Acquisition and sustainment of Mobile Sensor Systems

The contract notice concerns DALO's award of framework agreements for the procurement of Mobile Sensor Systems, services and spare parts. The acquisition is divided into two framework agreements, 1) a framework agreement (Acquisition Contract) concerning the acquistion of the Mobile Sensor Systems and 2) a framework agreement (Sustainment Contract) related to the sustainment of the Mobile Sensor Systems — mainly in form of delivery of spares and other sustainment services.
The Acquisition Contract and Sustainment Contract are to be seen as a whole and will be awarded to the same supplier.
DALO intends to use the Deliverables for intelligence, surveillance and reconnaissance as well as for target acquisition and target designation. The Mobile Sensor System is intended as an electro-optical sensor solution supporting all branches of the Danish Defence.
There is a need for two sizes of sensor units, a medium range sensor unit and a long range sensor unit. Both shall be available for land and maritime applications, and should be available for airborne applications.
There is also a need for masts in three different sizes for different land platforms.
Basic mandatory features of the Medium Range Mobile Sensor System.
Observe in following spectral bands:
— Visual,
— Near Infra Red (NIR),
— Medium Wave Infra Red (MWIR).
Include following types of lasers:
— Laser Range Finder (LRF),
— Laser Pointer (NIR),
— Availability of Laser Target Designator (LTD — minimum 10 mJ for marking purposes).
Concept of operation for Medium Range Mobile Sensor System on Land platforms.
The system can be operated in 3 ways:
1.The whole system mounted on the vehicle and operated from here.
2. The Sensor is detached from the vehicle and placed on tripod in a short distance from the vehicle. Human Machine Interface (HMI) is still in the vehicle and the sensor is operated from here.
3. Whole system (sensor unit and HMI) is detached from the vehicle and placed on e.g. a roof and operated from here. Power from battery, mains or other. Tripod, battery and charging unit will be required for this scenario.
It shall be possible to attach and detach sensor unit and HMI from the vehicle manually and without the use of tools. System modules should be man portable.
It shall be possible to drive and observe with the sensor system at the same time with the mast in a low position.
Only while the vehicle is stationary it shall be possible to raise the mast to maximum height.
Scope of supply specific for the Medium Range System:
— Sensor units,
— HMI incl. recording capability,
— Tripod,
— Charging unit,
— Batteries.
Technical Mandatory requirements for the Medium Range Sensor System:
1. The complete weight of the sensor unit shall be no more than 35 kg.
2. The mounted Sensor Units maximum horizontal extent from vertical center line shall be no more than 0.25 meter.
3. The sensor unit shall comply with the values stated in MIL-STD 461 F or equivalent concerning Radiated Susceptibility ‘RS103 Limits’ for ‘All ships above deck’ (minimum 200 V/m).
Basic mandatory features of the Long Range Mobile Sensor System.
Observe in following spectral bands:
— Visual,
— Near Infra Red (NIR),
— Short Wave Infra Red (SWIR),
— Medium Wave Infra Red (MWIR).
Include following types of lasers:
— Laser Range Finder (LRF),
— Laser Pointer (NIR),
— Availability of Laser Target Designator (LTD — minimum 70 mJ for designating purposes).
Concept of operation for the Long Range Mobile Sensor System on Land platforms:
The system will be operated by TACP units (Tactical Air Control Parties) for AO (Artillery Observers) and FAC (Forward Air Controllers). The system is permanently mounted on the vehicle and usually operated from here. The vehicles sensor system should be able to communicate with a TOC (Tactical Operations Center) when used for camp protection.
It shall be possible to drive and observe with the sensor system at the same time with the mast in a low position.
Only while the vehicle is stationary it shall be possible to raise the mast to maximum height.
Scope of supply specific for the Long Range System:
— Sensor units,
— HMI incl. recording capability.
Technical Mandatory requirements for the Long Range Sensor System
1. The complete weight of the sensor unit shall be no more than 70 kg.
2. The mounted Sensor Units maximum horizontal extent from vertical center line shall be no more than 0.40 meter.
3. The sensor unit shall comply with the values stated in MIL-STD 461 F or equivalent concerning Radiated Susceptibility ‘RS103 Limits’ for ‘All ships above deck’ (minimum 200 V/m).
4. The resolution of the MWIR sensor shall be no less than 1 280x720 sensor elements.
Scope of supply common for both Medium Range Sensor System, Long Range Sensor System and masts:
— Training courses for Master Instructors and Technicians,
— Special tools and test equipment,
— Spare parts,
— Documentation,
— Software,
— Various types of service,
— Support for integration onto a platform.
DALO intends to use the Mobile Sensor System on current operational vehicles and vessels, such as (however not limited to):
— MRZR from Polaris,
— Intruder from Supacat,
— Piranha 5 from Mowag, and
— NSW 11 meters Rigid Hull Inflatable Boats (RHIB)
and on any other future vehicles, vessels and aircrafts operated by the Danish Defence.
The Sustainment Contract containing e.g. Spare Parts and Services is intended for maintenance and enhancement of the Mobile Sensor Systems, including support. The supplier shall assist in the integration of the Mobile Sensor System on any platform and shall assume full system responsibility in regards to the Mobile Sensor System on the platform.
DALO expects to make an initial purchase of 12-20 Mobile Sensor Systems. DALO expects the deliveries to commence no later than 13 months after receipt of a purchase order. DALO expects to conduct testing of the Mobile Sensor Systems in Denmark in June 2018 (June 8th — June 19th). The candidates shall be able to supply a Medium Range sensor unit and a Long Range sensor unit for the test together with relevant personnel for instruction and installation on platforms. Masts will not be part of the test. Laser Designation capabilities will not be part of the test. Participation, accommodation and travel cost are at the tenderers' own expense. The prequalified candidates will receive further information with the tender documents.

