Fehmarnbelt Fixed Link Railway Infrastructure – Framework Agreement for Assessment Body and Notified Body Services

Femern A/S

According to the Danish Planning Act Femern A/S is tasked with designing and planning this Fixed Link between Denmark and Germany across the Fehmarn Belt. Femern A/S is a subsidiary of the Danish, state-owned Sund & Bælt Holding A/S, which has experience from the construction of the fixed links across the Great Belt and the Øresund.
The infrastructure of the Fehmarnbelt Fixed Link project covers a distance from the connection to Danish Hinterland project at Lolland (Rødby) via the Fixed Link (combined rail- and road tunnel) to the connection to the German Hinterland project at Fehmarn (Puttgarden). The railway coast-coast project is classified as Core TEN-conventional new line for mixed traffic, class IV-M, and will be an ERTMS double-track electrified line, established as a part of the conventional TEN-T railway network.
Parallel to the establishment of the Fixed Link, Femern A/S is a company which will achieve safety approval leading to the status as Infrastructure Manager for the Fixed Link infrastructure.
As a prerequisite for this status the Fixed Link Railway project must demonstrate that the entire project’s risk management process is compliant to the requirements in the European Safety Directive. Also the European Interoperability Directive requires that the Fehmarnbelt Fixed Link Railway infrastructure demonstrates compliance to the European Technical Specifications for Interoperability (TSI).
The framework agreement covers the Independent Assessment (CSM RA) and the EC-Verification of the entire Fehmarnbelt Fixed Link project comprising:
— the Independent Assessment (CSM RA), acc. to the EC Safety Directive (2004/49/EC) and the EC Regulation on Common Safety Method on risk evaluation and assessment (352/2009/EC),
— the EC-Verification by a NoBo (acc. to: Art. 2, litra j, Art. 28 and Art. 18 of the Interoperability Directive (2008/57/EC) up to commissioning the Fixed Link Railway infrastructure and completion of the project.
The Assessment Body shall also perform the Notified Body (NoBo) tasks covered by the Interoperability Directives and the corresponding Technical Specifications for Interoperability (TSIs). The Assessment Body must thus be a certified NoBo.
The State Treaty determines that beyond the obligation of demonstration of compliance to the EC Directives (Safety and Interoperability) the Fixed Link shall be built according to Danish Norms and Standards as well as demonstrating compliance to German National Safety Rules as notified according to art. 8, of Directive 2004/49/EC.
The framework agreement will cover the period from approximately November 2012 until the operation of the Fixed Link around 2021.
It is anticipated that the detailed assessment of the suppliers' work will be carried out by suppliers own assessors paid by the suppliers. The framework agreement does NOT cover the supplier safety assessors.

1) The candidate shall submit a short description of the firm/company and the organization of the candidate (including a description of the ownership structure).

2) The candidate is asked to submit a copy of the candidate's NoBo certificate regarding the Interoperability Directive, cf. also section II.1.5. The candidate's NoBo number must appear from the certificate. If the NoBo certificate is not submitted, Femern A/S will rely on the NoBo certificate information found on the NANDO website (http://ec.europa.eu/enterprise/newapproach/nando/index.cfm?fuseaction=directive.main).

3) The candidate must sign a solemn declaration showing that the candidate is financially and managerially independent of Femern A/S.

4) The candidate must sign a solemn declaration showing, that the candidate has not participated in providing solutions relating to the Fehmarnbelt Fixed Link project in a way that disqualifies the candidate. However, the candidate can be a company (or a consortium), which have been providing solutions relating to the Fehmarnbelt Fixed Link project, if the section of the company (or consortium), which will be in charge of the assessment is independent of the section, which have been providing solutions to the Fehmarnbelt Fixed Link project.

5) The candidate must sign a solemn declaration showing that the candidate will not contribute with solutions or possible answers relating to the Fehmarnbelt Fixed Link project during his work as an assessor on the Fehmarnbelt Fixed Link project.

6) If the candidate relies on the capacities of other legal entities (e.g. a parent company), the candidate must submit a short description of the other legal entities and the organization of the other legal entities (including a description of the ownership structure) as well as - if relevant - a copy of the other legal entities' NoBo certificates regarding the Interoperability Directive as well as solemn declarations, cf. no. 3-5 from the other legal entities.

7) If more than one economic operator submits a request for prequalification (e.g. a consortium) each participating party of the consortium must submit a short description of the company and the organization of the company (including a description of the ownership structure) as well as solemn declarations, cf. no 3-5. If more than one of the participating parties are certified NoBos, a copy of each of the parties' NoBo certificate regarding the Interoperability Directive must be submitted, cf. no. 2.

