The tendered contract is the primary layer of a Directors and Officers insurance program. The excess layers will be subject to a separate tendering procedure (the estimated time for the notice to be published is October 2015).

Betingelser for deltagelse
Egnethed til at udøve det erhverv:

1) General description of the economic operator.

2) Solemn declaration that the personal situation of the applicant is not covered by the grounds for exclusion

mentioned in Article 45(1)-(2)(a,b, c, e, f) of Directive No 2004/18/EC

3) Solemn declaration that the applicant does not have any unpaid mature debt to any Danish public authority

in excess of 100 000 DKK, cf. Consolidated Act No 336 of 13.5.1997

A template for a declaration covering both 2) and 3) may be obtained from the contact person listed in Annex A. The applicant may — but is not required to — use this template to submit the required information.

AGENTS: If the applicant acts an agent for one or more insurance companies implying that the insurance company or companies will eventually be party to the contract with Finansiel Stabilitet and thus the final issuers of the insurance policy, the declarations on 2) and 3) above must be submitted for each insurance company represented by the agent. The agent, however, is not required to submit declarations on 2) and 3) above.

JOINT APPLICATION/CONSORTIUMS: If a group of insurance companies — either directly or through an agent acting on behalf of two or more insurance companies — apply for participation as a group and intend to submit an offer as a group if qualified — the above information shall be provided for each insurance company party to the consortium.

Økonomisk og finansiel stilling:

Information on the applicant's financial rating. The applicant is requested to state its financial rating. A template declaration may be obtained from the contact person listed in Annex A.

Mindstekrav til niveauet:

The economic operator's financial rating must be at least A- (Standard & Poor's) or equivalent.

Kontraktens udførelse

There are no specific requirements regarding the legal form to be taken by a group of economic operators in order to be eligible for award of the contract. However, if a group of economic operators submits a joint offer, all economic operators in the group must be jointly and severally liable for the performance and fulfillment of the contract.

AGENTS: It should be clearly stated in the application if the applicant acts as an agent for one or more insurance companies implying that the insurance company or companies will eventually be party to the contract with Finansiel Stabilitet and the final issuer of the insurance policy.

Udførelsen af tjenesteydelsen er forbeholdt et bestemt erhverv:

Chapter 3, Section 11 and Chapter 5 of the Danish Financial Business Act (consolidated Act No. 182 of 18.2.2015 — ‘lov om finansiel virksomhed’).

For complaints regarding decisions related to the prequalification stage, the deadline is 20 days from the date on which the decision in question has been notified to the applicants.
