Odense Tramway - Independent Safety Assessor

Odense Letbane

The services of an independent safety assessor will be procured to assess all aspects of the design, manufacture, construction, installation, training, testing, commissioning, trial running and initial operation of the Light Rail Transit system to verify compliance with the governing standards for the assessment services and the standards governing safety of the Odense Tramway.
Legislative basis for development of the project: A Law will be enacted by Parliament authorising construction of the Odense Tramway. Legislation, regulations, standards and norms governing safety of the design and operation of the Odense Tramway shall include:
BOStrab (Verordnung über den Bau und Betrieb der Strassenbahnen) and BOStrab-Richtlinien;
Applicable standards of Verband Deutscher Verkehrsunternehmen” (Association of German Transport Companies – VDV);
Applicable Danish norms and standards;
CENELEC railway standards EN 50126, 50128, 50129 (safety management, verification and validation);
Applicable requirements of the CEN 45545 fire safety standards.
The safety assessments shall be carried out pursuant to EN 50126 (RAMS), EN 50128 and EN 50129, which correspond respectivelyl to IEC 62278, IEC 62279 and IEC 62425.
The applicable procedures for regulatory approval by the Danish Transport Authority (Trafikstyrelsen) must be complied with, including Order No. 54 of 24 January 2013 concerning approval of the light rail vehicles, Order No. 1187 of 12 December 2012 concerning authorisation for operation of railway subsystems, Order No. 14 of 4 January 2007 concerning safety certification of railway companies, Order No. 13 of 4 January 2007 concerning safety certification of railway infrastructure managers and Chapters 3 and 4 of the Rail Act concerning permission to operate rail services and managing rail infrastructure.

The number of invited respondents is five. Insofar as the number of respondents, whose request is in compliance with the requirements of this notice, exceeds five, the selection of respondents will be based on the following grounds: - the quality of references for light rail, metro or similar assessment assignments during the previous 10 years; - the number and credentials of staff of the respondent specialised in light rail and operation of light rail systems applying the standards set out in III.2.3 The declarations to be submitted cf. section III.2 must not be older than six months before the deadline for receiving requests. If the respondent consists of a joint group of firms (e.g. a consortium) each member of the consortium should submit the declaration/report. The primary method of sharing documents between Odense Letbane and the respondents is the Odense Tramway Tender Portal that has been established for the project. This Portal called DOCIA and administered by ByggeWeb is the online method that will be used for the Odense Tramway to both issue formal project Tender material and receive Bids (Offers) from the Tenderers. Further details are available in the ByggeWeb / DOCIA Instruction manual (see http://www.byggeweb.dk/cms/uk/). Respondents shall be granted access to the Odense Tramway Tender Portal by use of a unique link, username and password sent by request via the email address in section I.1 above. The respondents must provide the following documents:

1. A solemn declaration, made in accordance with the template to be found on the DOCIA web page (Annex A), stating whether the respondent has fulfilled its obligations relating to the payment of direct and indirect taxes and social security contributions in accordance with the legal provisions of the country in which the respondent is established or in Denmark, in accordance with the Danish Consolidation Act No. 336 of 13.5.1997 on the restriction of Debtors' Options for Participating in Public Procurement Procedures and on the Amendment of Certain other Acts.

2. A solemn declaration, made in accordance with the template on the DOCIA web page (Annex B), stating whether the respondent is excluded from participating in a public contract due to the reasons stated in Article 45 of Directive 2004/18/EC, cf. Article 54, section 4 of Directive 2004/17.

Submission from foreign respondents of a similar declaration/report from their country containing the same information as the Danish solemn declaration is also sufficient. Please be aware that the declaration from the respondent may only contain information about the respondent's own country and the tender must then be supplemented with a declaration about the respondent's public debt in Denmark.

3. A solemn declaration, made in accordance with the template on the DOCIA web page (Annex C), stating that the respondent shall adopt satisfactory quality assurance processes to ensure professional independence during execution of the safety assessment services if awarded a contract for provision thereof.

Økonomisk og finansiel stilling:

The respondents must provide the following financial key figure information:

a) Equity (must be positive) in each of the last 2 complete financial years

b) The solvency ratio in each of the last 2 complete financial years

c) Revenue in each of the last 2 completed financial years.

Should the request for participation come from a consortium, then the annual accounts must be submitted for each single consortium member.

Teknisk og faglig kompetence:

Experience of tram, light rail, metro or similar assignments;

Experience in using the standards BOStrab, VDV Richtlinien, EN 50126, EN 50128 and EN 50129;

Experience in Banedanmark's norms and regulations;

Experience in Danish rail infrastructure;

Organisation of the respondent's enterprise, including consortium members and subcontractors;

Documentation to be provided:

— Description of the enterprise and of the subcontractors,

— Description of the number of staff within the field of tram, light rail and operation of tram, light rail systems,

— References from tram, light rail, metro or similar assessment assignments during the previous 10 years, which contain experience in assessment of light rail transit systems from commencement of design to start up of operation. The references should include the name of the client, contact person, the period of the contract, economic size and description of the tasks performed. The information should be i accordance with the template to be found on the DOCIA web page (Annex E)

— Documentation on competencies on safety issues for compliance with international standards governing rolling stock, track, overhead catenary system, including power distribution system, interlocking, telecommunications, command and control, depot and workshop, SCADA system and operation and maintenance of railway systems, rolling stock and Civil Works. The information should be i accordance with the template to be found on the DOCIA web page (Annex E).

If a consortium should be awarded the contract each member of the consortium must sign a certificate of joint and several liability under the contract.

Andre særlige vilkår:

The contract, which is a part of the tender documents, contains social considerations.

The assessor who will be assigned to the task must comply with the standards of EN 45 011 and shall be approved by the Danish Railway Authority (Trafikstyrelsen) before a contract can be entered into.

Oplysninger om frister for klageprocedurer:

A complaint lodged on the grounds that the entity was not prequalified for the further tender proceedings must be submitted to the Danish Procurement Board of Complaints within 20 calendar days. The 20 calendar days are calculated from the day where the contractor issued information to the enitities expressing interest on which enitities has been prequalified, provided that this information containes a short explanation on the relevant reasons for the decision.

Aside from complaints on prequalification, complaints must be submitted to the Danish Procurement Board of Complaints within 45 days after the contractor has published a notice on award of contract. The deadline for submission of complaints is calculated from the day after publication of the notice of award of contract.
