Fremskyndet procedure:
The D&O insurance policy consists of a primary layer and up to 16 excess layers. The primary layer policy forms the basis of the excess layer policy and therefore, the contract for the primary layer policy must be concluded with the winning tenderer, before the tender for the excess layers can be initiated. In order for FS to have a the contracts for the new D&O insurance policy (both primary layer and excess layer) concluded prior to the expiration of the existing D&O insurance policy — which is vital — the tender for the excess layers needs to be initiated no later that at the beginning of October 2019. It will not be possible to have the contract for the primary layer D&O insurance concluded, if the ordinary time-limits are Applied in this re-tender for the contract. Therefore, FS finds that shortening the deadlines pursuant to Section 63(2) and 65(2) in the Procurement Act is warrented and justified.