Økonomisk og finansiel stilling:

1) A statement of the candidate's turnover within the key areas mentioned in section III.2.3, 2.3.1 for the last 3 financial years available, depending on the date on which the candidate's undertaking was set up or the candidate started trading as far as the information on these turnovers is available.

2) If more than one economic operator submits a request for prequalification (e.g. a consortium) all the participating parties of the consortium must submit their own documentation and information.

3) If the candidate relies on the capacities of other legal entities (e.g. a parent company), the candidate must prove that the candidate has at his disposal the resources necessary, for instance by providing documentation that the candidate can rely on the capacities of the other legal entities in this respect.

Teknisk og faglig kompetence:

1) The candidate shall supply information about the number of persons employed within the key areas mentioned in no. 2.3.1. The candidate shall not submit CVs as a part of the information.

2) The candidate shall document references within the below mentioned 2.3.1. Key areas within the past 5 years (within this period both assignments won but not yet commenced, completed assignments and assignments in progress are of interest, but the candidate is asked to specify for each single reference the situation to which reference is made). If the candidate has fulfilled similar activities as part of a consortium or the candidate has acted as sub-supplier on similar contracts, the exact contribution by the candidate shall be highlighted.

It should be noted, that a reference is only relevant if at least one of the key personnel who worked with the project, which the reference is concerned with, is still working in the candidate company at the time when the application is submitted. In each reference the candidate must thus include information on the number of key personnel working with the reference-project who are still working in the candidate company at the time when the application is submitted.

2.3.1. Key areas:

a) Large scale railway infrastructure and rail tunnel projects;

b) EC-verification of complex infrastructural systems involving internal as well as external interfaces and numerous stakeholders;

c) Independent Assessment according to CSM-RA 352/2009/EC and in relation to EN50126, EN50128 and EN50129 including assessment of tunnel safety;

d) Experience regarding assessment of combined construction complexes, i.e. combined rail and road tunnel complexes will be advantageous;

e) Knowledge of Danish and German Norms & Standards and safety requirements.

The framework agreement was awarded to the Consortium RINA Services S.p.A. & SINTEF, and the contract award notice (no 2013/S 030-046564) was published on 12 February 2013. This notice concerns Femern A/S' intention to prolong the existing framework agreement between Femern A/S and Consortium RINA Services S.p.A. & SINTEF until 31 December 2029 where the construction of the Fixed Link across the Fehmarn Belt is expected to be finalized, though at least until the finalization of the Fixed Link (as was the original intention with the procurement, cf. the contract notice), cf. section IV.1.1) for further information.

Complaints must be submitted to The Danish Complaints Board for Public Procurement before the expiry of 30 calendar days, see section 7(3) of the Act, from the day after the contracting entity has published a notice in the Official Journal of the European Union that the contracting entity has entered into a contract if the notice includes an explanation of the grounds for the decision.

Not later than at the time of lodging a complaint with The Danish Complaints Board for Public Procurement, the complainant must notify the contracting entity in writing that a complaint has been lodged with The Danish Complaints Board for Public Procurement and whether the appeal was lodged during the standstill period (i.e.10 calendar days starting on the day after this notice has been published in TED).

On 7 July 2012 the contract notice (no 2012/S 129-214427) concerning the Framework Agreement for Assessment Body and Notified Body Services, was published in TED. The framework agreement was awarded to the Consortium RINA Services S.p.A. & SINTEF, and the contract award notice (no 2013/S 030-046564) was published on 12 February 2013. By voluntary ex ante transparency notice (no 2021/S 245-647672) Femern A/S announced Femern A/S intention to prolong the existing framework agreement between Femern A/S and the Consortium RINA Services S.p.A. & SINTEF until 31 December 2029 where the construction of the Fixed Link across the Fehmarn Belt is expected to be finalized, though at least until the finalization of the Fixed Link (as was the original intention with the procurement, cf. the contract notice). After this (and the expiry of stand still as stated in notice no 2021/S 245-647672) the framework agreement has been prolonged.

In regards of section II.2.5) it is noted that the award criteria are as stated in the initial tender documents. This notice is sent in continuation of the prolongation of the existing framework agreement. Therefore, there has not been a new invitation to participate or a tender deadline, no new tender documents and therefore also not any evaluation of tenders. The value stated in section II.1.7) and V.2.4) is the estimated total value of the existing framework agreement, i.e. including the prolongation. It is noted that part of the amount, that exceeds the initial estimated value (DKK 10,000,000, cf. contract notice), represents indexation and is therefore not in fact an actual modification of the framework agreement’s value, and that the estimated total value further includes a buffer of 5 % taking into account future unexpected changes in value.
