Tenderers must state clearly and unambiguously in their tenders which legal entity is the tenderer and thereby responsible to the Danish Nature Agency.

Tenderers that have been convicted of one or more of the types of criminal offence listed in Article 45(1) of the Procurement Directive, or that are covered by one or more of the circumstances listed in Article 45(2)(a)–(c) of the Procurement Directive, will be excluded from the procurement procedure.

To demonstrate evidence of economic suitability, tenderers must submit documentation showing that the tenderer has or can obtain the relevant professional indemnity insurance for the agreement.

Teknisk og faglig kompetence:

Tenderers must submit the following to document their technical and specialist suitability:

1. References for the company. A maximum of five references should be attached, covering projects which the tenderer has undertaken within the specified area in the last three years. The list of references must include the following information:

a. Recipient of laboratory analyses/sampling (customer), stating contact person

b. Brief description of the project

c. Contract period

d. Contract value in DKK

In cases where it is not possible to submit references for a sub-agreement, a valid or reasonable explanation for this must be given.

2. Information on how large a proportion of the contract the tenderer intends to subcontract. The percentage of the total financial tender accounted for by subcontracting must be stated. The proportion must not be greater than 70 % in terms of DKK.

3. A description of the tenderer's organisation and employees.

4. A copy of the accreditation document(s) of the tenderer and any sub-supplier(s) of the tenderer from the Danish Accreditation and Metrology Fund (DANAK), or from an equivalent accreditation body that is also a cosignatory to the European co-operation for Accreditation (EA)'s multilateral agreement on mutual recognition.

Kontraktens udførelse
De vigtigste finansieringsbetingelser og betalingsordninger og/eller henvisning til de relevante bestemmelser, der regulerer dem:

Invoices are to be sent monthly. Another interval may be agreed between the Supplier and the Danish Nature Agency. The Supplier must provide an electronic invoice to the Danish Nature Agency.

Otherwise, invoicing must be in accordance with the rules laid down in the Public Payments, etc. Act, see Act no. 1203 of 27 December 2003 as amended, see Consolidating Act no. 798 of 28 June 2007, and the rules issued on the basis of this Act. All invoicing must be free of charges and at no cost to the Danish Nature Agency.

Where a tender is submitted by a consortium including multiple responsible tenderers, each legal entity must be specified individually in a clear and unambiguous way and the consortium members must also specify a joint authorised representative with whom the Danish Nature Agency can enter into a contract with binding effect on the consortium. The consortium members have joint and several liability. Where a consortium is awarded the contract, each member of the consortium must submit a written declaration that it is jointly liable for the fulfilment of the contract.

Andre særlige vilkår:

It will be a contractual requirement that the supplier and any subcontractors ensures employees wages (including benefits), working hours and other working conditions not less favorable than those established for work of the same kind under a collective agreement concluded by the most representative organizations of employer and employee within the subject area by the most representative employers/employees in Denmark and which are applied throughout the Danish area. By fulfilling the contract is understood work carried out in Denmark in order to fulfill the contract. The contract will therefore contain a provision ensuring this.

The supplier can contact the relevant organization of employer or employee in relation to which the agreement can be considered representative within the subject area.

Oplysninger om frister for klageprocedurer:

Complaints must be received in the Board of Appeal within 45 days from the day following the publication in the Official Journal of the European Union that the contracting authority has signed a contract, or within 6 months from the contracting authority informed the tenderers whom the contracting authority will conclude contracts with, if it is a framework agreement. According to the Law on Enforcement of procurement rules, Act no. 492 of 12.5.2010, with subsequent amendments, the Danish Nature Agency first sign the contract with the successful bidder(s) 10 days after the notification is sent to all bidders by e-mail. If complaint is received by the Board of Appeal before the expiry of the standstill period, the complaint automatically has temporary suspensive effect, until the Board of Appeal has ruled on whether an appeal has suspensive effect.

Oplysninger om frister for klageprocedurer:

Complaints must be received in the Complaints Board for Public Procurement within 45 days from the day following the publication in the Official Journal of the European Union that the contracting authority has signed a contract or within 6 months from the contracting authority informed the tenderers whom the contracting authority will conclude contracts with, if it is a framework agreement. According to the Law on Enforcement of Procurement Rules, Act No 492 of 12.5.2010, with subsequent amendments, the Danish Nature Agency will not sign the contract with the successful bidder (s) until 10 days after the notification is sent to all bidders by e-mail. If complaint is received by the Complaints Board for Public Procurement before the expiry of the standstill period, the complaint automatically has temporary suspensive effect, until the Complaints Board for Public Procurement has ruled on whether an appeal has suspensive effect.
