Vordingborg Kraftvarme A/S

The tender covers the conclusion of a contract for a major overhaul of an ABB V25 (10 MW) steam turbine for Vordingborg Kraftvarme A / S. The turbine has passed 200,000 EOH and underwent the last major overhaul at 100,000 EOH.
The main overhaul is part of the maintenance of the steam turbine and includes the following deliveries:
1. Cleaning of all components of the turbine, including reducers, valves and servos and inspection of all these components
2. Delivery and replacement of known lifetime expired parts
3. Fact-finding
4. Renovation / repair of defective and damaged parts
5. Delivery spare parts and replacement of defective parts found during fact-finding.
In the case of deliveries referred to in sections 4 and 5, it is noted that these services are only actualized if there are identified defects or damage to the turbine in connection with deliveries described in sections 1 and 3. The content and scope of deliveries under sections 4 and 5 will therefore depend on the result of the major overhaul and the specific needs arising from the identified defects and damages to the turbine.
The contract is thus a mixed contract consisting of both services in the repair and maintenance of the steam turbine and the purchase of spare parts (purchases) for any repairs and replacements. The contract contains a framework-like element with respect to the content and scope of the purchase of repair services and spare parts.
Since the value of the services is estimated to exceed the value of the supplies, the contract is tendered as a service contract.
Duration of the contract is expected to be approx. 8 months from contract award see also section. II.3. However the contract is not completed until all deliveries in section 1-5 above are completed.

Pursuant to section 1, it is noted that there are additional documents which the applicant may request from the entity during the prequalification phase. Additional documents in the form of tender documents will only be sent to the suppliers after the prequalification in connection to the invitation to tender. Questions and answers concerning the prequalification will be posted on the entity's website. (http://www.vordingborgforsyning.dk/kraftvarme/major-overhaul-steam-turbine). Applicants are encouraged to keep themselves updated on the website. The request for prequalification must be prepared on the basis of the in section III.2 specified conditions for participation. Applicant companies must deliver all of the statements, declarations, etc. required in section. III.2.1, III.2.2 and III.2.3. to be considered as a possible tenderer. For groups of companies (e.g. Consortium), the equity ratio in percentage is calculated as the consortium's entire equity capital value in relation to the consortium's total assets. If the applicant relies on other companies' performance, the applicant's equity ratio is calculated as the applicant and the other companies in the total equity capital value, relative to their total assets, calculated as a percentage. If the candidate relies on other entities' performance, the applicant's equity ratio is calculated as the total equity of the applicant and the other entities, relative to their total assets, calculated as a percentage. If the candidate relies on other entities (e.g. Subcontractors or units in the same group, including parent companies, affiliates or subsidiaries), the applicant shall fully possess the resources necessary for performance of the contract, see The Utilities Directive Art. 54 pcs. 5 and 6. This can be documented by decree or by presenting evidence of undertaking by those entities to place the necessary resources. Otherwise, the Contracting Authority will not be allowed to focus on the other entities capacities. The Contracting Authority intends to invite a maximum of 5 candidates to submit their offer in the negotiations. Possible limit on the number of candidates invited to tender will be made after an assessment of the candidates (I) have demonstrated the best economic performance in light of the reported revenues and equity ratio, cf. II.2.2 and (II) have demonstrated the best and most relevant reference, cf. III.2.3. There will be special emphasis on similar services, which includes audits of the same turbine type and / or the same turbine size, cf. II.1.5. In the assessment, (II) weighs more than (I). Each applicant may submit only one request for prequalification. The request must be in Danish. Time-limit for receipt of requests for prequalification follows section. IV.3. The request for prequalification must be sent to Ramboll A/S, see contact details in section. I.1. The request for prequalification should be submitted in one physical (paper-based) copy. The Contracting Authority also wants the applicant in addition to enclose 2 physical (paper) copies of the application and one electronic copy of the request accompanied on a physical medium, for example. CD/DVD-ROM or USB flash. The request for pre-qualification may NOT be placed by email. With reference to section. II.3, it is further disclosed that the duration of the contract is expected to be approx. 8 months from contract award. However the contract is not completed until all deliveries included in the major overhaul as described in section II.1.5) are completed. With reference to section. IV.3.5, it is further disclosed that the application for prequalification must be in English or Danish, and the tender documents will be available in English, and bids must be submitted in English or Danish. The tender documents will be detailed provisions for exemptions from this requirement Danish, for example in relation to the technical annexes, which are expected to be delivered in English, Danish, German Swedish or Norwegian. Negotiations held are according to the same requirement for language as applicable to the contract documents. The deadline for submission of negotiation deals is expected to be in September 2014. Immediately thereafter, negotiating sessions will be held, i.e. October 2014. Any separation of tenderer during the negotiation phase, including permit conditions would be included in the tender documents.

As all the timely received proposals reviewed under the negotiated procedure according to Notice number in the OJEU: 2014/S 132-237593 of: 12/07/2014 did not meet all the minimum requirements in the tender documents, Vordingborg Kraftvarme A/S was obliged to reject all 4 proposals. Vordingborg Kraftvarme A/S therefore cancelled the tender process in order initiate a procedure without prior call for competition in accordance with the Utilities Directive article 40 paragraph 3 a). This contract reward notices pertain to this renewed procurement procedure initiated in accordance with the Utilities Directive article 40 paragraph 3 a).
