The contract notice concerns DALO's award of framework agreements for the procurement of mobile sensor systems, services and spare parts. The acquisition is divided into 2 framework agreements:
1) A framework agreement (acquisition contract) concerning the acquisition of the mobile sensor systems; and
2) A framework agreement (sustainment contract) related to the sustainment of the mobile sensor systems — mainly in form of delivery of spare parts and other sustainment services.
The acquisition contract and sustainment contract are to be seen as a whole and will be awarded to the same supplier.
DALO intends to use the deliverables for intelligence, surveillance and reconnaissance as well as for target acquisition and target designation. The mobile sensor system is intended as an electro-optical sensor solution supporting all branches of the Danish Defence.
There is a need for 2 sizes of sensor units, a medium range sensor unit and a long range sensor unit. Both shall be available for land and maritime applications, and should be available for airborne applications.
There is also a need for masts in 3 different sizes for different land platforms.
Basic mandatory features of the medium range mobile sensor system.
Observe in following spectral bands:
— visual,
— near infra red (NIR),
— medium wave infra red (MWIR).
Include following types of lasers:
— laser range finder (LRF),
— laser pointer (NIR),
— availability of laser target designator (Ltd — minimum 30 mJ for marking purposes).
Concept of operation for medium range mobile sensor system on land platforms.
The system can be operated in 3 ways:
1) The whole system mounted on the vehicle and operated from here;
2) The sensor is detached from the vehicle and placed on tripod in a short distance from the vehicle. Man machine interface (HMI) is still in the vehicle and the sensor is operated from here;
3) Whole system (sensor unit and HMI) is detached from the vehicle and placed on e.g. a roof and operated from here. Power from battery, mains or other. Tripod, battery and charging unit will be required for this scenario.
It shall be possible to attach and detach sensor unit and HMI from the vehicle manually and without the use of tools. System modules should be man portable.
It shall be possible to drive and observe with the sensor system at the same time with the mast in a low position.
Only while the vehicle is stationary it shall be possible to raise the mast to maximum height, use Ltd and get grid references on observed objects.
Scope of supply specific for the medium range system:
— sensor units,
— MMI incl. recording capability,
— tripod,
— charging unit,
— batteries.
Technical mandatory requirements for the medium range sensor system:
1) The complete weight of the sensor unit shall be no more than 26 kg. The sensor unit is defined as ‘The gyro stabilised platform that contains all sensors and lasers’ i.e. not including external power supplies, external cables, hand controllers and other auxiliary equipment;
2) The sensor unit shall comply with the values stated in MIL-STD 461 F or equivalent concerning Radiated Susceptibility 'RS103 Limits' for 'All ships above deck' (minimum 200 V/m);
3) The resolution of the MWIR sensor shall be no less than 1280 x 720 sensor elements.

Concept of operation for the long range mobile sensor system on land platforms:
The system will be operated by TACP units (Tactical air control parties) for AO (Artillery observers) and FAC (Forward air controllers). The system is permanently mounted on the vehicle and usually operated from here. The vehicles sensor system should be able to communicate with a TOC (Tactical operations center) when used for camp protection.
It shall be possible to drive and observe with the sensor system at the same time with the mast in a low position.
While the vehicle is stationary it shall be possible to raise the mast to maximum height, use Ltd and get grid references on observed objects.
Scope of supply specific for the long range sensor system:
— sensor units,
— HMI incl. recording capability.
Technical mandatory requirements for the long range sensor system:
1) The complete weight of the sensor unit shall be no more than 70 kg. The sensor unit is defined as ‘The gyro stabilised platform that contains all sensors and lasers’ i.e. not including external power supplies, external cables, hand controllers and other auxiliary equipment;
2) The sensor unit shall comply with the values stated in MIL-STD 461 F or equivalent concerning Radiated Susceptibility 'RS103 Limits' for 'All ships above deck' (minimum 200 V/m);
3) The resolution of the MWIR sensor shall be no less than 1280 x 720 sensor elements.
Scope of supply common for both medium range sensor system, long range sensor system and masts:
— training courses for master instructors and technicians,
— special tools and test equipment,
— spare parts,
— documentation,
— software,
— various types of service,
— support for integration onto a platform.
DALO intends to use the mobile sensor system on current operational vehicles and vessels, such as (however not limited to):
— MRZR from Polaris,
— intruder from Supacat,
— Piranha 5 from Mowag,
— NSW 11 meter RHIB,
— frigates of the Iver Huitfeldt-class,
— support ships of the Absalon-class,
— inspection ships of the Thetis-class,
— inspection vessels of the Knud Rasmussen-class,
— patrol vessels of the Diana-class.
And possibly on any other future vehicles, vessels and aircrafts operated by the Danish Defence.
The sustainment contract containing e.g. spare parts and services is intended for maintenance and enhancement of the mobile sensor systems, including support. The supplier shall assist in the integration of the mobile sensor system on any platform and shall assume full system responsibility in regards to the mobile sensor system on the platform.
DALO expects to make an initial purchase of 18-32 mobile sensor systems. DALO requires deliveries to commence no later than 13 months after receipt of a purchase order.
DALO expects to conduct testing of the mobile sensor systems in Denmark in the spring of 2020. The candidates shall be able to supply a medium range sensor unit and a long range sensor unit for the test together with relevant personnel for instruction and installation on platforms. Masts will not be part of the test. Laser designation capabilities will not be part of the test. Participation, accommodation and travel cost are at the tenderers’ own expense. The pre-qualified candidates will receive further information with the tender documents.