When submitting the offers (but not the request for participation), the tenderers must submit a solemn declaration stating to which degree the tenderer has unpaid overdue debt in relation to tax, duties or social security contributions under Danish law or under the law of the country in which the tenderer is established. A template for the declaration will be provided with the tender documents, and the tenderer is encouraged — but not obliged — to use it.

Be advised, that DALO shall exclude a tenderer which has unpaid overdue debt of 100 000 DKK or more to public authorities in relation to tax, duties or social security contributions under Danish law or under the law of the country in which the tenderer is established.

However, DALO may not exclude a tenderer which has provided sufficient documentation that the tenderer is reliable. DALO will decide whether the documentation is sufficient, hence the tenderer is considered reliable, based on the guidelines equal to the guidelines provided for in Section 138(1-4) of the Danish Act no. 1564 of 15.12.2015 — The Public Procurement Act.

Mindstekrav til niveauet:

The candidate must have had an annual turnover of at least 500 000 000 DKK for each of the last 3 financial years. If the turnover is not stated in said currency, DALO will calculate the turnover based on the official exchange rate on the date this notice was published.

If the candidate is composed of a group of entities (e.g. consortium), including temporary joint ventures, the annual turnover is calculated as the sum of all the participants annual turnover in each of the last 3 financial years available.

If the candidate relies on the economic and financial standing of an entity or entities, the annual turnover will be calculated as the sum of the candidate's annual turnover and the entity or entities' annual turnover in each of the last 3 financial years available.

The candidate must have had an equity ratio of at least 10 % percent for each of the last 3 financial years. The equity ratio is calculated by dividing the candidate's equity with the candidate's total assets (equity/total assets x 100).

If the candidate is composed of a group of entities (e.g. consortium), including temporary joint ventures, the equity ratio is calculated by dividing the sum of all the participants' equities with the sum of all the participants' total assets (sum of equity/sum of total assets x 100) in each of the last 3 financial years available.

If the candidate relies on the economic and financial standing of an entity or entities, the equity ratio is calculated by dividing the sum of the candidate's and the entity or entities' equity with the sum of the candidate's and the entity or entities' total assets (sum of equity/sum of total assets x 100) in each of the last 3 financial years available.

Please note that a candidate may rely on the economic and financial standing of other entities (e.g. a parent or sister company or a sub supplier), irrespective of the legal nature of the relations between the candidate and the entity or entities on which the candidate relies.

Teknisk og faglig kompetence:

Three (3) lists of the most important similar deliveries (references), cf. section II.1.5) carried out within the past 5 (five) years prior to the deadline for the request to participate.

The three lists shall contain information regarding references for:

A: Aircraft-mounted (rotary or fixed-wing);

B: Maritime vessel-mounted;

C: Vehicle-mounted.

Similar deliveries shall be limited to the following three types:

— Aircraft-mounted (rotary or fixed-wing) gyro-stabilized electro-optical system, which includes cooled thermal cameras.

— Maritime vessel-mounted gyro-stabilized electro-optical system, which includes cooled thermal cameras.

