Odense Tramway - Independent Safety Assessor

Odense Letbane

The services of an independent safety assessor will be procured to assess all aspects of the design, manufacture, construction, installation, training, testing, commissioning, trial running and initial operation of the Light Rail Transit system to verify compliance with the governing standards for the assessment services and the standards governing safety of the Odense Tramway.
Legislative basis for development of the project: A Law will be enacted by Parliament authorising construction of the Odense Tramway. Legislation, regulations, standards and norms governing safety of the design and operation of the Odense Tramway shall include:
BOStrab (Verordnung über den Bau und Betrieb der Strassenbahnen) and BOStrab-Richtlinien;
Applicable standards of Verband Deutscher Verkehrsunternehmen” (Association of German Transport Companies – VDV);
CENELEC railway standards EN 50126, 50128, 50129 (safety management, verification and validation);
Applicable requirements of the EN 45545 fire safety standards.
The safety assessments shall be carried out pursuant to EN 50126 (RAMS), EN 50128 and EN 50129, which correspond respectively to IEC 62278, IEC 62279 and IEC 62425.
The applicable procedures for regulatory approval by the Danish Transport Authority (Trafikstyrelsen) must be complied with, including Order No. 54 of 24 January 2013 concerning approval of the light rail vehicles, Order No. 1187 of 12.12.2012 concerning authorisation for operation of railway subsystems, Order No. 14 of 4 January 2007 concerning safety certification of railway companies, Order No. 13 of 4 January 2007 concerning safety certification of railway infrastructure managers and Chapters 3 and 4 of the Rail Act concerning permission to operate rail services and managing rail infrastructure.

The expected number of invited respondents is 5. Insofar as the number of respondents, whose request is in compliance with the requirements of this notice, exceeds five, the selection of respondents will be based on the following grounds in prioritized order of bullets: 1) the quality of references for light rail, metro or similar assessment assignments during the previous 10 years, as well as experience in using standards BOStrab, VDV Richtlinien, EN50126, EN50128 and EN50129; 2) equity, the solvency ratio and revenue of the respondent The primary method of sharing documents between Odense Letbane and the respondents is the Odense Tramway Tender Portal that has been established for the project. This Portal called DOCIA and administered by ByggeWeb is the online method that will be used for the Odense Tramway to both issue formal project Tender material and receive Bids (Offers) from the Tenderers. Further details are available in the ByggeWeb / DOCIA Instruction manual (see http://www.byggeweb.dk/cms/uk/). Respondents shall be granted access to the Odense Tramway Tender Portal by use of a unique link, username and password sent by request via the email address in section I.1 above. Respondents will receive notification about updated or new documents on the Odense Tramway Tender Portal from the email address in section I.1 above and shall confirm receipt of the notice. Requests should be submitted electronically via the Odense Tramway Tender Portal. The request must contain contact information of the company requesting prequalification, phone, email address and name of contact person. The request should include a general description of the company including ownership, submitted in accordance with the templates on the DOCIA web page (Annex D). The request should comprise the information requested in accordance with the template on the DOCIA web page; Annexes A – E and G in filled-in state, and if applicable, the Annexes F and H. The Annexes to be used for request of participation will be available on the DOCIA web page from 9.7.2014.

The respondents must provide the following documentation:
1. A solemn declaration, made in accordance with the template to be found on the DOCIA web page (Annex A), stating whether the respondent has fulfilled its obligations relating to the payment of direct and indirect taxes and social security contributions in accordance with the legal provisions of the country in which the respondent is established or in Denmark, in accordance with the Danish Consolidation Act No. 336 of 13.5.1997 on the restriction of Debtors' Options for Participating in Public Procurement Procedures and on the Amendment of Certain other Acts.

2. A solemn declaration, made in accordance with the template on the DOCIA web page (Annex B), stating whether the respondent is excluded from participating in a public contract due to the reasons stated in Article 45 of Directive 2004/18/EC, cf. Article 54, section 4 of Directive 2004/17. Submission from foreign respondents of a similar declaration/report from their country containing the same information as the Danish solemn declaration is also sufficient. Where the respondent comprises a consortium, each consortium member and / or subcontractor shall comply with this requirement. Please be aware that the declaration from the respondent may only contain information about the respondent's own country and the tender must then be supplemented with a declaration about the respondent's public debt in Denmark.

3. A complaint lodged on the grounds that the entity was not prequalified for the further tender proceedings must be submitted to the Danish Procurement Board of Complaints within 20 calendar days. The 20 calendar days are calculated from the day where the contractor issued information to the entities expressing interest on which entities has been prequalified, provided that this information contains a short explanation on the relevant reasons for the decision.