Regarding Section II.1.4 and II. 2.1): the estimated value of the framework agreement is 500 000 000 DKK — 1 000 000 000 DKK. The reason for the interval stated is the uncertainty regarding the actual value of the framework agreement. Hence, the lower limit of the interval constitutes DALO’s most qualified estimate of the actual value of the framework agreement at the present moment, while the upper limit of the interval constitutes the expected maximum value of the framework agreement in its duration. This tender is conducted according to the negotiated procedure, cf. directive 2009/81/EC, Article 26. The candidates who will be invited to submit tenders will receive further practical information regarding the negotiated procedure in the instructions to tenderers. Tenderers are expressly made aware that DALO reserves the right to regard the INDO as a best and final offer (BAFO) and to close the tender procedure and award the contract on the basis of the submitted INDO, i.e. without conducting any negotiations. Please note, that each candidate can only submit one request for participation. When submitting the offers (but not the request for participation), the tenderers must submit a solemn declaration stating:
1) That the tenderer is not subject to any of the reasons for exclusion stated in Art. 39(1) or 39(2) of the Defence and Security Directive (2009/81/EC); and
2) To which degree the tenderer has unpaid overdue debt in relation to tax, duties or social security contributions under Danish law or under the law of the country in which the tenderer is established. A template for the declaration will be provided with the tender documents, and the tenderer is encouraged — but not obliged — to use it. If the tenderer is composed of a group of entities (e.g. consortium), including temporary joint ventures, a solemn declaration must be submitted for each participating entity.

Be advised that DALO shall exclude a tenderer which has unpaid overdue debt of 100 000 DKK or more to public authorities in relation to tax, duties or social security contributions under Danish law or under the law of the country in which the tenderer is established, unless the tenderer has provided collateral for the overdue debt, will provide collateral for the overdue debt or has entered into an installment agreement, which has not been breached at the time of submitting the offer.

The low weight gimbals shall weigh no more than 26 kg (for the sensor unit) and have a nominal size of no more than 14 inches.

Similar deliveries with regards to high performance sensor systems shall be understood as gyro-stabilized electro-optical gimbals, which include cooled high definition thermal cameras (minimum sensor resolution 1280 x 720) within each of above mentioned lists. The high performance gimbals shall weigh no more than 70 kg (for the sensor unit) and have a nominal size more than 14 inches up to no more than 16 inches.

Only the deliveries (references) performed in the past 5 years at the time of the deadline for the request to participate will be considered when assessing if the minimum requirement for suitability stated below is fulfilled/which candidate has documented the relevant previous deliveries cf. IV.1.2). If the delivery in question is ongoing, it is only the part of the services/supplies performed and completed at the time of the deadline for the request to participate which will be included in the assessment of the delivery (reference).

When specifying the program run time the candidate should state the date for the commencement and completion of the deliveries. If this is not possible, e.g. because the delivery in question is performed on an ongoing basis according to a framework agreement, the description of the deliveries should nonetheless contain information on how the date is set.

(d) vehicle-mounted high-performance gimbal;
(e) high performance gimbal, that includes 70mj laser target designator (not platform specific);
(f) low weight gimbal with HD thermal sensor (minimum 1280 x 720 elements) either maritime vessel-mounted or vehicle-mounted;
(g) the candidate must further demonstrate experience within the past 5 years with sustainment arrangement regarding mobile sensor systems.

