Conditions which the economic participants must fulfil in order to get access to the agreement:

The Supplier which petitions for qualification must provide complete information/documentation for the following:

1. Name, address and type of company. For companies with personal liability, the ownership situation as well as any limitations in the company’s liability must also be stated.

2. Documentation that the supplier is not involved in any of the situations listed in the tender directive, directive nr. 2004/18/EF, article 45. For suppliers based in Denmark, a copy of the service certificate from the Danish Commerce and Companies Agency must be included. The service certificate may not be older then 1.2.2011. Companies situated outside of Denmark must procure the necessary documentation in another suitable way, possibly, by filling out the accompanying documents.

3. An overview over the last 3 years’ revenue, results and equity. The key figures must be attested by a registered or state authorised accountant. If the applicant is a consortium then information from all companies in the consortium must be supplied.

If the contractor is a part of a consortium, the other participants must be informed that joint responsibility for the consortium is required. Please observe that it is the legal entity which obtains prequalification that has to sign the contract with N1 A/S and thus is fully responsible towards N1 A/S regarding fulfilment of the contract.

Complaints must be filed with the Complaints Board within certain time limits, if the complaint concerns an EU tender. A complaint about not being prequalified must be received by the Complaints Board within 30 days from the day of the contracting entity’s information about who has been prequalified. Other complaints must be received by the Complaints Board within 6 months from the day after publication of the contracting entity’s notice in the Official Journal of the European Communities that the contracting entity has concluded a contract.

Concurrent with the submission of the complaint to the Complaints Board, the complainant shall inform the contracting entity that he has filed a complaint with the Complaints Board.

The easiest way to do this is by posting or emailing a copy of the complaint with annexes to the contracting entity. The Complaints Board must know if the complainant has informed the contracting entity, and therefore the complainant must send a copy of the notification of the contracting entity to the Complaints Board.
