Country programme monitoring is the responsibility of the Embassy. In order to ensure quality monitoring the Embassy has decided to assist partners with the development of, and implementation of adequate monitoring frameworks, collection of data and reporting on progress towards agreed results of the engagements or programmes as a whole, including financial aspects. Furthermore, the Embassy has decided that the management information should be structured in systematic and coherent manner. This contract is for the services of a consulting company, organization or consortium to assist with this.

The main objective of the assignment is to help ensure that Kenya Country Programme results are achieved as planned. This advisory support purpose is twofold:

— provide continuous systematic, structured and strategic management information based on the Kenya Country Program, including the CP Theory of Change (ToC), the Thematic Programmes and the Development Engagements (DE), as well as the M&E systems of the DE partners;

— increase the capacity of the Embassy DE implementing partners with regards to Results Based Management, including M&E and risk management.

The M&E Support is premised on the monitoring dimensions of the Danida Guidelines for Country Programmes that includes: monitoring of actual Results; assessing the efficiency and effectiveness of the programme; Monitoring of assumptions; to assess if the Theory of Change (ToC) is still valid, or whether the programme must adapt a new intervention Logic and/or implementation modality; monitoring of risks; and monitoring of VfM issues.

The M&E support will function as an early warning system with regards to fiduciary risks and deepen the analysis through targeted Value for Money (VfM) assessments. The contractor will be expected to provide services that entails extensive field monitoring and/or very close cooperation with the DE implementing partners depending on the development intervention design, in order to assess the quality of outputs (be it goods or services).

The Kenya Country Programme 2016-2020 is based on the vision of the Denmark-Kenya Partnership Policy 2015-2020 and will support the objective of Kenya's Vision 2030 ‘Contributing to a globally competitive and prosperous nation with a high quality of life by 2030’. The Country Programme consists of three thematic programmes (TPs). The Governance TP with DKK 225 million will support the constitutional reforms with essential change processes in 3 intervention areas:

(i) Democratic practices;

(ii) Public sector effectiveness; and

(iii) Peace, security and stability.

The Green Growth and Employment TP with 500 000 000 DKK will support transition to a greener growth path through support in two intervention areas:

(i) Sustainable growth and jobs from investment and trade; and

(ii) Sustainable use of natural resources and community resilience. The Health TP with 245 500 000 DKK million will support provision of equitable access to quality health care through two intervention areas, namely:

(i) Support to the devolved health sector in the form of operational support for primary health care facilities and for health systems strengthening at county and national government levels; and (ii) support for sexual and reproductive health and rights.

The scope of services are outlined in the ToR.The contractor will as requested share information and cooperation with a Real Time Evaluation team which Danida Headquarters as a pilot exercise, will do on the Denmark Kenya country programme.

Using the ESPD, the applicant should quote its annual turnover for the last 3 available accounting years.

The information should be provided in the ESPD, Part IV, B: Economic and financial standing, section 1a.

Unless the information is publicly and electronically accessible free of charge, the documentation for the turnover quoted in the ESPD should be included in the e-mail with the ESPD. The documentation should be in the form of financial statements or extracts from the financial statements or a statement of the undertaking's overall turnover certified by a chartered accountant or certified public accountant.

Mindstekrav til niveauet:

Minimum level(s) of standards possibly required: 24 000 000 DKK million each accounting year.

If the candidate is a joint venture, the joint venture shall, as a whole, meet the minimum conditions related to economic and financial standing. In that case, each member shall submit a completed and signed ESPD.

If the candidate relies on the capacity of others, the turnover is calculated as the sum of the turnover of the applicant and the other entity's (or entities') turnover.

An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links, which it has with them.

Where an economic operator wants to rely on the capacities of other entities, it shall prove to the contracting authority that it will have at its disposal the resources necessary, for example, by producing a commitment by those entities to that effect. The letter of commitment or relevant documentation shall establish the legal commitment of the party concerned to support the applicant for the full contract period.

Such entities, including the parent company of the candidate, must respect the same rules of eligibility, and must comply with the conditions as stated in this contract notice. Such an entity must also submit a completed and signed ESPD.

Teknisk og faglig kompetence:

Using the ESPD, the applicant should provide:

— a) a list of no more than 10 project references of contracts (entered or finalized) in the last 3 years of most relevant services provided cf. section II.2.4). The information should include a description of the assignment and the services provided, the contract sum, dates, and the name of the client. Information should be entered in the ESPD, Part IV, C, section (1b).

No documentation will be required for the information provided in the ESPD regarding project references of contracts.

— b) a description of the technical facilities and measures used by the economic operator for ensuring quality. Information should be entered in the ESPD, Part IV, C, section (3).

Documentation in the way of a certificate or description of the quality assurance system should be provided with the e-mail of the ESPD.

— Monitoring and evaluation of country level development programmes. Preferably with M&E experience from East Africa.

Regarding b): An EN ISO 9001 certification or similar, or another operating quality assurance and management system.

With regard to criteria relating to the educational and professional qualifications or to the relevant professional experience, economic operators may however only rely on the capacities of other entities where the latter will perform the works or services for which these capacities are required.

A group of economic operators will be required to enter a joint venture agreement.

Where a joint venture is proposed, the Ministry of Foreign Affairs of Denmark will require that all members of the joint venture are jointly and severally liable.

Precise information on deadline(s) for lodging appeals Pursuant to the Danish Act on Enforcement of the Procurement Rules, etc. (the Act is available at www.retsinformation.dk), the following deadlines apply to the lodging of appeals:

Appeals for not having been prequalified must be submitted to the Danish Complaints Board for Public Procurement (Klagenævnet for Udbud) within 20-calendar days calculated from the day after the day when the contracting authority has notified the applicants concerned which applicants have been prequalified provided that the notification has included a short explanation of the relevant grounds for the decision.

In other situations, appeals regarding tender procedures must be lodged with the Complaints Board for Public Procurement within:

1) 45-calendar days after the contracting authority has published a notice in the Official Journal of the European Union that the contracting authority has concluded the contract. The deadline is calculated from the day after the day when the notice was published.

2) 30-calendar days calculated from the day after the day when the contracting authority has notified the applicants concerned that a contract based on a framework agreement with reopening of competition or a dynamic purchasing system has been entered into if the notification has included a short explanation of the relevant grounds for the decision.

The complainant must no later than at the same time as lodging the appeal with the Complaints Board for Public Procurement notify the contracting authority that an appeal has been lodged with the Danish Complaints Board for Public Procurement and whether the appeal has been lodged within the standstill period, see section 3(1) of the Act.
