Eksport Kredit Fonden, The Danish Export Credit Agency (EKF), wishes to enter into a framework agreement for the provision of advice and strategic assistance on environmental and social sustainability issues, including in particular the following:
.
1) Environmental and Social Due diligence Review to establish if EKF conducts its business in accordance with EKF's CSR and environmental policies, including i.a. The OECD Recommendation on Common Approaches on the Environment and Officially Supported Export Credits, The Equator Principles, IFC Performance Standards and — if relevant — the Danish rules on animal welfare.

2) Monitoring of and follow up on EKF's projects.

3) Training and workshops for employees for the purpose of providing EKF with the expertise needed.

4) Small ad-hoc tasks relating to environmental and social sustainability advice, including also identification of relevant regulations in connection with project planning.

As an optional service under the framework agreement, EKF also invites tenders for support services in connection with the preparation of an annual CSR report based on the principles of the Global Reporting Initiative.

The framework agreement will be awarded to one supplier and is expected to take effect as from 1 November 2015.

A) The application for prequalification must be sent electronically marked ‘Confidential — tender for the provision of environmental and social sustainability advice’ to the contact person specified in section I.1). When the application has been sent, the applicant is requested to make a ‘reply all’ without attachments, thus re-sending a copy of the initial e-mail (but without attachments) to the contact person stated in section I.1). If just one of these two e-mails are received before expiry of the time limit, EKF will consider the application filed on time. . b) Any questions received by EKF during the prequalification process will, together with the answers, be published in anonymous form on http://www.ekf.dk/en/about-ekf/news/Pages/Tender-regarding-consultancy-services-on-environmental-corporate-and-social-responsibility.aspx and, if relevant also in a supplementary tender notice. c) EKF reserves the right to use the procedure described in section 12 of the Danish Executive Order no. 712 of 15.6.2011 on the procedures for the award of public works contracts, public service contracts and public supply contracts. . d) EKF will — after announcing the prequalification — forward the tender documents to the (up to) five prequalified applicants. Also, EKF will within five days of forwarding the material ask the prequalified applicants to confirm that they are still interested in the tender. If one or more applicants state that they do not intend to submit a tender within this time limit, EKF reserves the right to prequalify ‘the next applicant on the list’ based on the applications received.

Egnethed til at udøve det erhverv:

1) The applicant is requested to state its business name, address, Central Business Register (CVR) no., telephone no., contact person and e-mail address.

2) The applicant is requested to briefly describe its corporate form and primary business activities, organisation, ownership structure and number of employees.

3) The applicant must attach a solemn declaration stating that the applicant has no outstanding debt payable to any public authority under the Danish Consolidated Act no. 336 of 13 May 1997 and with reference to Article 45(1) and (2). The declaration may not be more than three months old counting from the date of the application. A template declaration is available at http://www.ekf.dk/en/about-ekf/news/Pages/Tender-regarding-consultancy-services-on-environmental-corporate-and-social-responsibility.aspx. The applicant may use another template at its own option.

When the contract has been awarded, the successful tenderer may be asked to submit a certificate from the Danish Business Authority (‘serviceattest’) or a similar statement concerning the above and may also be asked to submit a new declaration.

If the application for prequalification is made by a consortium, the application must be accompanied by the information specified in 1) — 3) for all consortium participants.

The applicant must attach the following:

4) Information about the applicant's audited revenue, results, equity and solvency ratio for the last three finalized, audited and approved financial years. If such documentation does not exist because the applicant is a newly (or younger) established business, the application must be accompanied by similar documentation. The financial ratios may be provided in a statement signed by the management or in an audit opinion or by submitting audited annual reports. EKF reserves the right to request additional information and/or verification of the information.

5) Information about the applicant's revenue from the provision of environmental and social sustainability advice as described above for the last three finalized, audited and approved financial years. If the applicant is a newly (or younger) established business the information can be provided for the years of existence. Please note that information about the applicant's revenue from the provision of environmental and social sustainability advice may be based on the applicant's best estimate. EKF notes that the audited annual reports will typically not include this information.

6) If the financial ratios provided for the last finalized, audited and approved financial year are more than three months old at the date of application, the applicant must also attach a statement that the financial ratios have not changed significantly since the last financial year or if the ratios have changed a short description of such changes and the (expected) reasons behind. EKF may take any such changes into account in connection with the prequalification.

