The contracting authority will invite five candidates to participate in the tender process. If there are more than five suitable candidates which meet the minimum requirements, the selection of the five to be invited will be done applying the following criteria in order of priority: 1) Which candidates have the better technical capacity based on an assessment of the relevance of the reference projects in the candidate's list of works; 2) Which candidates have the better technical capacity based on the information submitted according to clause III.2.3 no. 2) (statement on manpower and actual number of employees in the requested categories). Depending on the period required for the tender procedure and the final approval of the contract by the contracting authority, the contract for the tendered project is expected to be signed in the beginning of 2015. The contemplated works are expected to be initiated soon hereafter.

The candidate is requested to submit the following documentation:

1) A description of the candidate's legal nature (e.g. whether the candidate is a limited liability company), short business profile, registered address, contact person and contact details for the contact person.

2) A solemn declaration signed by the candidate verifying that the candidate has not been the subject of a conviction by final judgment of any of the matters listed in article 45 (1) (a), (b), (c) or (d) of Directive 2004/18/EC, and that the candidate is not in any of the situations referred to in article 45 (2) (a), (b), (c), (d), (e), (f) or (g) in Directive 2004/18/EC.

The candidate should preferably submit the documentation in one paper copy and one electronic copy (DVD, CD or USB).

If the candidate is a group of economic operators, 1) the above must be submitted for each of the economic operators in the group, and 2) the candidate must submit a solemn declaration certifying that the members of the group undertake joint and several liability in case the candidate is awarded the contract.

The candidate may (but is not obliged to) use the declarations and forms in the Pre-qualification Questionnaire avaiable on the contracting authority's website www.fhhavn.dk.

Økonomisk og finansiel stilling:

The candidate is requested to submit the following documentation:

1) A statement from the candidate stating the equity (net assets) of the candidate according to the candidate's annual accounts for the most recent financial year for which the annual accounts have been audited. A copy of the audited annual accounts should be included in the application. Accounts must comply with International Financial Reporting Standards. Minimum requirement: The equity (net assets) must be at least 25 million euro or the equivalent thereof in any other currency.

2) A statement, dated after the date of this tender notice, from a bank or financial institution, licensed to do business in the EU/EEA certifying that the candidate has available to it at the date of the statement a guarantee facility or guarantee commitment which will allow the bank or financial institution to issue a guarantee of at least 10 million euro in favour of Frederikshavn Havn A/S for the obligations of the candidate, should the candidate be awarded the tender contract. The statement should preferably be made in the form published in the Prequalification Questionnaire available on the contracting authority's website www.fhhavn.dk or on similar terms.

The candidate should preferably submit the above documentation in one paper copy and one electronic copy (DVD, CD or USB).

If the candidate is a group of economic operators, it is sufficient that one of the economic operators comply with the requirements listed in item 1) and 2) of this clause III.2.2.

If the candidate relies on the financial ability of another entity, the candidate must submit documentation certifying that the financial means of such other entity are available to the candidate to support the candidate's fulfilment of the contract, and a solemn declaration as mentioned in clause III.2.1, no. 2), signed by such other entity, must be included in the application.

The candidate may (but is not obliged to) use the declarations and forms in the Pre-qualification Questionnaire available on the contracting authority's website www.fhhavn.dk.

Teknisk og faglig kompetence:

The candidate is requested to submit the following documentation:

1) A list of harbour construction works carried out over the past five years similar to the actual tender (including breakwaters, quay walls with sheetpile-, piles- and concrete work as well as dredging and reclamation work), indicating the value or contract sum, year of performance/completion and site of the works. Minimum requirement: The candidate must have completed at least one harbour construction project similar to the actual tender within the past five years with a contract sum of such single project of minimum 15 million euros (or the equivalent in other currency).

2) A statement for each of the last three years of (i) the average annual manpower of the candidate which has been predominantly occupied with harbour or sea water construction works, and (ii) the candidate's actual number of employees predominantly occupied with or experienced in harbour or sea water design engineering and construction works in the employee categories: "Design managers", "Design senior engineers/experts", "Contract managers" and "Contract senior engineers/experts".

The candidate should preferably submit the documentation requested according to this clause III.2.3 in one paper copy and one electronic copy (DVD, CD or USB).

If the candidate is a group of economic operators, it is sufficient that one of the economic operators comply with the minimum requirements listed in clause III.2.3.

If the candidate relies on the technical capacity of another entity, the candidate must submit documentation certifying that the technical abilities and resources of such other entity are available to the candidate to support the candidate's fulfilment of the contract, and a solemn declaration as mentioned in clause III.2.1, no. 2), signed by such other entity, must be included in the application.

The candidate may (but is not obliged to) use the declarations and forms in the Pre-qualification Questionnaire available on the contracting authority's website www.fhhavn.dk.

Kontraktens udførelse
Krav om deponering og sikkerhedsstillelse:

The draft terms of the contract will be part of the tender documents. It is expected that the contractor will be required to provide security for the due performance of his obligations towards the contracting authority corresponding to approx. 10-15 % of the contract sum. Further details will be set forth in the tender conditions.

A group of economic operators which request to participate in the tender process must undertake joint and several liability to perform the contract. Such group must, furthermore, authorise one member of the group to represent the group with legally binding effect for all members of the group.

The contracting authority may request the winning tenderer to present additional proof that the tenderer is suitable according to the conditions of clause III.2.1. The contracting authority may refuse to accept that a contractor uses subcontractors which are not suitable according to the conditions of clause III.2.1.

The minimum salary payable by the contractor for work performed in Denmark of the nature comprised by the contract must at least correspond to the minimum salary requirements agreed in collective bargaining agreements entered into by the most representative labour market parties and applicable for all of the Danish area.
