I/S Ensted Transithavn

Handling of coal including unloading of ships, loading of barges and maintenance of equipment and facilities at I/S Ensted Transithavn (ETH) in Aabenraa, Denmark. Coal handling is expected to start up in November/December 2013 or January 2014. The tenderer awarded the contract must expect to take over the staff in the assigned location in accordance with the rules in the Act on Employees' right in the event of Transfer of Undertakings, Act No. 710 of 20.8.2002. Any special conditions for the take-over of staff, including employment conditions, will be described in the tender conditions. The number of employees at the location is currently appx. 20 employees including 1 person at management level. A reduction in the number of employees must be expected before the commencement of the contract due to lower activity level.

The tasks to be handled have previously mainly been performed by the staff to be transferred to the tenderer who will be awarded the contract, but the required manpower will vary according to the amount of coal to be handled and may during peaks exceed the number of employees taken over. For the required services ETH commits to the exclusive use of the tenderer who is awarded the contract. The tasks are coordinated on a regular basis with the contractor. ETH intends to limit the number of tenderers who can bid to up to 5 tenderers. If there are more applicants than the planned number, prequalification of the applicants will be based on the information provided regarding the applicants' financial ability, technical capacity and employee relations. The amounts in section II.2.1 represents the estimated value of the service agreement for a 5-year period. ETH expects to require a right to terminate the contract for convenience to its expiry 24 months after its commencement date against ETH's payment of a compensation to the supplier. Further information regarding this will be included in the tender conditions. If more companies submit an offer in a consortium, the tender must be submitted jointly by the companies, who must assume joint and several liability for the tender submission and during the performance of the contract. One of the consortium members must have full procuration to ETH. A form shall be obtained at the contracting entity, see section I.1 (form No. 5). The consortium's request to participate in the prequalification shall moreover contain required documentation for every participant in the consortium in accordance with section III.2.
