Fehmarnbelt Fixed Link Project: Insurance Services

Femern A/S

The Fehmarnbelt Link Project (‘Project') is the final stage in the realisation of a straight traffic corridor between Scandinavia and continental Europe. This is intended to be an immersed tunnel containing two dual carriageways and a twin-track railway (‘Tunnel'). It will traverse the 18km distance across the Fehmarnbelt between Rødby on the island of Lolland in Denmark and Puttgarden on the island of Fehmarn in northern Germany.
Femern A/S requires insurance services related to construction of Fehmarnbelt Fixed Link comprising:
— Lot 1. Construction 'All Risks' and Public Liability Project Insurance. The Public Liability will contain a 'Primary' 2 500 000 EUR each and every occurrence limit of indemnity,
— Lot 2. Excess Project Public Liability Insurance, First Layer — Limit of Indemnity 7 500 000 EUR each and every occurrence in excess of EUR 2.5 million each and every occurrence;
— Lot 3. Excess Project Public Liability Insurance, Second Layer — Limit of Indemnity 40 000 000 EUR each and every occurrence in excess of 10 000 000 EUR each and every occurrence;
— Lot 4. Excess Project Public Liability Insurance, Third Layer — 50 000 000 EUR each and every occurrence in excess of 50 000 000 EUR each and every occurrence.
It is expected that some or all of the Lots may exceed the bidder's own treaty capacity. Femern A/S intends to control the placement of any facultative re-insurance that may be necessary and tenders should therefore be based solely on bidders' own treaty capacity. Accordingly, bidders will be able to tender for the whole or a part of each Lot.

Interested parties should email the contact point identified in section I.1 for a pre-qualification questionnaire. The email account will generate a 'delivery receipt'. In the event that a delivery receipt is not received within 30 minutes of submission then the contact point should be contacted by telephone. It is intended that the policies will cover: (1) the construction period for the Tunnel (which is expected to be between 96-108 months); and (2) with respect to certain types of occurrences associated with defects (including the rectification thereof) and maintenance services, the defects notice periods/maintenance periods in the construction contracts for a period up to 60 months after the commencement of commercial operation of the Tunnel. The Project is subject to German plan approval and the assent of the Danish parliament. The Construction Act for the Project was present to the Danish Parliament in February 2015 and the required submissions have been made to the German plan authorities. Femern A/S anticipates being in a position to start the works in 2016.

Complaints shall be submitted to Klagenævnet for Udbud according to Act No. 492 of 12.5.2010 as amended ('Håndhævelsesloven'). Complaints regarding the pre-qualification of applicants shall be submitted no later than 20 days from the date on which the contracting authority notifies the applicants of the results of the prequalification in accordance with section 7(1) of Håndhævelsesloven. Other complaints shall be submitted no later than 45 days after the date on which the contract award notice is published in the Official Journal of the European Union according to section 7(2) of Håndhævelsesloven.
