Acquisition of military helmets

The helmet will be tendered as a “Military off-the-shelf” product. The helmet must have a high protection level against both fragments & projectiles. Furthermore the helmet must have been Operational Tested; which means that the helmet has been tested by a unit from NATO Allies partner with a documented appertaining evaluation.
Minimum requirements:
The coverage area of the helmet must correspond to MEDIUM CUT (ACH).
To support the soldier’s situational awareness the helmet must be available in 4 sizes covering a circumference of 54-64 centimetres and there must be 2 possibilities of adjusting the helmet ensuring that it can be firmly tightened. The construction of the helmet must allow the adjustment to be carried out using one hand without leaving any loose straps.
The helmet retention system must, as a minimum, be a four point harness system.
Furthermore, the helmet must be designed to be used by soldiers operating the weapon from either the left or the right side.
The material used should contribute to a low overall weight and the weight of helmets with a circumference of 56-59 centimeters should not exceed 1 250 grams. A low weight with a high protection level against both fragments & projectiles will be given a high score in the evaluation. Ballistic screws must be used.
The helmet must be designed to allow mounting of standard equipment for a combat soldier e.g. sensors, battlefield combat identification, sights and with the possibility to add counterbalance on the back of the helmets.
Mounting of mandible guard to secure the soldier from stroke and shock must also be possible. The helmet must be delivered with or must be prepared for the mounting of a bracket for using NVG.
The helmet must be compatible with protective glasses of the type WILEY-X SABER, ESS-CROSS BOW and REVISION SAWFLY as well as CBRN mask AVORN FM12 and with infantry headset INVISIO X5 (S10).
Mandible guard and helmet covers will be requested in a smaller quantity, however. The cover should be designed allowing the use of rails and NVG. For camouflage of the helmet, covers / net / similar must be available. The helmet must be delivered in Coyote tan/brown.
Spare parts for replacing straps, pads, etc., will be requested.
The following products/accessories are expected to be listed as options to the tender:
a. delivery of the helmet in Multicam ® color;
b. visor for the helmet;
c. a high cut helmet with the same protection as will be demanded for the medium cut (ACH) helmet together with ear protection equipment to be mounted allowing the use of headsets. The protection level for the ear protection must be of the same level as that of the helmet;
d. the medium cut (ACH) helmet certified in accordance with DS/EN 397;
e. delivery of Combat Riot Control (CRC) equipment that can be mounted on the helmet.

The military helmet (sample) to be sent to the contracting authority in order to gain prequalification will be examined to determine whether or not the military helmet fulfills the minimum requirements set forth, i.e. complies with the specifications or standards set forth in section III.2.3. No payment will be received for the sample. The mimimum requirements applying to the military helmet (sample) to be sent to the contracting authority in order to gain prequalification must also be fulfilled with respect to the final delivery. In connection with the final tender, a test will be made, cf. below, and this test must fulfill further requirements specified in more detail in the. Tender documents. It should be mentioned that the military helmet delivered as part of the tender does not have to be identical with the military helmet (sample) used for prequalification. However, the military helmet delivered as part of the tender must fulfill all minimum requirements stated in connection with the prequalification. B) Testing of sample helmet (delivered as part of the tender). As part of the evaluation of tenders and prior to awarding the contract, tests will be conducted on several sample helmets to verify that the military helmet (to be delivered) fulfills the mandatory requirements. The tests are expected to take place in May/June 2012 and will require each tenderer to supply 52 military sample helmets to DALO. The tests are expected to have a duration of 2 months. All tenderers will receive payment for any sample helmet delivered according to the official list prices of the tenderer. Such payment, however, will only be made if the tender fulfills all formal and minimum requirements. C) Re. section IV 3.4) Each candidate may only submit one application. The application should preferably be submitted in 3 paper copies and 1 electronic copy on a CD-ROM or an equivalent medium. The list of deliveries should indicate the value of the deliveries in question (purchase prices), the date(s) of deliveries, the location of the deliveries and the recipients involved (names not required, but information regarding whether or not the customer(s) involved were NATO countries must be submitted).

G) As part of the application the applicant must supply DALO with one helmet similar to the military helmet to be supplied, the authenticity of which must be certified if the Contracting Authority so request.

FMI har ved udbudsbekendtgørelse 2012/S 030-048439 haft udbudt rammeaftale på indkøb af militærhjelme samt service og vedligeholdelse (begrænset udbud efter Forsvars- og Sikkerhedsdirektivet (Europa-Parlamentets og Rådets direktiv 2009/81/EF)). Rammeaftalen blev d. 28.9.2012 tildelt Revision Military BV. Aftalens oprindelige værdi blev anslået til at være mellem 34 000 000 DKK og 45 000 000 DKK, jf. udbudsbekendtgørelsen. Der har efterfølgende vist sig et behov for at anskaffe yderligere hjelme på aftalen, ud over det oprindeligt estimerede.

Rammeaftalen vil herefter, med det yderligere indkøb, have en samlet værdi på ca. 77 000 000 DKK. Datoen i afsnit V.2.1) er datoen for beslutningen om at ændre kontrakten. Ændringen vil ikke blive foretaget før udløbet af en 10 dages frist fra offentliggørelse af denne bekendtgørelse.

Omfanget af udbuddet
Kort beskrivelse:
FMI har ved udbudsbekendtgørelse 2012/S 030-048439 haft udbudt rammeaftale på indkøb af militærhjelme samt service og vedligeholdelse (begrænset udbud efter Forsvars- og Sikkerhedsdirektivet (Europa-Parlamentets og Rådets direktiv 2009/81/EF)). Rammeaftalen blev d. 28.9.2012 tildelt Revision Military BV.

Aftalens oprindelige værdi blev anslået til at være mellem 34 000 000 DKK og 45 000 000 DKK, jf. udbudsbekendtgørelsen. Der har efterfølgende vist sig et behov for at anskaffe yderligere hjelme på aftalen, ud over det oprindeligt estimerede.
Der henvises til beskrivelsen ovenfor i afsnit II.1.4).

Oplysninger om frister for klageprocedurer:
Den ordregivende myndighed ønsker at indgå en kontrakt med den i afsnit V.2.3) nævnte leverandør. Ændringen vil først blive foretaget efter udgangen af 10 dage efter offentliggørelsen af denne bekendtgørelse i EU-tidende, jf. Lov om Klagenævnet for Udbud § 4, stk. 1, nr. 2. For klagefrister kan der i øvrigt henvises til lov om Klagenævnet for Udbud § 7, stk. 3, hvoraf det fremgår, at en klage over, at ordregiver har indgået en kontrakt uden forudgående offentliggørelse af en udbudsbekendtgørelse i Den Europæiske Unions Tidende, skal være indgivet til Klagenævnet for Udbud inden 30 kalenderdage regnet fra dagen efter den dag, hvor ordregiver har offentliggjort en bekendtgørelse i Den Europæiske Unions Tidende om, at ordregiveren har indgået en kontrakt, forudsat at bekendtgørelsen indeholder begrundelsen for ordregiverens beslutning om at tildele kontrakten uden forudgående offentliggørelse af en udbudsbekendtgørelse i Den Europæiske Unions Tidende. Klager skal skriftligt informere den ordregivende myndighed om indgivet klage senest samtidig med, at klagen indgives til Klagenævnet for Udbud.
