Applicants should also note that the Danish legislation on industrial cooperation is undergoing change and that the new rules are expected to enter into force in the 2nd quarter of 2014. Pursuant to the draft version of the new rules, industrial cooperation may be required, in so far as a concrete assessment shows that such cooperation is necessary in order to safe-guard essential Danish security interests. The selection of the candidates that will be invited to submit tenders will be based on (listed in decreasing order of priority):
1. The refrence list including, the scope and value, the description, frequency and the relevance and nature of the candidates' previous similar deliveries.
2. The statement regarding the undertakings turnover in the area covered by the contract in relation to the undertakings overall turnover.
3. The undertakings solvency ratio for the past three financial years available.
4. The undertakings overall turnover.
Please note that any ambiguities and/or incomprehensibilities in the information submitted under III.2.2) and III.2.3) may be regarded negatively in the evaluation when selecting the limited numbers of candidates.
Regarding clause IV.1.2) Limitations on the number of operators who will be invited to tender or to participate, candidates are specifically made aware, that this limitation relates to both lots.