— Vehicle-mounted gyro-stabilized electro-optical system, which includes cooled thermal cameras.

For vehicle-mounted systems, please indicate whether or not the system is mounted on masts on the vehicle.

Each list should preferably include a short description of each delivery e.g. in the form of a data sheet. The description should also contain information on:

— the platform onto which the system was mounted,

— if vehicle-mounted whether or not the system was mast-mounted,

— a description of the candidates participation/role in the performance of the delivery,

— the date of the deliveries,

— the amount of systems delivered,

— the recipients of the deliveries (specific names/countries are preferred, but not necessary; if no country specific information is included, the candidate shall state whether the recipient country is a NATO-member or non-NATO-member).

Only the deliveries (references) performed at the time of the deadline for the request to participate will be considered when assessing if the minimum requirement for suitability stated below is fulfilled/which candidate has documented the relevant previous deliveries cf. IV.1.2. If the delivery in question is ongoing, it is only the part of the services / supplies performed and completed at the time of the deadline for the request to participate which will be included in the assessment of the delivery (reference).

When specifying the date for the deliveries, the candidate should state the date for the commencement and completion of the deliveries. If this is not possible, e.g. because the delivery in question is performed on an ongoing basis according to a framework agreement, the description of the deliveries should nonetheless contain information on how the date is set.

Please note that a candidate may rely on the technical and professional capacity of other entities (e.g. a parent or sister company or a sub supplier), irrespective of the legal nature of the relations between the candidate and the entity or entities on which the candidate relies.

Mindstekrav til niveauet:

The candidate must demonstrate experience with as a minimum one similar delivery within each of below mentioned categories within the past 5 years prior to the deadline for the request to participate.

Categories:

B: Maritime vessel-mounted gyro-stabilized electro-optical systems with cooled thermal cameras.

C: Vehicle-mounted gyro-stabilized electro-optical systems with cooled thermal cameras.

The candidate must further demonstrate experience within the past 5 years to have had experience with sustainment arrangement regarding Mobile Sensor Systems.

Krav om deponering og sikkerhedsstillelse:

If prepayments are made, an on-demand guarantee from a recognized financial institution must be presented. The financial institution has to be approved by DALO.

Reference is made to the tender documents regarding payment terms. Invoicing must be done in accordance with the applicable Danish legislation on public payments. At present, this is Danish consolidation act. no. 798 of June 2007 which requires invoicing to be done electronically. Exact terms will be stated in the contract.

No particular legal form is required. If the contract is awarded to a group of suppliers (e.g. a consortium), the participants are required to undertake joint and several liabilities and to appoint one supplier to represent the group.

The Supplier and any sub-supplier(s) are required to comply with NATO Security Regulations as implemented by the National Security Authority of the country in which the work is performed. The supplier will be required to ensure that only authorized security personnel have access to classified information or material in the course of performance of the contract.

Begrundelse for rammeaftaler med en varighed på mere end fire år:

As described in section II.1.5) below, DALO will award 1) a framework agreement (Acquisition Contract) concerning the acquistion of the Mobile Sensor Systems and 2) a framework agreement (Sustainment Contract) related to the sustainment of the Mobile Sensor Systems. The length of the Acquisition Contract will not exceed 7 years. With regards to the Sustainment Contract, the framework agreeement will have a duration of 7 years with a possibility for renewal 4 times for each two years (7 + 2+2+2+2). DALO has determined that such a duration is justified based on the following grounds in particular: The Mobile Sensor Systems are expected to have a life span of approximately 15 years. DALO therefore has a need for sustainment that exceeds 7 years. Due to the numbers of Mobile Sensor Systems to be delivered — as well as the expected integration costs associated with integration of the Mobile Sensor Systems on DALOs platforms, it creates a need for a longer depreciation period than usual which also motivates a contract period exceeding 7 years. Furthermore, a great deal of knowledge and experience will be gathered throughout the contract period, in particular in relation to the integration on DALOs platforms. The need to minimize the technical and logistic difficulities that a change of supplier will result in also supports the need for at contract period longer than 7 years.

Objektive kriterier for udvælgelse:

The limitation of candidates will be based on an evaluation of which candidates have documented the most relevant previous deliveries in comparison to the contract/purchases described in section II.1.5) above, in terms of the nature and quantity of the previous deliveries. Besides nature and quantity it will further be evaluated positively if the candidate demonstrates experience with mast-mounted systems on vehicles and experience with delivery of all three categories A: Aircraft-mounted (rotary or fixed-wing), B: Maritime vessel-mounted and C: Vehicle-mounted.

