The present tender is a re-publication of the former tender ‘Apps for game consoles and HbbTV’ published by the Contract Notice 2014/S 083-144782, which was cancelled by 2014/S 159-286067.
The Contracting Authority is the largest Provider of streaming media on the Danish market and wishes to be present at various devices such as HbbTV (connected TV), game consoles, smart phones and tablets. The scope of this tender is to replace the current HbbTV application with a new version and add applications for Playstation 3 & 4.
The object of the present tender is for DR to enter into a framework agreement regarding development of TV Apps for Large and Small Screen Devices for DR's main video streaming services of DR TV.
Please notice, that there will be held a Tender Information meeting for the purpose of clarifying the content and structure of the tender material. For further details please see the Tender Conditions section 5.3.

Tenderers must in addition to the submission of a tender complete and submit a Solemn Declaration (Document A) as documentation of whether or not the company has unpaid outstanding debts to public authorities concerning social security contributions, taxes or duties cf. the Danish Act no. 336 of 13/5/1997 on restricting debtors access to public tenders. Document A is also documentation as to whether the Tenderer should be excluded from participation cf. article 45 in Directive 2004/18/EC of the European Parliament and the Council (Public Procurement Directive). The Contracting Authority‘s template must be used and can be downloaded at http://www.eu-supply.com/dr.asp If the Tenderer is a consortium or similar group of economic operators, a legally binding declaration regarding the circumstances in III.1.3 signed by all participating companies must be submitted together with Document A for each participating company.

Økonomisk og finansiel stilling:

As documentation for the Tenderer‘s economic and financial capacity, the Tenderer must complete and submit Document B - Key Figues (Economic and financial capacity) containing the following key figures:

1) Overall turnover;

2) Turnover in the area covered by the framework agreement;

3) Net Profit after taxes;

4) Equity;

5)The Equity Ratio;

6) The Liquidity Ratio;

7) The Proit Margin;

8) The number of full time employees.

All key figures must be stated for the past 3 financial years available. If the Tenderer has existed for less than 3 years, key figures for all available financial years must be stated. The statement must be verified by a signature from the auditor or accountant of the Tenderer having authorization to certify the key figures. If the Tenderer is a consortium or a similar group of economic operators, Document B - Key Figures must be completed and submitted for each participating company. If a Tenderer intends to rely on the financial and/or economic capacities of other entities, the Tenderer must prove that it will have at its disposal the resources necessary by documenting the joint liability between the companies. Accordingly, the Tenderer must also submit document B - Key Figures (Economic and financial capacity) for all relevant entities.

The Contracting Authority reserves the right to obtain material in accordance with section 12 in Consolidation Act no. 712 of 15.6.2011.

Mindstekrav til niveauet:

The Contracting Authority reserves the right to exclude any Tenderer which for financial reasons are clearly unsuitable to deliver the requested services.

Teknisk og faglig kompetence:

As documentation for the Tenderer‘s technical capacity, the Tenderer must complete and submit a list of references (Document C) in which the Tenderer provides information regarding the most important contracts of similar nature as to the object of the framework agreement described in item II.1.5. executed within the past three years. Document C - List of References (Technical Capacity).

The list of references must include the following information:

i) Name of customer and if possible contact person,

ii) Value of the contract in DKK,

iii) Use of sub-contractors if relevant,

vi) Description of the contract.

The Tenderer must indicate whether or not it is contemplating the use of subcontractors in relation to the present framework agreement and the technical qualifications of the subcontractors, in accordance with the above mentioned.

The Tenderer must specify which subcontractors will be part of the framework agreement.

If the Tenderer is a consortium or a similar group of economic operators, one joint list of references must be submitted with a clear indication of which company each reference relates to.

If the Tenderer intends to rely on other entities, the Tenderer must document that it will have at its disposal the resources necessary by documenting the joint liability between the companies.

Accordingly, the Tenderer must also submit Document C - List of References for all relevant entities.

Mindstekrav til niveauet:

The Tenderer must be able to document 2 references of relevance for HbbTV, 1 reference of relevance for Playstation 3 and 1 reference of relevance for Playstation 4 within the last 3 years.

Tenderers which are in a consortium or a similar group of economic operators are jointly and severally liable to the Contracting Authority in case they are awarded the framework agreement.