If the application for prequalification is made by a consortium, the information specified in 4)-6) must be provided for all consortium participants.

If the applicant would like EKF to take for instance the capacity of another party, including any sub-consultant or parent company, into account when assessing the applicant's suitability, then the applicant must demonstrate that the applicant has access to the necessary resources from that party and must attach documentation of such party's obligations in this respect, for instance by way of an availability statement. The applicant must also attach the information specified in 4)-6) for the relevant party. If the application for prequalification is not accompanied by such information about capacity, this may affect the assessment of the applicant's suitability.

A) The applicant must have a revenue of at least 5 000 000 EUR in the last finalized, audited and approved financial year.

Teknisk og faglig kompetence:

The applicant is requested to attach the following:

7) A description of the applicant's most important references, which document experience providing environmental and social sustainability advice during the last three years. It is possible to state references where the project has been completed within the last three years, but references where the project is still in progress may also be relied upon.

For each reference, the following should be specified:

a) customer and contact person

b) the term of the contract (year of commencement/termination of advisory services)

c) the contract value

d) a short description of the services rendered

e) whether the reference fulfils the minimum level required as specified below

The applicant may provide no more than 15 references. If more than 15 references are provided, EKF will only consider the first 15 references when making the selection. If a reference does not contain all of the requested information, this will not necessarily entail non-compliance, but it may disadvantage the applicant in the selection process. EKF reserves the right to contact the references that are stated

The maximum of 15 references also applies if the applicant is a consortium or if the applicant uses sub-consultants.

8) Information about the applicant's average number of employees who have been engaged in providing environmental and social sustainability advice during the last three finalized, audited and approved financial years. Please note that information about the applicant's average number of employees may be based on the applicant's estimate.

9) A general description of the applicant's international network, including the location of own offices and/or offices of well-established partners of co-operation.

If the applicant would like EKF to take the capacity of another party, including any sub-consultant or parent company, into account when assessing the applicant's suitability, then the applicant must demonstrate that the applicant has access to the necessary resources from that party and must attach documentation of such party's obligations in this respect, for instance by way of an availability statement. The applicant must also attach the information specified in 7)-9) for the relevant party. If the application for prequalification is not accompanied by such information about capacity, this may affect the assessment of the applicant's suitability.

A) The applicant must provide at least 5 references that demonstrate experience in applying the combination of environmental, health & safety and social standards of international finance institutions such as the World Bank/IFC, EBRD, African Development Bank, etc.

b) The applicant must provide at least 5 references that demonstrate experience in managing multi-site projects drawing on in-country teams (either own offices or offices of partners of co-operation) for conducting environmental and social impact assessments and/or due diligence review of such documentation.

No particular legal form is required, but the applicant must clearly specify in the application for prequalification which legal person is the applicant and, as such, the subsequent tenderer and contract holder.

If the applicant is a consortium or association of business entities, all participating entities must accept direct, several and unlimited liability for the tender and for the performance of the awarded contract, and one entity with authority to bind the consortium must be appointed.

If EKF receives more than five (5) compliant applications for prequalification, the five prequalified tenderers will be selected on the basis of the following:.Among the applicants who prove to have sufficient financial ability, the selection will be based on the applicants' docu-mented experience in providing environmental and social sustainability advice. The selection will be based on to which extent an applicant has provided relevant, comparable references, including experience in a) due diligence assessment of sustainability, b) monitoring of current activities, c) support in connection with the preparation of CSR reports in accordance with Global Reporting Initiative and d) training and workshops..Furthermore, the selection will be based on the degree to which the applicant has provided relevant, comparable references that demonstrate comprehensive experience in applying environmental, health & safety and social standards of international finance institutions such as the World Bank/IFC, EBRD, African Development Bank, as well as experience in managing multi-site projects drawing on in-country teams (either own offices or offices of partners of co-operation) for conducting environmental and social impact assessments and/or due diligence review of such documentation..In addition to relevant experience, EKF will also take into consideration the extent of the applicant's international network and the economic and financial ability of the applicant, including but not limited to the applicant's revenue from the provision of environmental and social sustainability advice for the last three finalized, audited and approved financial years.
