The prequalification stage and the subsequent tender stage will be carried out digitally, but it should be noted that information about who has been selected and award letters will be sent to the e-mail address of the contact person informed by the applicant/the tenderer. The construction contract concerns the construction of a carcass for a new three storey research and laboratory building with two storey basement. The size of the building is approx. 27 000 m

In outline, the work consists of:

a) establishing own construction site and erecting construction site fencing,

b) establishing safety measures and keeping excavation pit dry,

c) fine grade excavation,

d) casting of about 2 100 m

e) wiring in ground,

f) casting of about 3 000 m

g) delivery and mounting of about 15 000 m

h) design of about 21 000 m

i) delivery and mounting of steel lattice girders and trusses in roof,

j) coating of thin plaster on concrete slab,

k) close-off of roof, including roof building and provisional draining off of rain water,

l) close-off of roof building facades,

m) provisional close-off of other facades.

The application must include a statutory declaration certifying that the applicant has not been and cannot be excluded from tenders in accordance with Article 45(1) and (2) of European Parliament and Council Directive no. 2004/18/EC of 31.3.2004. The application must also include the applicant's solemn declaration regarding any outstanding debt payable to any public authoritiies, as this may affect the applicant's ability to prequalify in accordance with Act no. 336 of 13.5.1997.

The client has prepared a statutory declaration which the applicant must use to submit above requested information. If the applicant is an association of applicants (consortium),the statutory declaration must be made for each association (consortium) participant.

The applicant must state which legal entity (e.g. company) is submitting the prequalification application, including whether the applicant is an association of applicants (consortium). If the applicant is an association of applicants (consortium), this information must be provided for each association (consortium) participant. The applicant must also provide information about any CVR no. (business registration number), the applicant's address and contact, including email address and phone number of such contact.

Please also see item VI.3, which states that the applicant must use the mandatory prequalification form prepared by the client. Both forms are available via iBinder.dk under the tab ‘Prequalification documents’, and both forms must be submitted under tab ‘Application’ via iBinder.dk.

Økonomisk og finansiel stilling:

A solemn declaration regarding the applicant's total turnover, equity to debt ratio as well as cash-to-current-liabilities ratio for the last 3 financial years. The information must be stated in the table contained in the prequalification form which it is mandatory for the applicant to use. If the applicant is a group of applicants (a consortium), the information regarding economic and financial capacity must be provided for each participant in the group (the consortium).

Mindstekrav til niveauet:

The applicants must in each of the 3 most recent financial years have an annual turnover of at least 500 million DKK. If the applicant is a group of several applicants (a consortium), the total annual turnover of the consortium must for each of the 3 most recent financial years be at least 500 million DKK. The applicants must have an average equity to debt ratio in the 3 most recent financial years of at least 15 %. If the applicant is a group of several applicants (a consortium), all members of the consortium must have an average equity to debt ratio of at least 15 % in the 3 most recent financial years.

The applicants must have an average cash-to-current-liabilities ratio of at least 100 in the 3 most recent financial years (i.e. the current assets must at least be equal to or exceed the short-term debt). If the applicant is a group of several applicants (a consortium), all members of the consortium must have a cash-to-current-liabilities ratio of at least 100 on average in the 3 most recent financial years.

Teknisk og faglig kompetence:

When completing the mandatory reference form drawn up by the contracting authority, the applicant must provide references from the most significant similar construction projects carried out/initiated within the last 5 years prior to the date of application. The reference form must be completed for each individual reference. The references submitted for consideration should include the customer's name, the services rendered in the construction project, the size of the construction project in terms of area (including whether it is gross or net area), the period of the construction project (which is to be understood as the term of the contract/performance), the contract price (in DKK).

A reference should furthermore include information as to whether the construction was carried out in relation to and/or integrated in an existing building stock which is at the same time in normal operation. References should furthermore include information as to whether the project was carried out in an area in which the construction of other building projects was carried out in the immediate neighbourhood at the same time.

The references must be submitted as a solemn declaration and, therefore, each reference form must be dated and signed.

The reference must be submitted under the tab ‘Application’ in iBinder.

It should furthermore be noted that the applicant must submit key figures regarding compliance with time limits, defects, work-related accidents, and customer satisfaction for the most significant previously completed construction projects within the last 3 years pursuant to the provisions of section 9 of Executive Order no. 1469 of 16.12.2009 on key figures for governmental construction works, etc. (i.e. one or more relevant ‘fact sheets’).