If prepayments are made, an on-demand guarantee from a recognized financial institution must be presented. The financial institution has to be approved by DALO.

Reference is made to the tender documents regarding payment terms. Invoicing must be done in accordance with the applicable Danish legislation on public payments. At present, this is Danish consolidation act. No 798 of June 2007 which requires invoicing to be done electronically. Exact terms will be stated in the contract.

No particular legal form is required. If the contract is awarded to a group of suppliers (e.g. a consortium), the participants are required to undertake joint and several liabilities and to appoint one supplier to represent the group.

Pursuant to the guidelines, industrial cooperation may be required, in so far as a concrete assessment shows that such cooperation is necessary in order to safe-guard essential Danish security interests. Such an assessment is currently being made in relation to the contract. Pre-qualified tenderers will be informed of the outcome. The framework agreement must be conducted in consideration of corporate social responsibility and it contains a labour clause. The pre-qualified candidates will receive further information with the tender documents. DALO demands that any person taking part in the performance of the contract/framework agreement must possess the appropriate personnel security clearance at the level required by DALO. Procedure
Rammeaftalens varighed i år: 15
Begrundelse for rammeaftaler med en varighed på mere end fire år:
As described in Section II.1.5) below, DALO will award:
1) A framework agreement (acquisition contract) concerning the acquisition of the mobile sensor systems; and
2) A framework agreement (sustainment contract) related to the sustainment of the mobile sensor systems. The length of the acquisition contract will not exceed 7 years. With regards to the sustainment contract, the framework agreement will have a duration of 7 years with a possibility for renewal 4 times for each 2 years (7 + 2 + 2 + 2 + 2). DALO has determined that such a duration is justified based on the following grounds in particular: the mobile sensor systems are expected to have a life span of approximately 15 years. DALO therefore has a need for sustainment that exceeds 7 years. Due to the numbers of mobile sensor systems to be delivered — as well as the expected integration costs associated with integration of the mobile sensor systems on DALOs platforms, it creates a need for a longer depreciation period than usual which also motivates a contract period exceeding 7 years. Furthermore, a great deal of knowledge and experience will be gathered throughout the contract period, in particular in relation to the integration on DALOs platforms. The need to minimize the technical and logistic difficulties that a change of supplier will result in also supports the need for at contract period longer than 7 years.

Objektive kriterier for udvælgelse:
Objective criteria for choosing the limited number of candidates: the limitation of candidates will be based on an evaluation of which candidates have documented the most relevant previous deliveries in comparison to the contract/purchases described in Section II.1.5) above, in terms of the nature and quantity of the previous deliveries. In the evaluation it will be evaluated positively if the candidate demonstrates experience with mast-mounted systems on vehicles. Further it will be evaluated more positively if the previous deliveries demonstrate experience with whether the low weight gimbals include HD thermal sensors and/or laser target designators. The evaluation will be based on the list of references submitted by the candidates according to Section III.2.3). In order for DALO to make a selection between the candidates fulfilling the minimum requirement, it is therefore very important that the candidates provides DALO with a good description of previous deliveries. Please note that any ambiguities and/or incomprehensibilities in the information submitted may be regarded negatively in the evaluation when selecting the limited numbers of candidates.

Pursuant to the Danish Consolidation Act No 593 of 2.6.2016 on the Complaints Board for Public Procurement (available at www.retsinformation.dk), the following time limits for filing a complaint apply:
Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, cf. § 7(1) of the Act on the Complaints Board for Public Procurement, provided that the notification includes an account of the reasons for the decision.

Other complaints must in accordance with § 7(2) of the Act on the Complaints Board for Public Procurement be filed with The Complaints Board for Public Procurement within:
1) 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union. The time-limit is calculated from the day after the publication date;
2) 30 calendar days starting the day after the contracting authority has notified the tenderers in question, that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes an account of the reasons for the decision;

3) 6 months after the contracting authority has entered into the framework agreement starting the day after the contracting authority has sent notification to the candidates and tenderers involved, cf. § 2(2).
The complainant must inform the contracting authority of the complaint in writing at the latest simultaneously with the lodge of the complaint to The Complaints Board for Public Procurement stating whether the complaint has been lodged in the standstill period, cf. § 6(4) of the Act on The Complaints Board for Public Procurement. If the complaint has not been lodged in the standstill period, the complainant must also state whether it is requested that the appeal is granted delaying effect, cf. § 12(1).
