DONG Energy's decisions with regards to prequalification and subsequent contract award will be taken separately for each of the 4 lots. For example, an applicant applying for lot 1 and lot 2 may be prequalified for lot 1, but not lot 2. However, there is nothing to prevent the applicant from being prequalified for both (or none) of the lots. 5-10 applicants are expected to be pre-qualified (per lot) and 3-5 of these are expected to be awarded framework agreements (per lot). Engineering consultancy services intended for future offshore wind farms outside Europe (e.g. Asia or USA) are unlikely to be procured through the tendered framework agreements, regardless of the place of delivery. The tendered framework agreement will be entered into by DONG Energy Wind Power A/S on behalf of a number of companies in DONG Energy Group (affiliates). The Contracting Entity or any affiliate may during the term of the framework agreement require the provision of Consultancy Services comprised by the framework agreement. These group companies are listed in the Tender Conditions document. The Contracting Entity may during the term of the framework agreements apply the procedure described in the Utilities Directive article 50, (f). This entails that the Contracting Entity may use a negotiated procedure without prior call for competition to contract for new services consisting in the repetition of similar services assigned to the contractor to which the Contracting Entity awarded an earlier contract, provided that such services conform to a basic project for which a first contract was awarded. Further elaboration is included in the tender material (appendix 11 to the contract draft).

The applicant must submit information enabling the contracting entity to identify and contact the applicant, preferably including the following information:

A.1 Company name and webpage;

A.2 Contact person, e-mail and telephone number;

A.3 Registration number.

The information should be provided in the eESPD part II, section A.

Further, the applicant shall submit information enabling DONG Energy to assess the applicant's economic and financial capacity. This shall include the following figures based on the latest 2 signed and approved annual reports:

— Turnover (revenue),

— Net result before tax,

— Current assets,

— Total assets (sum of all assets),

— Total shareholder's equity (equity including minority shares),

— Current liabilities,

— Intangible assets,

— Inventories,

— Trade receivables,

— Cash and cash equivalents,

— Trade payables.

The Applicant is encouraged to submit a description of its ownership and corporate structure. If the Applicant is a subsidiary, the Applicant is encouraged to submit the name of the highest possible group parent — being an entity directly or indirectly controlling more than 50 % of the Applicant. The information may be provided in part V of the eESPD. The Contracting Entity reserves the right to set a deadline for submission of the description of ownership structure after the deadline for request to participate.

If the Applicant wishes to improve its economic and financial assessment by relying financially on another legal entity, this should be indicated by ticking ‘yes’ in the eESPD part II, C. Further, the supporting legal entity shall fill in a separate eESPD. If the other supporting entity is a parent company to the Applicant and the companies have consolidated accounts, it is possible to submit financial information for the parent company only but it shall be made clear from part II C of the eESPD that the Applicant relies on the economic and financial information of the parent company or any other supporting entity by ticking ‘yes’ in section II C of the eESPD: ‘Does the economic operator rely on the capacities of other entities…’.

Please note that the financial information should be submitted in English or Danish. The Contracting Entity however reserves the right to supplement applications which partially or fully do not comply with this requirement, but encourages the Applicants to follow the instructions.

Teknisk og faglig kompetence:

The applicant must provide a list of the most relevant services (references), similar to the services comprised by the tender. For lot 1 and lot 2 in particular it is recommended that the list includes approx. 10 reference projects and a 2-4 page description of each of these.

DONG Energy encourages the Applicants to include the following information for each of the references:

— Title of the project;

— Customer (however, ‘anonymous’ is acceptable if the project is otherwise thoroughly described);

— Period of execution;

— Contract value or number of performed hours/days/weeks/months (note, that if no value is provided, DONG Energy will do a cautious assessment based on the description or — if this is not possible — disregard the reference);

— Description of the supply and the applicant's role in the project; and

— Relevant KPI's.

The information may be provided in part V of the eESPD. If the applicant wishes to upload more references than it is technically possible to submit via the eESPD, then the applicant may upload a separate file in Scanmarket including the reference list and refer to such file in the eESPD section V.

The applicant is encouraged to submit a separate reference list for each of the lots which the applicant wishes to apply for and to indicate clearly which lot each reference list concerns.

Minimum requirement for all lots:

The applicant must be certified according to ISO 9001 or equivalent.

Further minimum requirement for Lot 1 and 2:

The number of engineers employed or by other means engaged by the applicant who are suitably qualified to perform the services comprised by the tendered framework agreements may not be below 75.

Further minimum requirement for Lot 3 and 4:

none

Compliance with all minimum requirement is confirmed by ticking ‘yes’ in part IV of the eESPD.

Applications for prequalification must be submitted in the e-sourcing system Scanmarket. Please follow the link set out in I.3 above.

Applicants are requested to fill out the eESPD document using the XML file.

Applicants must have a financial strength proportionate to the magnitude of the contracts in order to ensure proper performance, and the necessary technical capacity to ensure proper fulfilment of the contract.

If the number of Applicants applying for prequalification exceeds 5-10, the limitation of the number of prequalified applicants will be based on which applicants demonstrate:

1. The highest financial and economic capacity proportionate to the magnitude of the contracts.

2. The most extensive and most relevant provision of services (references) similar to the services comprised by the tendered contracts.

Ad 1) Financial and economic capacity:

The assessment regarding the applicant's economic and financial capacity will be based upon the figures requested in section III.1.2) submitted by the applicant in the ESPD.

The assessment regarding the Applicant's economic and financial capacity will be based upon an overall assessment of the below three areas (in prioritized order):

Solvency;

Liquidity;

Profitability.

Ad 2) References:

The assessment regarding the applicant's references will be based upon the information requested in section III.1.3) last section, submitted by the applicant in the ESPD.

References will be given more weight in the evaluation than Financial and Economic Capacity.