The evaluation will be based on the list of references submitted by the candidates according to section III.2.3). In order for DALO to make a selection between the candidates filfilling the minimum requirement, it is therefore very important that the candidates provides DALO with a good description of previous deliveries. Please note that any ambiguities and/or incomprehensibilities in the information submitted may be regarded negatively in the evaluation when selecting the limited numbers of candidates.

Tenderers are expressly made aware that DALO reserves the right to regard the INDO as a best and final offer (BAFO) and to close the tender procedure and award the Contract on the basis of the submitted INDO, ie. without conducting any negotiations.

Please note, that each candidate can only submit one request for participation. If the same legal entity is a part of or in any other way participates in several applications, e.g. submits his own application and at the same time participates in a consortium which also applies, the candidates shall ensure that the same legal entity's participation does not provide for opportunity for mutual coordination of their applications and offers. DALO reserves the right to request the candidates to establish and reassure DALO that the same legal entity's participation does not threaten the transparency and distort competition between the tenderers.

DALO reserves the right — but is not obliged — to use remedies equal to the remedies provided for in Section 159(5) of the Danish Act no. 1564 of 15.12.2015, the Public Procurement Act, if applications or tenders do not fulfil the formalities of the tender documents.

DALO demands that the candidate and each of the legal entities whose capacities the candidate relies on undertake joint and several liability for the performance of the contract.

Candidates are asked to submit their request to participate via ETHICS. The permalink is stated in section I.1). The request to participate cannot be submitted by e-mail.

DALO has prepared a prequalification questionnaire (PQQ) which candidates are strongly encouraged to use when submitting their applications. The PQQ contains questions, forms and templates for providing information etc. in accordance with the requirements in this Contract Notice. However, it is emphasized that it is the sole responsibility of the candidate that the information provided fulfils the requirements. The questionnaire is available via ETHICS. According to the EU defence directive, a candidate may rely on the economic and financial standing and/or technical and/or professional capacity of other entities, regardless of the legal nature of the links with the entities. If a candidate wants to rely on other entities and wishes that the capacity of other entities is taken into account when DALO assesses the suitability of the candidate, the candidate must prove that the other entities will and shall put the relevant resources at the disposal of the candidate. A template for a declaration from the supporting entity to this effect is included in the prequalification questionnaire referred to above.

DALO will host a clarification meeting for the prequalified candidates, which is expected to take place at DALO premises the 7.3.2018.

Pursuant to Section 3 of the Danish Consolidation Act no. 593 of 2 June 2016 on the Complaints Board for Public Procurement (available at www.retsinformation.dk ), the following time limits for filing a complaint apply:

Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, cf. § 7(1) of the Act on the Complaints Board for Public Procurement, provided that the notification includes a short account of the relevant reasons for the decision.

Other complaints must in accordance with § 7(2) of the Act on the Complaints Board for Public Procurement be filed with The Complaints Board for Public Procurement within:

1) 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union (with effect from the day following the publication date).

2) 30 calendar days starting the day after the contracting authority has informed the tenderers in question, that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes a short account of the relevant reasons for the decision.

3) 6 months starting the day after the contracting authority has sent notification to the candidates/tenderers involved that the contracting authority has entered into the framework agreement, provided that the notification included a short account of the relevant reasons for the decision.

4) 20 calendar days starting the day after the contracting authority has published a notice concerning his decision to uphold the contract, cf. the principle in § 185(2) of the Public Procurement Act (act no. 1564 of 15.12.2015 — available at www.retsinformation.dk ).

The complainant must inform the contracting authority of the complaint in writing at the latest simultaneously with the lodge of the complaint to The Complaints Board for Public Procurement stating whether the complaint has been lodged in the stand-still period, cf. § 6(4) of the Act on The Complaints Board for Public Procurement. If the complaint has not been lodged in the stand-still period, the complainant must also state whether it is requested that the appeal is granted delaying effect, cf. § 12(1) of the said act.

The tender procedure has been terminated without an award. One of the reasons is that some mandatory requirements were not fulfilled in the INDO2. Another reason is that as a result of the new Agreement for the Danish Defence an analysis of the need for the Mobile Sensor Systems is necessary, as DALO might need to acquire more systems than initially assumed in the tender. Because of the above mentioned reasons DALO has therefore decided to terminate the tender without an award in order to reconsider the tender material.
