The lot concerns facultative (re)insurance brokerage services.
The facultative (re)insurance brokerage services comprises assistance in regard to the following services (‘Public Procurement Services’) as further described in the Requirement Specifications:
• assist with the design of the public procurement process in the design phase;
• create awareness of the public procurement process in the awareness phase;
• assist in market dialogues, market nurturing and market information exchange in the public procurement phase;
• placement of specific facultative (re)insurance agreements.
Furthermore, the facultative (re)insurance services comprises assistance in regard to negotiating, placing and managing of facultative (re)insurance agreements (‘Placement and Contract Management Services’). The assistance comprises inter alia the following services:
• propose appropriate structures, including the scope of cover, in relation to facultative (re)insurance of specific projects;
• analyse the facultative (re)insurance market and give recommendations regarding the opportunities for facultative (re)insurance of specific projects;
• facilitate and participate in meetings between EKF and the reinsurer(s) regarding specific projects with the aim of creating awareness and appetite in the facultative (re)insurance market for providing (re)insurance of a specific project;
• assist EKF in collecting and providing the reinsurer(s) with relevant and required information on specific projects (incl. Q&A) in order to comply with fair presentation requirements as well as with specific requirements from the reinsurer(s);
• assist and facilitate negotiations and closing of facultative (re)insurance agreements be-tween EKF and the reinsurer(s), incl. facilitation of a direct dialogue between EKF and the reinsurer(s), where appropriate;
• assist in making changes to the terms of a facultative (re)insurance agreement at the request of EKF, including replacing one or more reinsurer(s);
• verify that issued facultative (re)insurance agreements, including any amendments thereto, are in accordance with the agreed (re)insurance cover;
• assist EKF in premium, loss, and recovery calculations and facilitate the timely payment of all such amounts;
• act as intermediary between EKF and the reinsurer(s) and provide active assistance to EKF upon occurrence of claim events and collections of compensation of loss under facultative (re)insurance agreements;
• assist in the arrangements of meetings between the reinsurer(s) and EKF when needed (in general and in regard to specific projects)
• assist EKF in getting non-disclosure agreements, Power of Attorneys and other agreements and documentation in place in regard to the reinsurer(s);
• register and keep an archive of any correspondence and agreements with reinsurer(s);
• on-going relationship management in general in the facultative (re)insurance market on behalf of EKF based on an understanding of EKF’s role and portfolio composition in order to further strengthen and promote EKF’s presence in the facultative (re)insurance market
• Inform and advise EKF on a regular basis, and particularly on specific events, on changes in market conditions, market participants (incl. downgrades if the reinsurance broker has knowledge hereof), products, price structure, etc., tailored at improving and supporting EKF’s position and possibilities in the market;
• assist in the initial stage of EKF's development of new products (more in-depth assistance in regard to EKF’s development of new products is out of scope, and a separate remuneration must be agreed between EKF and the Reinsurance Broker);
• perform and/or assist with all such other tasks agreed under the Facultative (Re)insurance Agreement(s) entered into by EKF, which have been brokered under the contract;
• any other task which usually is performed by a reinsurance broker in regard to placing and managing facultative (re)insurance agreements on behalf of an ECA.