If the applicant has had its key figures calculated in at least three previously completed construction projects within the last 3 years, the applicant must furthermore submit supplementary information pursuant to the provisions of section 9, including a weighted average for each of the mentioned key figures and information on partly or completely interrupted evaluation cases (i.e. a ‘grade book’).

If the applicant is not in possession of key figures calculated according to the definitions stated in the Executive Order, the applicant must submit equivalent information for the purposes of the selection process, cf. section 9(5) of the Executive Order. Equivalent information is information about previous achievements within the last 3 years documenting that the applicant can meet the requirements and the required qualifications in the four areas. Key figures and fact sheet must be submitted under the tab ‘Application’ in iBinder.

It is pointed out that completion of the reference form cannot replace the submission of key figures.

Similarly, the submission of key figures cannot replace the completion of the mandatory reference form for the references that the applicant wishes to include in the assessment of the applicant's suitability. Completed and signed reference forms must be submitted via iBinder.dk under the tab ‘Application’.

Kontraktens udførelse
Krav om deponering og sikkerhedsstillelse:

In accordance with AB92 § 6 with the following addition: If the contract is extended with 10 % or more, then the employer may demand an equivalent raise in the security of the due performance. Regarding § 7 be advised, that the employer will not provide performance bond.

No particular legal form is required. If the order is awarded to an association (consortium), the association (consortium)

participants must accept joint and several liability and appoint a joint legal representative. All the information required in this contract notice must be provided for each association (consortium) participant. The client/employer recommends that every participating unit submit a separate prequalifikation application, jointly makin up the association (consortium) application. Please note that applicants who intend to fulfill the contract also through subcontractors are not considered an association.

Andre særlige vilkår:

It should be noted that this construction project will be evaluated according to the Order No 1469 of 16.12.2009 on key performance indicators building projects carried out by the state etc., and the contract terms will contain provisions to this effect. This means that all contractors must submit for calculation key performance indicators from the building process for this specific projekt. This applies to all contacts which exceeds a value of 300 000 DKK excl. VAT. Applicants are refered to careful reviewing of the requirements in above mentioned Order. It should be noted that the construction contract will include a labour clause imposing on the contractor to ensure that the pay and working conditions of both the contractor's own workers and those of his subcontractors, if any,are no less favourable than those applicable to work under a collective agreement within the trade or industry in question between the most representative labour market partners in Denmark. The contractor will be bound by contract to document that the labour clause is complied with and that any failure to comply can lead to sanctions in the form of retention requirements, fines, and possible cancellation of the contract for breach of the labour clause.

It should be further noted that this construction contract is expected to contain provisions requiring of the contractor to employ trainee(s).

Objektive kriterier for udvælgelse:

The number of applicants who will be prequalified to submit a tender is stated to be five. If the number of suitable applicants exceeds this number, the best suited applicants will be prequalified on the basis of an assessment of the references from construction projects which are comparable to the project tendered for, cf. item III.2.3 Technical capacity. It will have a positive effect on the assessment of the comparability of a reference if it comprises work carried out in relation to and/or integrated with an existing building stock similar to DTU Lyngby Campus, while in normal operation. It will also have a positive effect on the assessment of the comparability of the reference if the construction was carried out in the immediate neighbourhood with simultaneous construction of other building projects. If more than 5 applicants are still assessed to be suitable on the basis of the references submitted, the contracting authority will give weight to the applicant's key figures (e.g. grade book), in that a good evaluation regarding compliance with time limits, handling of defects, work-related accidents and customer satisfaction will be decisive.

Appeals regarding non-prequalification must be submitted to the Danish Tender Appeal Board (Klagenævnet for Udbud) no later than 20 calendar days from the day following the day when the ordering authority sent notification to the applicants the result of the prequalification. Appeals regarding other issues must be submitted to the Danish Tender Appeal Board no later than 45 days after the ordering authority publishes a notification in the Official Journal of the European Union to the effectthat the ordering authority has concluded a contract. The deadline is calculated from the day the notification is published. Simultaneously with the appellant's submission to the Danish Tender Appeal Board, the appellant must also inform the client that an appeal has been submitted to the Danish Tender Appeal Board.
