months old calculated from the deadline for the provision of proof set by EKF. In respect of other EU businesses, such proof must to the greatest extent possible be provided by submitting the means of proof specified in e-Certis: https://ec.europa.eu/tools/ecertis/#/search

As evidence of the tenderer meeting the minimum requirements for technical and professional ability, the tenderer (including entities on whom the tenderer relies in respect of its technical and professional ability) must, at EKF's request, provide the following proof of the information stated in the ESPD:

• a list of the most significant provision of services carried out within the past 3 years calculated from the deadline for submitting tender offers, stating the description, amount, start date, end date, recipients and recipients' contact details. If such information has been stated in the ESPD, the EKF does not expect to request further proof thereof. However, EKF reserves the right to contact the recipients for confirmation of the stated references.

If the tenderer is an association of businesses, each business in the association must, in addition to the proof set out above, provide a ‘Declaration on joint representative and joint, several, direct and unlimited liability’, see section 3.3.3 of the tender conditions.

If the tenderer relies on other entities' technical and professional ability, the tenderer must, in addition to the proof set out above, provide a ‘Support Form’, see section 3.3.4 of the tender conditions.

Under the Danish Act on the Complaints Board for Public Procurement, etc. (lov om Klagenævnet for Udbud m.v.), the following time limits apply to the filing of a complaint:

Oplysninger om frister for klageprocedurer:

Under the Danish Act on the Complaints Board for Public Procurement etc. (lov om Klagenævnet for Udbud m.v.), the following time limits apply to the filing of a complaint:

A complaint about not being selected must be filed with the Complaints Board for Public Procurement within 20 calendar days, see section 7(1) of the Act, from the date after notification has been sent to the candidates involved of who has been selected when notification is accompanied by the reason for the decision in accordance with section 2(1)(i) of the Act, and section 171(2) of the Danish Public Procurement Act (udbudsloven).

3) 6 months after the contracting authority has concluded a framework agreement calculated from the day after the day on which the contracting authority has notified the candidates and tenderers involved, see section 2(2) of the Act, and section 171(4) of the Danish Public Procurement Act.
