The tender will be carried out digitally, but it should be noted that award letters will be sent to the e-mail address of the contact person informed by the tenderer. For the handling of the procurement process, the contracting authority has chosen to use the procurement portal iBinder: www.ibinder.com Material regarding this tender is thus available at the procurement portal iBinder. Access to the procurement portal iBinder can only be obtained by direct invitation to iBinder from the contracting authority. An invitation to iBinder can be obtained by submitting an e-mail to Pia Pytlich: pipy@dtu.dk stating name and e-mail address of the bidder's contact person. In order to obtain access to the tender documents, a bidder must sign and return a confidentiality agreement. Invitation to iBinder will be forwarded as soon as possible after receipt of the signed confidentiality agreement. Access to the procurement portal iBinder is free for bidders. In the qualification form, the bidder must state the legal entity (e.g. a company) submitting the bid, including whether the bidder is a group of several bidders (a consortium). If the bidder is a group of several bidders (a consortium), the information must be submitted for each member of the group (the consortium). The bid must include a mandatory declaration certifying that the bidder has not been and cannot be excluded from tenders in accordance with Article 45 (1) and (2) of European Parliament and Council Directive No 2004/18/EC of 31.3.2004. The bidder must also include the bidder's solemn declaration regarding any outstanding debt payable to any public authorities, as this may affect the bidder's ability to qualify in accordance with Act No 336 of 13.5.1997. The client has prepared a mandatory declaration which the bidder must use to submit above requested information. If the bidder is an association of bidders (consortium), the mandatory declaration must be made for each association (consortium) participant. The bidder must state which legal entity (e.g. company) is submitting the bid, including whether the bidder is an association of bidders (consortium). If the bidder is an association of bidders (consortium), this information must be provided for each association (consortium) participant. The bidder must also provide information about any CVR No (Business Registration Number), the bidder's address and contact, including email address and phone number of such contact. The bidder and if the bidder is a group of several bidders (consortium) the Group (consortium) must provide proof that the bidder at the time of the bid will be able to supply the usual Construction warranty required under AB92 Section 6. It is accepted that the documentation of said warranty is not dated precisely at the date of the bid but dated some time between date of publication of this contract notice and the time limit of the bid. The contracting authority has prepared a form available along with the rest of tender documents on iBinder. Bidders are encouraged to use the form to avoid doubt as to the compliance of the documentation with the requirements. Be advised that the documentation of the bidder's general limit as to a warranty framework is not sufficient, unless the guarantor includes a statement of the available balance for coverage of said contract at the date of the bid. It should also be stated by the guarantor, that the warranty will be provided at time the contract may be awarded to the bidder.

It is a minimum requirement, in addition to submitting documentation for construction warranty that this or either in case of a warranty framework the available balance carries a minimum of 2 000 000 DKK available for this project.
Teknisk og faglig kompetence:
When completing the mandatory reference form drawn up by the contracting authority, the bidder must provide references from the most significant similar construction projects carried out/initiated within the last 5 years prior to the date of application. The reference form must be completed for each individual reference. The references submitted for consideration should include the customer's name, the services rendered in the construction project, the size of the construction project in terms of area (including whether it is gross or net area), the period of the construction project (which is to be understood as the term of the contract/performance), the contract price (in DKK). The references must be submitted as a solemn declaration and, therefore, each reference form must be dated and signed. The reference must be submitted under the tab ‘Bid’ in iBinder.

If the contract is extended with 10 % or more, then the employer may demand an equivalent raise in the security of the due performance. Please note minimum requirements stated under item III.2.2 regarding economic and financial ability. Regarding AB92 Section 7 be advised, that the employer will not provide performance bond.

It should be noted that the Construction contract will include a labour clause ordering the contractor to ensure that the pay and working conditions of both the contractor's own workers and those of his subcontractors, if any, are no less favourable than those applicable to work under a collective agreement within the trade or industry in question between the most representative labour market partners in Denmark. The contractor will be bound by contract to document that the Labour clause is complied with and that any failure to comply can lead to sanctions in the form of retention requirements, fines and possible cancellation of the contract for breach of the labour clause.

Appeals regarding this tender must be submitted to the Danish Tender Appeal Board no later than 45 days after the ordering authority publishes a notification in the Official Journal of the European Union to the effect that the ordering authority has concluded a contract. The deadline is calculated from the day the notification is published. Simultaneously with the appellant's submission to the Danish Tender Appeal Board, the appellant must also inform the client that an appeal has been submitted to the Danish Tender Appeal Board. The easiest way to do this is by the appellant either posting or emailing a copy of the appeal with appendices to the client. The Danish Tender Appeal Board needs to know whether the appellant has notified the client, and the appellant must therefore send a copy of such notification of the client to the Danish Tender Appeal Board.
