Aarhus University

The Contracting Authority wants to consolidate all purchases of apparatus and instruments as well as laboratory furniture and related consumables, including software, after-sales services and service agreements in a number of framework agreements.
These agreements will substitute the agreements that the Contracting Authority currently holds with a number of suppliers based on two tenders, with a total of 25 lots, conducted and awarded in 2010.
Furthermore the Contracting Authority will in this tender procedure, and the subsequent purchases on basis of mini-tender procedures, have more focus on entering into service agreements with the suppliers where relevant and thereby submitting these service agreements to competition along with the apparatus or instrument.
Consolidation of these purchases is expected to generate a volume of approx. 100 000 000 DKK annually. However, the final volume of purchases depends on a number of aspects, in particular specific requirements, equipment that needs replacing as well as the grants awarded during the term of the framework agreement. The framework agreement holders are not guaranteed any purchases under the agreements.

2. Super speed centrifuges, high speed centrifuges and ultra speed centrifuges
3. Cooling and freezing equipment for laboratories
4. Laboratory furniture
5. Laminar Air Flow benches and safety cabinets
6. Environmental chambers
7. Laboratory washing up machines and pipette washing machines
8. Autoclaves (table and floor models)
9. Industry autoclave
10. Incubators
11. Counters and analysis equipment
12. Electrophoresis instruments
13. Pumps
14. Chromatography solutions and other separation techniques
15. Mass spectrometers
16. Spectrophotometer
17. Robotic solutions
18. Equipment and instruments for analysis and purification of DNA, RNA, proteins and cells
19. Equipment and instruments for PCR, QPCR and real time PCR
20. Water treatment equipment

All natural and legal persons/entities affiliated with the Contracting Authority may make purchases under the framework agreements.

Betingelser for deltagelse
Egnethed til at udøve det erhverv:
Grounds for exclusion.
Any candidate will be excluded from participation where that candidate:
(a) has been subject of a conviction by final judgment in respect of participation in a criminal organisation, corruption or fraud or money laundering;
(b) is bankrupt or is being wound up, where the candidate's affairs are being administered by the court, where the candidate has entered into an arrangement with creditors, where the candidate has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;

(c) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or an arrangement with creditors or any other similar proceedings under national laws and regulations;
(d) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning the candidate's professional conduct;
(e) has been guilty of grave professional misconduct proven by any means which the Contracting Authority can demonstrate;
(f) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which the candidate is established or with those of Denmark;
(g) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which the candidate is established or with those of Denmark;
(h) is guilty of serious misrepresentation in supplying the information required under this clause or has not supplied such information.
Documentation.
In order to prove that one or several of the aforesaid grounds for exclusion do not exist, the candidate must make a solemn declaration in the form of Template A concerning the grounds for exclusion mentioned above.
Please note that the solemn declaration must be completed by ticking the boxes and subsequently signed. A lacking or incorrect solemn declaration may mean that the request to participate will be deemed non-conforming and rejected.
At the request of the Contracting Authority, the candidate who the Contracting Authority intends to contract with is obliged to provide further documentation that one or several of the aforesaid grounds for exclusion do not exist.
Candidate's personal affairs.
Consolidated Act no. 336 of 13.5.1997 on the limitation of debtors' participation in public works contracts, etc., stipulates that, in connection with the purchase of goods and services, the public contracting entity must demand that any candidate make a solemn declaration stating to which extent the candidate has unpaid mature debt to any public authorities in the form of taxes, duties and contributions to social security schemes under Danish law or the laws of the country in which the Candidate has its registered office.

The Candidate must make a solemn declaration in the form of Template A attached to these instructions to candidates to be submitted together with the request to participate.
Økonomisk og finansiel stilling:
The Contracting Authority will only contract with financially sound entities as it is of material importance that the Candidate stays in business for the entire contract period.
Consequently, the Contracting Authority will take the following economic factors into account:
— the turnover of the candidate in the previous financial year,
— the solvency ratio of the candidate in the previous financial year.
Documentation.
The Candidate must complete Template B and enclose documentation showing the entity's turnover and solvency ratio in the most recent completed financial year. Such documentation can e.g. be the candidate’s latest audited annual report or a statement from an independent auditor or a bank or other respected financial institution. This requirement may, however, be excluded, if the candidate is a start-up entity not yet having presented its financial statements.

If the candidate is a consortium the documentation must be enclosed for each individual entity having presented financial statements.
The following formula is applied when calculating the candidate's solvency ratio:
(Capital and reserves x 100) / (Total assets).
Teknisk og faglig kompetence:
It is of decisive importance to the Contracting Authority that the candidate has the required technical capacity to act as a supplier to the Contracting Authority.
The candidate must document its technical capacity by providing the following documents and Template C in completed form:
a) information on the lots for which the candidate is able and intends to submit a tender;
b) information on the involved technicians or technical bodies, and in particular on those responsible for the quality control, irrespective of whether they are part of the candidate's business activities;
c) description of the technical equipment and the quality measures taken by the supplier, and the entity's investigation and research facilities;
d) information on the product range that the candidate generally offers. The Contracting Authority seeks to prequalify candidates that either offers a very wide range of products as well as candidates that offer few but highly specialised products;
e) information on the service organisation of the candidate including information on the general measures taken by the candidate to ensure a high level of after sales services and support when a service agreement as such is not purchased as well as when it is purchased. The candidates should enclose relevant documentation and state the number of employees dedicated to service, general response times etc.

Objektive kriterier for udvælgelse:
The Contracting Authority will prequalify companies best suited to perform the contract and ensure competition on the basis of the information provided by the Candidates pursuant to section III.2.2) and III.2.3). The Contracting Authority will look at the information provided as a whole, and it is in the interest of the Contracting Authority that the competition in the award phase is ensured. The products covered by the different lots have different purpose and target groups. Hence the Contracting Authority will differentiate in the way they select candidates for each lot. All Candidates will be assessed on the information provided by the Candidates pursuant to section III.2.2) and III.2.3). The Contracting Authority will however prioritise this information according to each given lot, and the Contracting Authority will seek to prequalify companies with one of the following profiles according to the specific lot:

— broad product ranges – expectedly larger companies with a significant turnover and positive solvency ratios,
— highly specialized product ranges – expectedly smaller sized companies with a lower turnover and moderate solvency ratios.
