Design and Build Contract - Completion of design and construction of a large indoor multipurpose arena in Copenhagen

Arena CPHX P/S

Realdania and the City of Copenhagen are working to develop a large indoor multipurpose arena in Copenhagen, Denmark, through a joint company called Arena CPHX P/S. The arena will meet a strong local and regional need for entertainment, cultural and sporting events facilities and act as a key driver of economic development. Copenhagen arena will form an important part of the image of Copenhagen, contributing to the life of the city, its people and visitors well into the future. The facilities will be marketed nationally and internationally and must be seen to be of a high quality, when measured against similar facilities worldwide, in order to attract the best artists and events from around the world.
The arena will have a capacity of around 15 000 spectators and will include 1 000 premium lounge seats plus 20 suites with a capacity of 12-15 persons each. Live Nation has entered into an agreement with Arena CPHX to lease the arena for 30 years on its completion in the summer of 2015. The arena is located in Ørestad Syd, a new district between the airport and city centre, with the arena acting as a catalyst for investment in the planned developments that will surround it. The scope of this contract will be to complete the design of the arena and construct it. A design team has been appointed for full services comprising of 3XN, HKS, Arup, ME Engineers and Planit IE. They will be novated to the successful organisation appointed to design/build the arena.

Betingelser for deltagelse
Egnethed til at udøve det erhverv:
1) Name, registration number, and contact details of candidate enterprise.
2) Solemn declaration that the candidate enterprise owes no unpaid due debt in excess of DKK 100,000 to any public authority, cf Danish Consolidated Act No 336 from 1997 (the Danish Act on Arrears). This declaration must be confirmed prior to the conclusion of the contract.

4) Presentation of a consortium agreement if the candidate is a consortium, and its members have concluded such agreement.

1) Information on the finances of the candidate enterprise in the form of financial data for the three (3) most recent financial years available in the form of revenue, result, equity and debt to equity rate. The financial data must be certified by a registered or a state-authorised public accountant. If the business has not existed long enough for financial data for the three (3) most recent financial years to be availiable, financial data must be submitted for the year(s) for which financial statements have been presented. Newly founded businesses, which have yet to present financial statements, must submit an audit opinion documenting the economic and financial capacity of the business.

2) Statement by the management confirming that no material change in the financial situation of the business has occurred since the end of the most recent financial year or, if such material change has occurred, elaborating on such material change.
3) Documentation for relevant general liability insurance including information on limits of cover, deductible and specification of insurance company.
4) Non-binding 'letter of credit' from a well consolidated bank or other financial institution confirmning that the candidate will be able to provide the guarantee set forth in section III.1.1 above, if no material change in the candidate's financial position occurs.

Guarantees will be required according to the Danish standard conditions for design and build contracts, ABT 93, section 6 (15 % of the value of the contract).

If a candidate is a group of businesses, a 'consortium', the consortium members must be jointly and severally liable and must appoint a representative with whom the contracting entity may conclude agreements that are binding on the consortium.
